Presentation to Hillcrest
Community
Fire Chief Nigg reported on the Spark of Love Toy Drive and the significant assistance by the Hillcrest Community in collecting, storing and distributing toys to children in the community. Chief Nigg stated that in November 2022, Hillcrest partnered with the La Verne Fire Department (LVFD) for the 30th Anniversary of Spark of Love Toy Drive. Hillcrest selflessly provided LVFD with much-needed storage for the many toys that were donated this year, they also coordinated a dedicated and passionate team of volunteers to sort the many boxes of toys and bikes and created a system for distributing them to families in need the week before Christmas. The toy drive is a big lift each year, and Hillcrest’s partnership was an incredible help during such a busy season. The La Verne Fire Department thanked Hillcrest for being such an amazing partner and helping to make Spark of Love Toy Drive such a great success!

Renewal of Weathermatic Smart
Irrigation Controller AirCard Software
Renewal of Weathermatic Smart Irrigation Controller AirCard Software - In December of 2011, the City Council authorized the purchase of “Smart” irrigation controllers for all City-maintained landscape areas, including the Landscape Maintenance Districts (LMDs). Renewal of the existing Smartlink Aircard software with new Smartlink software is needed to continue efficiency, effectiveness and maintain the health and appearance of the landscape. Included with the software is Smartlink Aircards hardware. These Smartlink Aircards connect the Smartlink controllers to the web application, which provides web-based control from a computer, tablet, or smartphone. It is estimated by using this software there is a saving of 25% or more of water each year over standard irrigation controllers.
Funding of $90,773 for the Aircard software purchase is available through existing parks operations accounts, and some operational funding from benefitting LMDs. This software program is valid for four (4) years and is eligible for renewal after four (4) years.

Resolution No. 23-04,
Proclaiming a Local Emergency
Regarding Winter Storm Damages
Resolution No. 23-04 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LA VERNE, COUNTY OF LOS ANGELES, STATE
OF CALIFORNIA, PROCLAIMING A LOCAL EMERGENCY
REGARDING WINTER STORM DAMAGES - Due to the recent
series of winter storms and the projected continuation of a heavier than normal winter storm pattern exhibiting “atmospheric river” conditions, it is recommended that the City Council declare a local State of Emergency to support emergency response and recovery efforts and gain potential financial assistance in case of localized impacts.

8. Community Development Block Grant
Program (CDBG) for 2023-24
Principal Planner Bowcock reported on the Community Development Block Grant Program (CDBG) for 2023-2024. She stated that this is the 49th funding year for the Community Development Block Grant Program. According to the Los Angeles County CDBG Bulletin, the City of La Verne will be allocated approximately $156,474 in CDBG funds. She stated that staff is recommending that the Senior Hot Lunch Program which has been operating successfully with CDBG funds for over 20 years be awarded the full 20% CDBG funding of $31,290, including $7,500 for staff time to successfully operate the program. Additionally, the City can no longer do public improvement projects due to the new HUD regulation that requires the re- certification of slum/ blight areas. In previous years, the City Council typically allocated $58,000, for the sidewalk repair program that would provide for removal of architectural barriers on damaged sidewalks for approximately 30 locations throughout the City. Staff is asking that the City Council approve these funds again with $8,000 allocated towards the administrative costs associated with the project.
Principal Planner Bowcock also reported that as identified in previous years, due to expanding regulatory criteria, it is difficult for La Verne to find programs that will be deemed eligible, e.g. meeting the national objective of assisting low/moderate income persons. One main challenge is the fact that there are no longer Census blocks within the city that qualify as 51% low/mod. She reported that staff would be conducting an audit for ADA improvements at City Hall and come back to City Council with recommendations.
Mayor called for comments from the Council.
Council Member Johnson asked if the funds could be used for street improvements or for the Public Safety Facility. He stated he did not want to see the funds sold.
Council Member Lau confirmed that staff would conduct an audit and get back to Council with their recommendations.
Mayor opened the public hearing and called for public comments.

It was moved by Crosby, seconded by Lau, and unanimously carried to allocate the 2023-24 Community Development Block Grant funds; and, to adopt Resolution 23-03, approving the proposed projects for funding.

