City of La Verne Agenda Packet August 15, 2023
7 Honorable Mayor Tim Hepburn and Members of the La Verne City Council:

August 3, 2023
To Whom lt May Concern:

It has come to my attention that there will be discussion on August 7, 2023 regarding La Verne's traditional Christmas day celebration. For many years, members of the city fire department have traveled throughout La Verne with Santa Claus on a vintage fire truck, waving to La Verne residents and giving out candy to children. This event is much anticipated and appreciated, but it is time to reconsider this tradition and create a new way to celebrate.

My understanding is that members of La Verne's fire department participated in this event but stopped participating in 2019. Lacking sufficient fire department member5 to perform this task, in 2019 city staff members were asked to replace the fire department members. Replacement of fire department members with city staff solidified into the "new normal', with more than 30 city staff members and additional volunteers taking over the duties of distributing candy to waiting children in 2023. There were several unfortunate consequences of this change and to this tradition in general, as follows:

1. City staff members had to relinquish their entire Christmas day with their own families on a national holiday. Some of these staff members have their own young children who miss their parents on Christmas Day. City staff members already relinquish July 4th to the needs of residents.

2. City staff members are not essential to protect La Verne residents, as are members of the police and fire departments. As such, they had no expectation to serve the city residents on Christmas day when initially employed. There is a question of the legality of requiring service of city staff members on Christmas day.

3. The tradition of the fire engine with Santa and distribution oftoys and gifts was imposed on city staff and then became a permanent expectation. lt is time to revisit this dynamic.

4. For some, Christmas is a sacred holiday and is observed in formal ways. Some attend Christmas Eve church-based services late in the evening, and others attend services on Christmas day. Religiously observant staff are made to relinquish this practice to attend to city duties. Public employers have increasingly recognized the inappropriateness of requiring such duties from observant members of specific faiths, or mitigating against practitioners of such faiths when they exercise their rights to decline to serve.

5. As La Verne has grown, so has its population and the potential for waiting children to miss the opportunity to have a meaningful interaction with Santa Claus. For some children and other residents of La Verne, this tradition has devolved into a swift race along one's street instead of an enjoyable, meaningful event. There is also the possibility that some streets will be missed altogether, with disappointment as a result.

City of La Verne Agenda Packet August 15, 2023
8 It is in my nature to view every challenge as an opportunity for more constructive action. I have thought for some time about how to maintain a tradition that is joyous without undue burden to a few at the expense of many. Frequently, when we think in fresh ways and apportion the burden more evenly, a solution appears that has unintended positive consequences. My suggestions are as follows:

1. Schedule the firetruck visit to a day other than Christmas. I suggest a weekend day such as the Saturday before Christmas Day. Another option would be to schedule several visits on late afternoons or weeknights.

2. Reduce the burden to drivers and residents by scheduling the truck to appear for several hours in the neighborhood with route termination at a city park in that district.

Residents could wait for the truck to drive by their house or bring their children to the park to visit Santa. After time in each district, the truck would go to the next district location. Visits to districts on different days would reduce the staffing burden on any given day.

3. Parents who are interested in seeing the truck and visiting with Santa would take their children to the park. After all, parents take their children to see Santa at Mainiero Square, and on a day other than Christmas. This could tun into a fun family ritual.

4. Require city council members to be present at the park aligned with their district. This way, city council members are directly participatory, give up a few hours of their time, and connect with their district constituents. City council members should be instrumental in recruiting resident constituents to help with candy and toy distribution (and maybe even decorating that part ofthe park where the firetruck stops).

5. A schedule can be developed for firetruck locations and stops; the schedule would be posted on the city calendar.

As President ofthe La Verne Historical society, no one appreciates tradition more than l.

However, we must realize that La Verne has grown to a population size of over 32,000, and.

Althou$h limited geographically, is still much larger than it was when this tradition began. tt is possible to preserve the spirit of this tradition without placing an excessive burden on city staff members who value their family time as much as anyone else.

Making this change would not "take Santa away from children", as some may claim. Rather, this new approach will create an additional opportunity to build community in La verne, as people come together, decorate their park space, and eagerly greet santa on his visit through their neighborhood.

Thank you for this opportunity to speak.

Christmas in La Verne
To whom it may concern.

