Senior Planner Candice Bowcock reported on the CDBG Program for 2024-2025.

10. VIRTUAL COMMENTS AT CITY COUNCIL MEETINGS - The City allowed public comments via Zoom as a result of the COVID-19 pandemic and, as a matter of public convenience, allowed Zoom comments to continue after the state -of-emergency elapsed. Due to incidents of hate speech affecting other municipalities , the City stopped accepting Zoom comments out of an abundance of caution beginning with the November 6, 2023, City Council meeting. Mayor Tim Hepburn and Council Member Steve Johnson requested the option for virtual public comments be brought forward for discussion.

RECOMMENDATION: That the City Council provide staff with direction regarding the option for residents to submit virtual comments via Zoom at City Council Meetings.

City Manager Domer reported on this item reiterating why the ability to comment via Zoom was put on hold. Per Council’s request to staff to check into options, the recommendation is to allow Zoom comments for specific items on the agenda, such as consent, other matters and public hearings. Not allowing it for the general public comment section. Emails can be submitted to the City Clerk or Council for the general public comment section. The Presiding Officer/Chair would call anyone straying out of decorum to order, if they fail to comply the Zoom comments can be turned off.

City Attorney Hall B
arlow agreed with the recommendation, and with the need to have the clarification on the agenda regarding which topics can be commented on, and being quick to call the commentor to order if they violate the rules of decorum or stray off topic.

Council Comments:

Council Member Kashifalghita asked why they should be given a second or third chance before shutting them down.

City Attorney Hall Barlow clarified the normal process when handling someone who has strayed off topic or making inappropriate comments would be to call them to order, give them a chance similar to anyone making comments at the podium, before cutting them off.

Council Member Lau added the First Amendment protects their right to talk. She agrees having the Zoom comments specific to agenda the items is a good way to handle this.

Council Member Johnson questioned if this would affect the other meetings, such as Planning Commission.

Council Meeting Agenda Packet, February 20, 2024 Page 11

Page 6 of 10 ends

City Manager Domer replied that it would, but currently we do not have the technology in place. In the future this will be looked at expanding our technological abilities.

Public Comment:

Joe Gabaldon thanked Mayor Pro Tem Lau for remembering the First Amendment rights and the importance of the public to engage with Council and speak.

Council Comments:

Mayor Hepburn agreed with the rights for the public to speak, and decorum must be kept.

Council Member Crosby asked for clarification as to what they were voting on.

City Manager Domer stated option #3 on the staff report, which states specific agenda items which occur under public hearings, other matters, and pulled consent items, but not general public comments, which are matters not listed on the agenda but within the jurisdiction of the Council.

It was moved by Johnson, seconded by Crosby, and unanimously carried by a vote of 5-
0, to approve option #3 on the agenda report as stated above.

City Manager Domer reported on this item, summarizing the Ordinance and when the salary increase would take effect.

Council Comments:

Council Member Crosby asked if the item would be brought back at another time for a finalization.

City Attorney Hall Barlow affirmed that was a correct statement, this was the first reading of the ordinance.

Mayor Pro Tem Lau asked for clarification on the table included in the report, were current salaries for other cities.

This item amends the City Manager’s agreement to reflect a 2.5% compensation increase, an additional 1% cost share of PERS costs to be paid by the City Manager, and changes to vehicle allowance for use of electric charging.

RECOMMENDATION: That the City Council approve “AMENDMENT #1 TO EMPLOYMENT AGREEMENT - CITY MANAGER,” approving a First Amendment to the City Manager’s employment agreement.

City Attorney Hall Barlow reported on this item. It is important to comply with the law to identify the proposal before Council, which is an amendment to the City Manager employment agreement. Which provides a 2.5% compensation increase, an additional 1% cost share of PERS costs to be paid by the City Manager, and changes to vehicle allowance for use of electric charging . Fiscal impact of $6,125.00 on an annualized basis, this fiscal year is $2,138.00 less the increase in the PERS contribution.

Mayor Hepburn called for public comment: There were none.

Council Comments:

Council Member Crosby thanked City Manager Domer for changes in the last year, bringing in key people, and bringing our employment groups together in multi-year agreements, has improved the City, and is looking forward to the next year. Our veteran Department Heads are moving in a good direction.

Council Member Kashifalghita, thanked City Manager Domer for the communication with City Council, having all the information ahead of time, the phone calls, texts, etc. He appreciates the good job.

Mayor Hepburn appreciates the methods CM Domer employed to engage staff and Council which is important for true leadership. No matter what level of employee you are everyone is equal here, everyone communicates and treats each other as equals.

A creative atmosphere thrives here with an open-door policy. We have gone through some major changes this past year, Christmas morning, we brought on some new people with a new vision, redoing our fee structure, making changes to the way we do things. Making our community better and our employees. Please keep up the good work.

It was moved by Kashifalghita, seconded by Lau, and unanimously carried by a vote of 5-0, to approve
the first amendment to the employment agreement.

Council Comments:

Council Member Kashifalghita agrees that the process should be streamlined.