SUBJECT: Purchase of Grant Funded Portable Vehicle Barriers ____________________________________________________________________________
SUMMARY
The Department received grant funding from a State Homeland Security Program (SHSP) to purchase protection barriers to be used to strengthen public safety.
RECOMMENDATION
It is recommended that the City Council:
1. A pprove the purchase of an eight-barrier trailer kit from Meridian Rapid Defense Group for $86,633.48; and,
2. Authorize the City Manager to execute applicable documents.
DISCUSSION
The City hosts various downtown community events such as car shows, wine walks, street fairs, and sidewalk coloring contests. Many of the events require street closures to protect pedestrians who are mingling within the roadway. In order to enhance the security of these events, the Police Department began seeking out more proven methods of limiting vehicle intrusion into special event areas. Current operational plans call for using water barriers or parked vehicles to protect the closed roadway from vehicular traffic . H owever, these vehicles and water barriers are susceptible to penetration from larger vehicles that can overcome those barriers.
The Department’s research determined that Meridian Rapid Defense Group’s product is best suited to meet the demanding needs to aid in efforts to provide safety and security to the community. Meridian’s barrier design provides enhanced mobility and security over the use of water barriers and vehicles in certain areas. The Department has secured funding to cover the cost of the bollards and checked references for the vendor, to include the City of Pasadena, which utilizes them for their large public events with reported positive experiences. Per Administrative Regulation No. 204, the Department conducted an informal bidding proc ess which allows for informal bidding with City Council approval for federal funding sources under $250,000. Bids were solicited from multiple vendors to acquire the portable vehicle barriers (bollards) and Meridi an Rapid De fense Group was determined to be the most responsible bidder.
FISCAL IMPACT
If approved, appropriations of $86,633.48 will need to be added to the Fiscal Year 2022- 23 Adopted Budget in the Miscellaneous Grants Fund. Funding for the security bollards is fully supported by the State Homeland Security Program (SHSP) Grant. There will be no fiscal impact on the City’s General Fund.

SUBJECT: ADDITIONAL COMPENSATION FOR UTILITY SUPERVISOR
ASSIGNED TO STANDBY
____________________________________________________________________________
SUMMARY
After the promotion of employee Ralph Hernandez to Utility Supervisor, the City has a need for an employee to serve in a back -up standby duty role. Since no other non- exempt employees currently qualify for this role, the City Council is requested to authorize, by minute order, additional compensation for Mr. Hernandez to serve on standby when needed.
RECOMMENDATION
It is recommended that the City Council authorize, by minute order, that Ralph Hernandez receive additional compensation as provided under Article 12 of the La Verne City Employees’ Association Memorandum of Understanding when assigned to standby duty.
DISCUSSION
Under state law and in conformance with the La Verne City Employees’ Association Memorandum of Understanding (MOU), the City compensates employees for time they are assigned to “standby” or “on- call” duty. This compensation is to recognize the burden of being able to respond to issues and/or emergencies outside of normal business hours. The compensation provided under Article 12 of the MOU is as follows:
1. Payment for Actual Hours Worked. An employee assigned to standby duty that is called in to perform work shall be compensated for actual hours worked at the overtime rate.
2. Compensation. An employee on standby duty shall be compensated for two (2) hours per day at the rate of the employee's hourly pay rate for each day on standby assignment.
3. City Vehicle. Only an employee assigned standby duty shall be allowed to take an appropriate City vehicle home for official use only.
To be eligible for standby, employees need to have the requisite skills, experience, and certification(s) necessary to perform duties independently covering a multitude of issues from those involving the water system to fallen trees. Recently, the City had three (3) employees eligible for the standby assignment. However, one (1) of those employees, Ralph Hernandez, has earned a promotion to Utility Supervisor which falls under the Middle Management group and is no longer eligible for benefits provided in the MOU. 73 February 6, 2023, City Council Meeting
Page No. 67
Additional Compensation for Utility Supervisor Assigned to Standby February 6, 2023
Further, there are not similar benefits for standby duties contained in the Middle Management benefits resolution. City staff is working with additional employees to become eligible to serve on standby but due to the requirements, it is not anticipated anyone will be eligible in the immediate future. Only having two (2) employees available to serve standby is problematic considering staffing flexibility as well as putting a significant burden on the employees constantly having to fill the assignment.
While Mr. Hernandez is no longer eligible for standby benefits provided in the MOU and there are not similar benefits provided in the Middle Management benefits resolution, Section 3500 of the City’s Personnel Rules and Regulations provide that the City Council can authorize an additional rate of compensation in consideration of an employee serving in capacities other than normal duties. It is recommended that t he City Council authorize Mr. Hernandez to receive additional compensation as provided under Article 12 of the MOU.
FISCAL IMPACT
Appropriations for standby compensation are included in the Fiscal Year 2022- 23 Adopted Budget within the Water Operating fund and no additional appropriations are needed for this action.

