SUBJECT: RESOLUTION NO. 23-64 APPROVING A CLASS SPECIFICATION

AND HOURLY COMPENSATION RATE FOR PART-TIME

AMBULANCE OPERATOR

SUMMARY
After a review of organizational structure, departmental efficiencies, and future service enhancement opportunities, the Fire Chief has requested the addition of a part -time classification and requisite compensation be created for Ambulance Operator.

RECOMMENDATION
It is recommended that the City Council a dopt the Resolution No. 23 -64, titled, “A

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA VERNE, COUNTY OF

LOS ANGELES, STATE OF CALIFORNIA, APPROVING A CLASS SPECIFICATION AND HOURLY COMPENSATION RATE FOR AMBULANCE OPERATOR.”

DISCUSSION
The successful deployment of the City’s Ambulance Operator Program has continued to be reviewed and refined by the Fire Department. After reviewing the new service model and recognizing potential future opportunities for revenue as well as additional service enhancements for the City, the Fire Chief is recommending the addition of a part -time Ambulance Operator classification. By adding this position, the City will be better prepared to pursue possible future enhancements as well as provide additional internal protection for surge capacity response. Lastly, part-time personnel will help in providing associated flexibility with normal staffing levels. The only difference from the previously City Council approved full -time position is related to the specificity of the part -time designation and the position being ineligible for retirement, medical insurance, and similar benefits afforded to full-time employees.

The initial creation of a full -time Ambulance Operator position was based around scheduling employees on a 56-hour work week similar to other sworn rank and file Fire Department employees. However, the City still needs to enter into agreements with outside private ambulance companies to provide surge capacity coverage. Surge capacity is a term relating to the fact that emergency medical systems are typically stretched to their limits on a daily basis, and the additional stress of an unexpected surge from a catastrophic or unexpected event can be overwhelming without proper planning.

Furthermore, the City has identified potential opportunities for receiving outside funding from regional and local partnerships related to medical response and transport services.

September 18, 2023 City Council Meeting Agenda Packet
42 While specific agreements and program details will be forthcoming at a future City Council Meeting, having the components such as the part-time Ambulance Operator classification already in place allows the City to be best positioned for these opportunities.

In summary, adding the part-time classification allows for greater departmental flexibility as well as the ability to pursue service and revenue enhancements.

FISCAL IMPACT
The recommended action has no fiscal impact at this time and as such, no additional appropriations are being requested. Any future anticipated financial impacts will be brought back before the City Council for approval.

ENVIRONMENTAL IMPACT
Not applicable.

SUBJECT: ESTABLISHMENT OF FUND FOR MONSANTO PCB SETTLEMENT

SUMMARY
The City previously received, and the City Council approved, a settlement payment from the class action case City of Long Beach, et al. v. Monsanto Company, et al., United States District Court for the Central District of California, Western Division, Case No. 2:16- cv-03493-FMO-AS in the amount of $576,108.00. Staff recommends that the City Council instruct the Finance Director to create a PCB Mitigation fund and record these settlement proceeds as assigned within that fund.

RECOMMENDATION
It is recommended that the City Council direct staff to deposit funds within the PCB Mitigation Fund and commit the settlement proceeds so that principal and interest earnings can be used to offset the costs of monitoring for PCBs as required by the City’s National Pollutant Discharge Elimination System (NPDES) and Municipal Separate Storm Sewer System (MS4) permits and related requirements, including mitigation.

DISCUSSION
In October 2022, the United States District Court approved a settlement of the class action litigation against Monsanto and related entities for damages related to contamination of various water bodies, natural resources and water systems from PCBs and var ious expenses incurred by public entities throughout the country to abate, track, and mitigate PCB contamination and migration in soil, water systems and stormwater. The settlement established different types of payment funds for entities based upon the type of damages suffered and expenses incurred or on- going. The City of La Verne was eligible for payments relating to its on-going obligation, under the City’s MS4 permit, to monitor for a variety of contaminants in the discharge of storm water into other bodies of water. The City is required to ensure that the Total Maximum Daily Load (TMDL) of any particular contaminant is not exceeded, to protect water quality. This monitoring process requires equipment and personnel to perform this function on a regular and ongoing basis. PCBs are one of the contaminants for which the City must monitor stormwater. The City may also be required to take steps to mitigate or eliminate discharges which exceed the TMDL.