I have been a resident of La Verne for just over 2 years. I grew up in Glendora and prior to moving here, I had no idea of the amazing Santa visit that occurs every Christmas in this town. As a mother to a now 4 year old, I can not explain the joy she gets from this each year. I am so glad this city is so amazing to the people that live here.

That said, I am very aware of the burden this puts on law enforcement, the fire department, and the city staff who take their Christmas mornings away from their families to bring this joy to our home. As much as we enjoy this, I am a proponent of moving this to a different day or cancelins altogether to give these folks their Christmas day back.

Sincerely,
Gerrie Martinez.

A La Verne resident.

6ood morning everyone,
I om submitting my comments to the Christmos Morning Study Session, as f will not be qvoiloble to ottend tonight's meeting. Thonk you for the opportunity.

My nome is Jennifer Kesterson, o long-time La Yerne resident. I am speaking as both a private citizen and as a CERT team member who has volunteered to support this event for the past several years.

First, as a private citizen. I have lived in La Verne for almost 30 years. I love the Christmas Morning tradition and look forward to it every year. I appreciate the long history and the special hold it has on the community. I listen for the sirens and look for Santa on the fire truck. When it finally arrives, I hurry out to wave at Santa and the workers. f toke pictures and send them to my family with a message "Merry Christmas from Small Town USA!" For this reason, I support the commlttee's new proposal to relieve lhe burden on City Stoff, Fire Deportment Personnel, ond volunteers so they con celebtate Christmos Doy with their fomilies.

Thonk you,
J enniler Kesterson

For the past few years, I also attended the planning committee meetings and helped recruit CERT volunteers to drive or navigate the vehicles on the routes. I experienced the mojor challenges thot the committee, stoff, ond volunteers foce every yeot.

Eventuolly f came to reolize that the 1 or 2 minutes of this special holiday tradition in front of my house comes at a Breat cost to City staff and the volunteers who are expected to participate for the duration of the event -- rain or shine, startlng before 5am and ending in the late afternoon. Most residents do not realize the enormity of the planning, time, and resources required, and the burden on City staff, the Fire Department, and volunteers to moke it hoppen, yeor ofter year.

Hello,
I am hoping to attend the City Council Study Session tonight if I am able to leave work in time. ln case I do not make it in time to attend, I wanted to share my thoughts on the Christmas morning Santa tradition-
However, I am hoping we explore every avenue to make sure this much-loved event continues. The Christmas morning event and La Verne 4th of July is what sets La Verne apart from all other local Cities. People are drawn to La Verne for the safe, family friendly and community atmosphere these events help to create. While recent circumstances are negatively impacting La Verne and threatening to change our city forever (most notably 740 Foothill) now is the time to hold tight to the positive things that bring our community together and make it a wonderful place to live.

I do have a couple of ideas. What if we got rid of the goody bags? That way less volunteers would be needed, and the process would move quicker through the neighborhoods. Also, what if the route was split between Christmas Eve and Christmas Day, alternating years. That way people coming to spend Christmas in La Verne would still be able to enjoy the tradition. I don't think weeknights before Christmas would get much attention and most people would probably miss it. Can the City allocate more in the budget for this important event? I know it is past budget time, but was this discussed? Anyway, I don't envy you having to discuss changing or stopping an over 100-year tradition. Please take it under great consideration.

Thank you very much for everything you do for the residents of La Verne. We appreciate you! Sincerely,
Paige Rode

I think it goes without saying, this event is a very special tradition for generations of families in La Verne. I understand the logistics of orchestrating the Santa drive through every neighborhood in La Verne on Christmas morning is much more difficult and challenging than it was over 100 years ago. I also respect the need for people to spend time with their families on the holidays. 1 City of La Verne Agenda Packet August 15, 2023

He stated that on July 1, 2023, during mid -day, Rodeo Jewelers was the scene of a violent robbery in which the suspects drove their vehicle into the store, assaulted an employee, and conducted a smash and grab robbery. This request seeks approval to offer a reward for information that leads to the arrest and conviction of the suspects as well as authorizing the City Manager, upon recommendation of the Chief of Police, to offer a similar reward for future violent crimes.