SUBJECT: DECLARATION OF INTENTION TO PROVIDE WEED ABATEMENT ON
SPECIFIC PROPERTIES
____________________________________________________________________________
SUMMARY
Each year, the County of Los Angeles Department of Agricultural Commissioner/Weights & Measures, conducts inspections for weeds, brush, rubbish, and refuse on public and private property that may be considered a seasonal and recurrent nuisance. A list of properties is provided to the City for review. City Council is required to declare its intention to provide for this abatement and set a public hearing for affected property owners to register objections to said abatement.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 23- 06, declaring the intention to provide for the abatement of weeds, brush, rubbish, and refuse , and setting a public hearing for Tuesday, February 21, 2023 at 6:30 p.m.
DISCUSSION
Every year, several private and public properties are declared to be a fire hazard, and therefore, a public nuisance due to the overgrowth of weeds , brush, presence of rubbish , or other flammable mate rials. The County of Los Angeles Department of Agricultural Commissioner/Weights & Measures has been designated to inspect the properties, provide notice to the property owners, and perform weed abatement services. The process as permitted by California Government Code Section 39560 to 39588 requires that the City Council first declare its intention to provide for the abatement and set a public hearing to allow affected property owners to register objections to the abatement of the weeds, brush, rubbish, and refuse.

Dear Ms. Estrella,
REQUEST TO REVIEW DECLARATION LIST 2023
Enclosed is a list of parcels in the City of La Verne which have been identified, by inspection, to contain or have the potential to contain weeds or brush sufficient to be considered a public nuisance. We are recommending that the City include them in its annual weed abatement process beginning with the City Council resolution adoption scheduled for February 6, 2023. Please review the list and submit any changes in writing as soon as possible so the Resolution and Final Declaration List be sent to your Cit y for approval.
The same state law pursuant to which the City’s weed abatement program is conducted can also be used to abate rubbish and refuse (illegal dumping, etc.) on private property in your City. If your City is interested in pursuing this, our Department may be able to help.
For more information on this, please feel free to contact me at (626) 575-5487.
Very truly yours,

Agenda Report

TO: Honorable Mayor and City Council
FROM: Colleen Flores, Chief of Police
SUBJECT: AGREEMENT WITH CITY OF PASADENA FOR SUPPLEMENTAL
LAW ENFORCEMENT SERVICES
SUMMARY
The City of Pasadena approached the City of La Verne requesting to enter into a contract to provide supplemental law enforcement functions relating to major events, such as the Rose Bowl, the Tournament of Roses Parade, and other events taking place at the Rose Bowl Stadium in the City of Pasadena. This is the third extension of this agreement between the City of Pasadena and the City of La Verne.
RECOMMENDATION
It is recommended that the City Council approve Resolution No. 23-07, authorizing the agreement between the City of La Verne and the City of Pasadena, for supplemental law enforcement services for a term of three (3) years and authorizing the City Manager to execute the agreement.
DISCUSSION
The safety surrounding around major events and staffing those events with personnel is a challenge to law enforcement agencies. Under a previous supplemental services contract, the City of La Verne has provided law enforcement services at events held at the Rose Bowl Stadium since 2018. The City of Pasadena has current supplemental law enforcement contracts for the Rose Bowl events with the Los Angeles County Sheriff’s Department, City of El Monte, and the California Highway Patrol. This agreement will terminate on February 1, 2026.
FISCAL IMPACT
Under this agreement, the City of Pasadena will reimburse all salaries, wages, or other compensation for services performed not to exceed seventy -four thousand nine hundred ninety -nine dollars ($74,999). The three- year contract will have no fiscal impact to the City of La Verne’s General Fund.
ENVIRONMENTAL IMPACT
Not applicable.