Mayor Hepburn felt it was a good idea, didn’t want to miss any opportunities for revenue for our City, as long as the City is left in good condition.

It was moved by Crosby, seconded by Kashifalghita, and unanimously carried by a vote of 3-0, with Mayor Pro Tem Lau and Council Member Johnson recusing themselves, to approve the film permit request from Shadowboxer Films LLC.

SUBJECT: GENERAL PLAN UPDATE

SUMMARY
The City is currently in the final process of updating the General Plan, which is a long- range planning document that is considered the City’s “constitution” or blueprint, because it guides growth, traffic patterns, housing, and resources conservation. This report serves as an update on that process.

RECOMMENDATION
It is recommended that the City Council receive and file this General Plan Update.

DISCUSSION
The General Plan, a reflection of the community's vision for the future, addresses critical issues such as land use, infrastructure, and safety. This foundational document serves as a roadmap for decision- making, guiding where buildings are constructed, roads are laid, and parks are located. Moreover, it underscores the City's commitment to inclusivity and transparency by welcoming public input throughout the planning process. The last comprehensive update to the General Plan occurred in 1998.

The City formed a General Plan Advisory Committee (GPAC) to advise Staff, Planning Commission, and the City Council on the City’s comprehensive General Plan Update.

The GPAC wa s comprised of community representatives who served as liaisons and project ambassadors and met generally once a month for ten months beginning in May 2018. The final meeting of the La Verne General Plan Advisory Committee took place on Wednesday July 31, 2019. This meeting represented the conclusion of the GPAC’s role in advisory City Staff and the Consultant Team on the goals, objectives, and priorities for the La Verne community.

The General Plan Update process was put on hold while the City focused on the State required completion of the Housing Element Update. On November 21, 2022, the City Council approved the City’s 2021- 2029 Housing Element Update and on December 21, 2022, the California Department of Housing and Community Development found the document in full compliance with State Housing Law. On February 21, 2023 the City Council approved an updated agreement with De Novo Planning Group to complete the General Plan Update.

The City is actively advancing its comprehensive General Plan Update, a crucial step towards ensuring a successful and sustainable future. Currently, the City is preparing an Council Meeting Agenda Packet, February 20, 2024 Page 39 General Plan Update

Environmental Impact Report (EIR) to scrutinize the potential ramifications of implementing the General Plan Policy Document. This undertaking involves conducting technical studies focused on transportation, noise, and air quality impacts.

Anticipated for release in late spring of this year, the Draft EIR will undergo a 45- day public review and comment period, offering residents an opportunity to contribute their insights. Following this period, the City will address received feedback and present the finalized materials to the Planning Commission and City Council at public hearings scheduled for the Fall of 2024. Updates and project details are readily accessible on the project website at www.LaVerne.GeneralPlan.org, where visitors can also register for future notifications.

SUBJECT: WEED ABATEMENT PROTEST HEARING

SUMMARY
On February 5, 2024, the City Council adopted Resolution No. 24- 08, accepting the Declaration List of Properties which has been found by inspections to have growing weeds or brush and/or rubbish. This item is the opportunity to hear protests from affected property owners.

RECOMMENDATION
It is recommended that the City Council conduct a protest hearing, take appropriate action related to any protests, and following the protest hearing, direct the Los Angeles County Agricultural Commissioner/Director of Weights & Measures to abate the nuisance at declared properties.

DISCUSSI
ON
Pursuant to the County of Los Angeles, Department of Agricultural Commissioner and Weights and Measures, the listed conditions constitute a public nuisance on designated properties and must be abated. Notices to destroy weeds were mailed to property owners notifying them of a hazard or public nuisance upon their property and that it must be abated. That notice set Tuesday, February 20, 2024, at 6:30 pm, as the date and time for protests to be heard from affected property owners. SUBJECT: BUSINESS AS SISTANCE FOR CRIME REDUCTION PROGRAM (BACR)

SUMMARY
The P
olice Department is seeking direction from the City Council regarding a “ Business Assistance for Crime Reduction" (BACR) program, an initiative targeting high- profile businesses susceptible to burglaries and other related crimes . The proposed BACR program aims to enhance safety through partnerships, environmental design, technology integration, and community collaboration.

RECOMMENDATION
It is recommended that the City Council provide direction to the Police Department regarding program elements and potential funding for a "Business Assistance for Crime Reduction" program to be brought back for approval at the March 18, 2024, City Council meeting or soon thereafter.

DISCUSSION
Based on recent criminal acts such as “smash and grabs” which target retail store fronts along well traveled corridors, City and Police Department staff have been discussing best ways to assist La Verne businesses in crime prevention, reduction, and educating businesses on how best to harden their businesses.

A "
Busines
s Assistance for Crime Reduction" program represents a proactive and multifaceted approach to enhancing the safety and security of La Verne's business community. This program, if strategically developed, is designed to address crime prevention through a combination of physical space redesign, technological integration, educational outreach, and community partnership. The discussion below elaborates on the various components of a program and their intended impact , and development of components can be rolled out as resources become available.