Acting Chief Sam Gonzalez stated this is still an active investigation, and hopefully this reward will prompt someone to say something to help with the investigation.

Agenda Report

DATE: A ugust 21, 2023

TO: Honorable Mayor and City Council

FROM: Christy Lopez, Finance Director

SUBJECT: CITY OF LA V ERNE T REASURER’S R EPORT FOR Q UARTER E NDING JUNE 30, 2023
____________________________________________________________________________

SUMMARY
The Treasurer’s Report for Quarter ending June 30, 2023, is submitted for City Council to receive and file per City of La Verne Administrative Regulation Number 215, the Statement of Investment Policy, and the State of California’s Government Code (GC) Section 53646.

RECOMMENDATION
It is recommended that the City Council receive and file the Treasurer’s Report for the Quarter ending June 30, 2023.

DISCUSSION
The attached Treasurer’s Report is provided to the City Council per the City of La Verne Administrative Regulation Number 215, Investment Policy, and as provided under the State of California’s Government Code (GC) Section 53646. GC §53646 provides that a quarterly report (or monthly if legislatively elected) may be submitted to the City Council on a quarterly basis. This report details cash and investments held by the City, a statement that the portfolio complies with the Investment Policy and confirms the City’s ability to meet pooled expenditure requirements for the next six months.

As of June 30, 2023, the City had total cash and invested funds (cost basis) of $100,317,677. Of this amount, $20, 392,446 is held in a fiduciary capacity for the Los Angeles Interagency Metropolitan Police Apprehension Taskforce (LA IMPACT). In addition, the City also has $3,662,674 that is held outside the treasury by a fiscal agent to meet the 1996 Revenue Bond covenant. The City’s portfolio is fully liquid; 69 % ($ 69,643,322) is maintained in on- demand accounts, including those held by the State Local Agency Investment Fund (LAIF).

The investment portfolio conforms to the City’s investment policy and sufficient money is available to meet City obligations due within the next six months.

40 City of La Verne, City Council
Agenda Report

DATE: August 21, 2023

TO: Honorable Mayor and City Council

FROM:

Sam Gonzalez, Acting Chief of Police

SUBJECT: DECLARATION OF SURPLUS POLICE DEPARTMENT PROPERTY

SUMMARY
The listed police equipment is outdated and no longer needed. Each unit is obsolete and ineffective for current operational requirements. Each will become surplus to the City’s operational needs and should be disposed per Administrative Regulation No. 606.

RECOMMENDATION
It is recommended that the City Council declare the equipment identified in Attachment 1 as surplus to the City’s needs and further recommends that the staff be directed to destroy the listed items per Administrative Regulation No. 606.

DISCUSSION
The Police Department employs a range of weapons, less -than-lethal tools, and equipment. Over time, some items become obsolete, exceed their serviceable life, or fall out of policy compliance. Consequently, the Department frequently updates its inventory and replaces these items, necessitating their removal from active service. To adhere to regulations, weapon systems, including batons, firearm parts, and pepper ball launchers, cannot be sold to the general public and must be disposed of properly. To achieve this, the Department intends to collaborate with SA Recycling in Anaheim, who will ensure the complete and irreversible destruction of the surplus equipment, rendering them unusable.

SUBJECT: DECLARATION OF SURPLUS PUBLIC WORKS PROPERTY

SUMMARY
The Public Works Department is seeking City Council declaration of certain vehicles and equipment as surplus property. Each listed unit is no longer useful or is ineffective for current operational requirements and is proposed to be disposed of per Administrative Regulation No. 606.

RECOMMENDATION
It is recommended that the City Council declare the vehicles and equipment identified in Attachment 1 as surplus and direct staff to sell each asset per Administrative Regulation No. 606.

DISCUSSION
The fleet maintenance division of the P ublic Works Department is responsible for the purchase and maintenance of all vehicles and equipment used by the C ity’s various departments. The division prepares specifications for the purchase of new vehicles and equipment, provides routine maintenance and repairs of such equipment, establishes equipment replacement plans, and is responsible for disposing of declared surplus equipment when items are no longer useful or are determined ineffective for current operational requirements.

FISCAL ANALYSIS
Any proceeds from the auction of these vehicles/equipment will be placed in the Equipment Maintenance Fund. The proceeds are difficult to predict given current market conditions but are anticipated to be less than $25,000.00.