In recognition of this ongoing obligation, the City received the $576,108 settlement payment from the TMDL fund of the settlement program. Because these funds were paid to the City to address the City’s past and ongoing obligation to monitor stormwater fo r PCBs, staff is recommending that the settlement proceeds be placed into their own Fund September 18, 2023 City Council Meeting Agenda Packet
72 to ensure the funds are utilized for that obligation, to track expenditures on such monitoring and mitigation and to apply any interest earnings to that obligation as well.

FISCAL ANALYSIS
Upon approval, the creation of the PCB Mitigation fund will take effect. This fund will track all activities pertaining to its designated purpose. The settlement proceeds, totaling $576,108, will be recorded within this fund, and securely held within the City's pooled cash account, where they will accrue interest. There is no impact to the General Fund associated with the approval of this item. These funds will be designated for the specific purpose of monitoring and mitigating PCB contamination within the waters under the City's jurisdiction. This allocation will persist until such time as sufficient funds remain to meet necessary PCB mitigation. Furthermore, with the City Council's approval, any excess funds beyond the necessary amount for PCB mitigation may be reallocated to the General Fund for discretionary purposes.

PUBLIC HEARING AND RESOLUTION REGARDING THE REQUEST
FOR TIME EXTENSION ON VESTING TENTATIVE TRACT MAP 82001 (500 BASELINE ROAD)

SUMMARY
On September 5, 2023, the City Council adopted Resolution No. 23-57, setting the public hearing for September 18, 2023, to consider of a one- year time extension to Vesting Tentative Tract Map (VTTM) No. 82001. The applicant has requested a one- year extension of the VTTM allowed in Section 66452.6 of the Subdivision Map Act. Pursuant to City Code Section 16.16.210, the City Council may consider granting the requested extension during a noticed public hearing.

RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 23-65 titled “ A

RESOLUTION OF THE CITY COUNCIL, CITY OF LA VERNE, COUNTY OF LOS

ANGELES, STATE OF CALIFORNIA, GRANTING A ONE- YEAR TIME EXTENSION ON VESTING TENTATIVE TRACT MAP NO 82001 PURSUANT TO THE PROVISIONS OF TITLE 7, DIVISION 2, CHAPTER 3, OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, ESTABLISHING THE NEW EXPIRATION DATE OF THE VTTM NO. 82001 AS OF NOVEMBER 3, 2024.”

DISCUSSION
On September 20, 2021, the City Council approved VTTM No. 82001 and Annexation Project. This proposed map included the subdivision of 19.44 acres of unincorporated Los Angeles County territory located within the Sphere of Influence of the City of La Verne. The site location is on the north side of Baseline Road approximately 140 feet east of the intersection of Baseline Road and Rodeo Lane at 500 Baseline Road. Of the nine lots proposed by this map, seven are identified to contain single-family dwelling units The remainder have been identified as providing space for a debris basin and open space.

In addition to the approval of the VTTM, Ordinance No. 1102 was introduced for first reading, establishing a pre-annexation zoning designation from the County zoning of A - 1-15000 to PR3D (HODZ) and adopting PR3D (HODZ) zoning for the project. Ordinance No. 1102 was adopted on October 4, 2021, resulting in the effective date of the VTTM No 82001 to be November 3, 2021.

Given that area covered by the map is currently in unincorporated Los Angeles County and the annexation of the project site into the City of La Verne is not completed, there is September 18, 2023 City Council Meeting Agenda Packet
74 no staff recommendation or action that can be taken by the City Council to approve a final map. Efforts to coordinate with Los Angeles County Local Agency Formation Commission (LAFCO) for the processing of the annexation have been initiated and are continuing. The expiration of the VTTM No. 82001 is set to occur on November 3, 2023, leaving inadequate time to process the final map for recording without an extension.

In accordance with Section 66452.6 of the Subdivision Map Act and pursuant to City Code Section 16.16.210, an extension of one-year may be granted by the City Council. In the event future extensions are required, Section 66452.6 of the Subdivision Map Act allows extensions of up to 10 years from the original tentative map approval. City Code limits time extensions for Vesting Tentative Maps to one year, and shall only be granted following a noticed public hearing.

If the City Council elects not to grant the one- year extension, the VTTM will expire on November 3, 2023, and the approval process for the proposed subdivision will have to restart should the applicant wish to continue to pursue the project.