SUBJECT: DISCUSSION AND POTENTIAL CONSIDERATION RELATED TO
DIRECTLY ELECTED MAYOR POSITION
____________________________________________________________________________
SUMMARY
Council Member Johnson has requested an item to discuss and consider revisiting a directly elected mayor in-lieu of the current rotational system set forth by Ordinance No. 1107 adopted on December 6, 2021, by a 4-1 vote of the City Council. This item will allow discussion and for the City Council to provide appropriate direction.
RECOMMENDATION
It is recommended that the City Council provide direction related to re -establishing a directly elected Mayor position.
DISCUSSION
The issue of converting to district-based elections began in 2020 and on December 7, 2020, the City Council held its first Study Session on district voting. On July 6, 2021, the City Council unanimously adopted Resolution 21- 47, a Resolution of Intention to move to district -based elections. After several public hearings, the City Council on a 4- 1 vote adopted Ordinance No. 1107 on December 6, 2021, which set forth the current five districts by which members of the City Council are to be elected. As part of that Ordinance, La Verne Municipal Code section
2.08.030 – Organization meeting, was changed to require the City Council to choose one of its own members as Mayor and one as Mayor Pro Tem. Prior to this change, the Mayor was directly elected for a two-year term. The directly elected Mayor, as well as setting a term of two- years, was initiated by the voters in 1972, as set forth in Resolution 72-21.
While typically an action approved by the electorate requires subsequent amendment only by the electorate, this requirement was changed by Assembly Bill 849 (Chapter 557 of 2019). This bill was approved by the Governor to provide local agencies flexibility to respond to the increasing use of litigation to force by -district elections. As such, the action taken by Council through Ordinance No. 1107 was compliant with law. More specifically to the current request, the Council may not change the method of electing members by ordinance unless it furthers the California Voting Rights Act (CVRA) per California Government Code section 34886. While changing from at-large elections to by -district supports the purposes of the CVRA, switching to an at -large Mayor may not be deemed to further the CVRA without a comprehensive demographic study.
The Council could approve the placement of a ballot measure for consideration by the electorate (whether advisory or compulsory) at a forthcoming General Election. However, it is more than likely that any such change would not be able to take effect until after the next census is undertaken in 2030 and results certified based on California Elections Code section 21605. Specifically, section 21605 (a) states:
101
February 6, 2023, City Council Meeting
Page No. 95
Consideration of Directly Elected Mayor
February 6, 2023
After redistricting or districting pursuant to Section 21601 or 21603, a council shall not adopt new council district boundaries until after the next federal decennial census, except under the following circumstances:
(1) A court orders the council to redistrict.
(2) The council is settling a legal claim that its council district boundaries violate the United States Constitution, the federal Voting Rights Act of 1965 (52 U.S.C. Sec. 10301 et seq.), or this article. (3) The boundaries of the city change by the addition of territory pursuant to Section 21603 or by the subtraction of territory.
Annexing property could trigger section 21605 (a) (3), however, the requirement of section 21603 is the addition of approximately 8,000 residents to the City through annexation, an option that is not attainable through annexing unincorporated areas within our sphere of influence.
Accordingly, it is the opinion of the City Attorney’s office that while options exist within California law to re-establish a directly elected Mayor, the options could expose the City to various claims under the CVRA if attempted to be implemented prior to next federal decennial census. If the City were to direct staff to prepare a ballot measure asking the question of re- establishing a directly elected Mayor position of either two or four years for the next General Municipal Election, if approved, the outcome should not take effect until the 2032 election cycle. As such, an option is to continue with the current selection of Mayor by the City Council until the 2028 or 2030 election at which time the question can be posed to voters. Due to the need to reduce Council districts to four to maintain a five-member City Council, there is concern the action may expose the City to legal liability and challenge under the CVRA. The City Council could also seek to create six districts, for a total seven- member City Council, to reduce the risk of litigation under the CVRA, but that may not be a practical option for a city of our size. Regardless, the use of a demographer will need to be utilized.
FISCAL IMPACT
There is no fiscal impact to the current Operating Budget from gaining potential direction on the issue. If directed to add a ballot measure to the 2024 consolidated Municipal Election which will have two district (3 & 5) elections on the ballot , it will cost an estimated $100,000 more than the two district elections and would have to be added to the 2023-2024 Fiscal Year Budget. If a two-year term at -large Mayor is implemented, the election costs would increase approximately $100,000 per election as estimated using the County of Los Angeles’ Election Estimating Calculator. The City expended approximately $45,000 for a demographic consultant when considering the current district maps and would need to budget an adjusted amount for future demographic work, potentially up to $60,000. Unknown costs related to voter education efforts on the issue would also be incurred.
ENVIRONMENTAL IMPACT
Not applicable.