SUBJECT: TRACT MAP No. 72428, BOND REDUCTION

SUMMARY
Meritage Homes of California Inc., the developer of Creekside at La Verne (Tract Map No. 72428), a 22 Lot single family subdivision located south of the intersection of San Dimas Canyon Road and Golden Hills Road, has requested the reduction of their Performance B ond. Staff has inspected and verified that all monuments have been placed.

RECOMMENDATION
Staff recommends that the City Council authorize the reduction of the bond amounts for the Performance Bond to approximately 15% of its value and retain the Grading Bond at the full value.

DISCUSSION
A requirement of the subject Tract Map was the placement of sureties to guarantee the completion of improvements in accordance with the Final Map and related Plans . The project has been complete with respect to a majority of the proposed improvements for some time, however work has continued on the project’s drainage basin.

The basin was designed to perform as storm water storage and to facilitate percolation of storm water collected from the project site. Prior to finalizing much of the project improvements, it was identified that the performance of the basin was not in line with the acceptable standard. Thus, the project developer, Meritage Homes of California Inc., has been required to correct the issue and return function of the basin prior to official completion of the project. Efforts to correct the issue impacting the basin’s performance have recently been completed, justifying a reduction to the surety bonds currently held by the City.

Given the critical nature and scale of the basin function, the remaining portions of the surety bonds will be retained by the City until acceptable performance of the basins can be observed and confirmed over the duration of a full wet season. It is anticipated that this may occur following the conclusion of the winter months of 2024.

The current bonds held by the City are as follows:

Performance Bond No. SU 1131538 $1,936,300.00
Grading Bond No. 1961806
$ 29,000.00
City of La Verne Agenda Packet August 15, 2023
47 With the completion of the drainage basin remediation, the sureties can be reduced to the following amounts:

Performance Bond No. SU 1131538 $ 290,445.00
Grading Bond No. 1961806 $ 29,000.00

The value of the bonds retained are equivalent to approximately 200% of the value of the engineer’s estimate associated for alternative modifications. In the event performance of the basin is not satisfactory, further efforts will be required of the developer to extract an acceptable level of function from the system.

SUBJECT: PUBLIC HEARING FOR ANNEXATION OF TERRITORY INTO COMMUNITY FACILITIES DISTRICT NO. 11 -1, (ANNEXATION 2023 - 01) OF THE CITY OF LA VERNE

SUMMARY
On July 17, 2023, the City Council adopted Resolution No. 23-44 declaring the intention to initiate proceedings for a nnexation No. 2023- 1 into the Community Facilities District (CFD) No. 11-1, setting the public hearing to occur on August 21, 2023. The area proposed for annexation is lot 1 of the Final Tract Map No. 83353 (Brandywine) as depicted on the Annexation No. 2023-1 map.

PLEASE NOTE: Council Member Johnson will declare a conflict of interest and abstain from voting on this matter, because he owns property within 500’ of the proposed Annexation Area. Mayor Tem Pro Lau will declare a conflict of interest and abstain from voting on this matter, because she is a member of the University of La Verne Board of Trustees and the University has property subject to CFD No. 11 -1. Due to a lack of a quorum, a vote will be taken with the minimum number of conflicted members participating by drawing lots in order to open the Public Hearing and continue it until September 5, 2023.

RECOMMENDATION

1. That the City Council, after drawing lots to allow a conflicted member to participate to establish quorum, shall open the public hearing and continue it until September 5, 2023.

At the September 5, 2023, City Council meeting, the City Council will be requested to:

1. C onduct the public hearing. At the conclusion of the public hearing, if written protests of:

a. 50% or less of the registered voters , or six registered voters, whichever is more, residing in the existing boundary of CFD No. 11-1, are received, or b. 50% or less of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 11-1 are received.

City of La Verne Agenda Packet August 15, 2023
61 3. 4. Pursuant to voter approval of the Annexation of Area 23-1 into CFD No. 11-1, that the City Council a dopt Resolution No. 23 -, Calling Special Election into the Levying of Special Taxes on Newly Annexed Area of 23-1 of Community Facilities District No. 11- 1 of the City of La Verne.