81 City of La Verne, City Council
Agenda Report

DATE: September 18, 2023

TO: Honorable Mayor and City Council

FROM: JR Ranells, Assistant City Manager

SUBJECT: RESOLUTION NO. 23 -66 AUTHORIZING THE CITY MANAGER TO

EXECUTE AN AGREEMENT FOR TEMPORARY EMPLOYMENT FOR

RETIRED ANNUITANT DEBORAH SEELY

SUMMARY
To be compliant with California Law and the 2013 Pension Reform Act, it is necessary for the City Council to certify there is an urgent need to waive the 180-day waiting period as well as take an action affirming the execution of an employment agreement utilizing the services of a retired employee.

RECOMMENDATION
It is recommend ed that the City Council adopt Resolution No. 23- 66, titled, “A

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA VERNE, COUNTY OF

LOS ANGELES, STATE OF CALIFORINA, AUTHOR IZING THE CITY MANAGER TO

EXECUTE AN AGREEMENT FOR TEMPORARY EMPLOYMENT FOR RETIRED ANNUITANT DEBORAH SEELY.”

DISCUSSION
Communications Officer Deborah Seely has submitted paperwork to retire after a long career in public service culminating in her serving the City of La Verne for 15 years. The position of communications officer, also known as a dispatcher, has been significantly challenging to find qualified applicants and continue full staffing. The City is interested in retaining Ms. Seely’s services to assist in filling current scheduling gaps as an interim communications officer while the recruitment process identifies potential replacements.

With Communications Officer Deborah Seely retir ing at the end of September and the challenges related to recruitment to fill vacancies of her position, staff is desirous to provide an arrangement where Ms. Seely can continue to work for the City for an estimated nine (9 ) months and no more than 960 hours. Ms. Seely’s continued relationship with the City will allow for assistance in relieving what would otherwise be an increased hardship on the dispatch center and its employees. There are effectively three (3) vacancies in the communications officer ranks with Ms. Seely’s retirement and recently the City Council on July 17, 2023, approved double overtime compensation due to the staffing situation for communication officers. Ms. Seely is willing to remain for the next several months, which will assist in mitigating the compounding of this issue while the City recruits and explores other options to get to full staffing levels.

September 18, 2023 City Council Meeting Agenda Packet
82 Section 7522.56 of the California Government Code states that a retiree can only be rehired by an agency for a maximum of 960 hours in a fiscal year. The law also states that if an agency wishes to reemploy such an individual sooner than 180- days after retirement, the governing board must certify that the nature of the appointment is necessary to fill a critical need.

The City has confirmed with CalPERS that the reasons for retaining Ms. Seely satisfy the required standards and is bringing forward the agreement for Council’s consideration.

Mainly, dispatching operations are an integral component to City public safety and emergency operations.

FISCAL ANALYSIS
It is important to note that on a fiscal perspective, the arrangement generally provides budget savings from that of a full-time position as Ms. Seely will be paid at an hourly rate and will receive no other monetary benefits. Additionally, Ms. Seely will be available to fill shifts that would otherwise be compensated at the double overtime rate if filled by a current full-time communications officer.

ENVIRONMENTAL ANALYSIS
Not applicable.

Agenda Report

FROM: JR Ranells, Assistant City Manager

SUBJECT: FILM PERMIT REQUEST FROM PICTURE 304

SUMMARY
The City has been contacted by a production company, Picture 304, to film a commercial at a residential property on Third Street. Per the City’s Municipal Code Chapter 5.57, all film permits must be approved by the La Verne City Council.

RECOMMENDATION
It is recommend ed that the City Council authorize the City Manager to execute an agreement with Picture 304 and issue a permit for filming once all required steps are completed.

DISCUSSION
Staff received a rush request for filming from a production company, Picture 304, to film a shoe commercial at a residential property on Third Street encompassing two days of shooting. According to their application the filming will take place in and around the single-family home but will not have a negative impact, such as loud noises or late hours, to surrounding neighbors or public property. There is a total of 15 people that will be associated with the filming and all equipment being used is small , such as handheld cameras.

The film company has already obtained approval from the property owner for use of their home and will be submitting all the necessary forms, proof of insurance, and deposits to satisfy the City’s requirements prior to permit issuance. T he City requires more notice but, given the film company has been responsive thus far and the filming project is relatively minor in nature, Staff is supportive of accommodating the rush request per City Council approval of authorization to the City Manager.

FISCAL ANALYSIS
Not Applicable. The City’s standard Film Permit Fees and insurance requirements will be assessed to Picture 304.

ENVIRONMENTAL ANALYSIS