5. That the City Council d irect the Assistant City Clerk to open the Assessment Ballot s received and file a canvass and a statement of results of the election and that the City Council adopt Resolution No. 23- , Declaring the Results of the Special Election and directing the Recording of Notice of Special Tax Lien.

If during the public hearing, written protests have been filed against the proposed annexation of territory No. 23-1 into CFD No. 11-1 by 50% or more of the registered voters or six registered voters, whichever is more residing in the existing boundary of CFD No. 11-1, or 50% or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 11-1 , or owners of one- half or more of the area of land within CFD No. 11-1 or owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 11-1, and protests are not withdrawn to reduce the protests to less than a majority, no further proceedings to annex the territory shall proceed.

Should the ballot results from recommendation item 2 cause failure of the proposition, no further actions shall be taken.

The City Council may choose to continue this public hearing, but it shall be completed within 30 days pursuant to Section 53339.7 of the Mello- Roos Community Facilities Act of 1982.

DISCUSSION
In 2011 the La Verne City Council adopted Resolution No. 11- 18 to declare its intention to establish CFD No. 11-1. At the May 2, 2011, meeting of the City Council, balloting was completed and Resolution 11-31 was adopted to form and establish CFD No. 11-1. City of La Verne Ordinance No. 1 023 was later adopted establishing the rate and method of apportionment for CFD No.11-1.

During the planning and development stages of CFD No. 11-1, it was anticipated that vertical construction would likely increase within the City as it allows for greater density.

In that review process, the La Verne Fire Department identified Standard No. 1710 of the National Fire Protection Association as recommending a minimum aerial ladder truck staffed with four firefighters as part of a total response effort of including 15 firefighters for a first alarm structure fire. At the time prior to the CFD No. 11- 1 establishment, the City’s Fire Department was deploying ten firefighters and relying on assistance from LA City of La Verne Agenda Packet August 15, 2023
62 County Fire for the remainder of the staffing needs for such an event requiring additional support.

Further analysis conducted prior to the formation of the CFD No. 11- 1 identified that to respond with the recommended staffing and equipment, annual costs for that service would be approximately $2.2 million on an annual basis in 2011 dollars. This noted budget impact to provide the subject emergency services was identified during the City’s 2007 Strategic Planning Workshop and thus, the establishment of a CFD for this service was recommended. The established CFD would result in the levy of a special tax on the qualifying projects and properties to aid in supporting the otherwise special benefit provided by the emergency service equipment and personnel recommended.

The projects that met the criteria for the additional services include buildings that exceed three stories or 35 feet in height, or require fire flow of 3,499 gallons per minute (GPM).

These qualifying buildings pose added challenges for the Fire Department to protect.

The project located at 3717 Fruit Street is comprised of 50 interlocking townhomes spread across seven buildings. All seven of the buildings meet the required criteria for the noted Fire Department services intended for CFD No. 11- 1 to assist in supporting the costs.

Currently the site is a single parcel identified as Lot 1 of Tract Map No. 83353. As construction continues to progress towards completion and once the project’s Condominium Map is recorded, the specific units and the respective assessment will be assigned to the new assessor parcel numbers created.

FISCAL ANALYSIS
Costs associated with the annexation of Lot 1 into CFD No. 11- 1 as described on Tract Map 83353 are the burden of the project applicant. Costs related to the proposed annexation procedures will be reimbursed by the project applicant.

As approved on June 19, 2023, the Fiscal Year (FY) 2023-24 CFD No. 11-1 Special Tax Levy rate is $0.6184 on a per square foot basis for buildings that have been issued final occupancy by the City, or $0.3092 for buildings that have been permitted for construction.

The project located at 3717 Fruit Street has units that vary from 1,243 SF to 1,618 SF.

The respective full annual assessment for the units would range from $768.67 to $1,000.57 if applying the FY 2023- 24 full unit rates to the project. If the full rate was to be applied to the 50 units within the project , the project is estimated to generate $44,929.73 annually in 2023 dollars. Given the current status of the buildings as being permitted for construction, the actual rate levied will be 50% of the full rate for a FY 2023- 24 total assessment of $22,464.87. Based on current construction progression it’s anticipated that the full project will be completed during FY 2023- 24 and thus assessments for the FY 2024- 25 tax roll are likely to be levied at the occupied rate as adjusted by the future Consumer Price Index (CPI) rate not to exceed 3% annually.

For the parcels currently on the tax roll for CFD No. 11-1 the projected revenue generated for FY 2023-24 is estimated to be $177,059.67. This proposed annexation will contribute City of La Verne Agenda Packet August 15, 2023
63 an increase of approximately 26% in assessable square footage in the CFD No. 11- 1.

While the current revenue projections from the assessable land subject to th e CFD No. 11-1 is well below the $2.2 million budget impact, the proposed annexation of 3171 Fruit Street further assists in offsetting the costs of the recommended equipment and staffing.

FROM:

Cody A. Howing, City Engineer

SUBJECT: FINAL TRACT MAP APPROVAL; TENTATIVE TRACT NO. 71373 (SAGE CANYON)

SUMMARY
On September 14, 2016, the Planning Commission approved Tentative Tract Map No. 71373 for 14 detached single- family homes on 11.53 acres of land located on 1977 Golden Hills Road. Following the City Council adoption of two Ordinances pertaining to a Zone Change and a Zone Amendment, the Tentative Map No. 71373 became effective on January 4
th of 2017. The Final Tract Map has been submitted for approval, allowing for the subdivision of three existing parcels that comprise the approximate area of 11.53 acres.

RECOMMENDATION
Adopt Resolution No. 23-56 titled, “A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF LA VERNE, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING THE FINAL MAP FOR TRACT 71373, A REQUEST BY SAGE CANYON DEVELOPMENT LLC, TO SUBDIVIDE THREE PARCELS WITH AREA OF 11.53 ACRES AT 1977 GOLDEN HILLS ROAD INTO A 14 UNIT, SINGLE FAMILY DETACHED SUBDIVISION,” approving the Final Tract Map No. 71373 for 14 detached single family homes and direct staff to sign the map as to its conformance with the Subdivision Map Act, Zone Change 36-15ZC, Zone Amendment 37-15ZA, and City Municipal Code.

DISCUSSION
This 11.53-acre site at 1977 Golden Hills Road is located northwest of the intersection of Golden Hills Road and Divot Drive. The existing site acreage is currently split between three parcels, two of which have an existing single-family detached structures located on the separate lots. The existing structures are intended to remain in place and have been accounted for in the subdivision of land covered by the final map.

Adjacent land uses include single family residential development to the west and southeast portions of the site. The remaining surrounding portions of the site are owned by the City of La Verne and included in the City’s Wilderness Area and Public Access Management Plan.

All conditions of approval pertaining to the approval of the final map have been met. Per City policy, grading and the first phase of construction for a residential development, cannot begin unless the subdivision map has recorded along with the posting of improvement bonds.

City of La Verne Agenda Packet August 15, 2023
83 This proposed project will also have to meet certain conditions of approval prior to the start of construction. Notably, the applicant will be required to obtain a permit from the California Department of Fish and Wildlife (CDFW) that will allow for fuel modification activities to occur offsite.

FISCAL ANALYSIS
Not applicable

ENVIRONMENTAL ANALYSIS
During the Tentative Map process the project underwent environmental review including the development of a California Environmental Quality Act (CEQA) Mitigated Negative Declaration (MND) document. The project has been identified as having a less than significant impact and thus the MND document outlines mitigation measures required of the project.

LEGAL REVIEW
The Tentative Map approval became effective on January 4th of 2017. A map is generally valid for only two years, plus any extensions allowed by law. Government Code section 66452.6(f) provides for an extension in the case of a development moratorium which includes actions of public agencies which regulate land use, development, or the provision of services to land as well as any period of time during which a condition was imposed by the City but could not be satisfied because the C ity was prevented in taking action before the expiration of the tentative map.

The CDFW had not approved the developer’s fuel modification plan which is required in order to obtain a streambed modification plan. Based on the lack of approval, the C ity could not issue a grading permit. The State’s inaction on approval constituted a moratorium which extended the life of the map.

The City Engineer has determined that the map may be finalized at this time, regardless of the fact that the fuel modification plan must still be resolved. The fuel modification plan shall be approved by the Fire Department prior to any issuance of grading permits.