Informed Design of Spaces : Recognizing the importance of environmental factors in crime prevention, this element focuses on redesigning public areas to make them less conducive to criminal activities. The C ity plans to collaborate with local businesses and property managers, conducting environmental assessments to identify areas prone to criminal activities. Recommendations will include enhancing visibility, improving lighting, and minimizing potential hidin g spots. This initiative also encompasses minor physical alterations that could significantly deter criminal activities. City staff will be consulted to ensure that changes are both aesthetically pleasing and functionally effective in reducing crime.

Council Meeting Agenda Packet, February 20, 2024 Page 43 Discussion on Business Assistance for Crime Reduction Program February 20, 2024

Page 2 ends

Defensi
ble Space Theory and CPTED Implementation: This component aims to educate business owners on the principles of Crime Prevention Through Environmental Design (CPTED), a proven strategy in reducing crime through the design and manipulation of the physical environment. Workshops and consulting sessi ons will be organized to disseminate knowledge about how the physical design of properties can influence offender decisions. This proactive approach empowers business owners to take charge of their spaces, making them safer and more secure.

Smart City Technologies Integration: Embracing technological advancements, this program element focuses on integrating Internet of Things (IoT) devices and smart cameras in business locations. These technologies facilitate real -time monitoring and alerting, acting as a deterrent to potential criminals. The City plans to establish a program that encourages businesses to adopt these technologies. Collaborations with tech providers are expected to offer discounts, making the technology accessible to a broader range of businesses.

Economic Impact and Investment Incentives: While this component involves minimal financial allocation, it is significant in terms of policy impact. The program will develop incentives such as fee reductions or recognition programs for businesses that actively participate in crime reduction efforts. These incentives are designed to encourage widespread participation and acknowledge the efforts of businesses in enhancing community safety.

Target Hardening: Enhancing the physical security of a crime target through the use of locks, door, and window types, security alarms and other crime prevention methods. With an approved application and oversight, a reimbursement system can be established to help alleviate part of the financial burden on businesses opting for these security enhancements.

Secure Your Business Brochure : Recognizing the power of information, this component involves the development and distribution of brochures that educate business owners on self -help security measures. These brochures will cover a range of topics, including basic security upgrades, best practices, and contacts for further assistance. The goal is to ensure that businesses are equipped with the knowledge to protect themselves effectively.

Business Watch Program : This program seeks to build a network of businesses committed to monitoring and reporting suspicious activities. By fostering a sense of community and shared responsibility, the program aims to enhance the collective security of the business district. Funds are allocated for administrative purposes, training materials, and communication tools necessary to establish and maintain this network.

Emergency Contact System : Utilizing the resources of the current Police staff, this component involves the creation and maintenance of an updated contact database for Council Meeting Agenda Packet, February 20, 2024 Page 44 Discussion on Business Assistance for Crime Reduction Program February 20, 2024

Page 3 ends

rapid response in emergencies. This system ensures that businesses can quickly reach out to law enforcement and receive timely assistance when needed.

The program's comprehensive nature, with its emphasis on collaboration, education, and technological integration, is expected to bring a significant reduction in crime rates, thereby fostering a secure and thriving business environment in La Verne. Regular evaluations and flexibility for adjustments will be key in ensuring the program's adaptability and long-term success.

The program proposes a clear timeline for implementation over two years, including initial rollout, engagement, refinement, scaling, and continuous actions for monitoring and support.

Application Process : If approved, businesses in La Verne will be encouraged to participate through a structured application process. This process could include application submission, information gathering, proposal development, follow -up, and post-approval procedures, ensuring transparency and accessibility.

FISCAL ANALYSIS
Any program will seek to utilize education and current staff resources; however, costs for equipment, printing of material, and potential reimbursement or incentives will require budgetary appropriation or the securing of grants, if any. As envisioned, t he initial implementation of this program proposes a budget of $50,000, allocated across various components for maximum impact. The funding is aimed at enabling businesses to enhance their security measures, thereby contributing to the overall safety of the La Verne community.

The C ity's contract with CalPERS governs retirement benefits provisions, specifying contribution rates and cost -sharing arrangements across five employee classifications, including those effected by the implementation of the Public Employees’ Pension Reform Act (PEPRA) . These classifications encompass Classic miscellaneous, Classic safety, PEPRA fire, PEPRA police, and PEPRA miscellaneous employees, each with distinct benefit formulas based on various factors.

Due to financial challenges faced by CalPERS and its member agencies, Government Code section 20516 allows for cost -sharing agreements between contracting agencies Council Meeting Agenda Packet, February 20, 2024 Page 47 and employees to address increasing costs and unfunded liabilities. Previously, the Council adopted resolutions (23-53 and 23-54) which included the approval of a .5% cost share in July 2023 and another .5% in July 2024, totaling a 1% cost share of the employer's cost for unrepresented Classic Safety and Miscellaneous Executive and Middle Management employees. Additionally, Council approved the agreement with the City Manager , herein classified for CalPERS requirements within the Executive Administration group, to include a 2% cost share of the employer ’s share. Those employees considered PEPRA are not participating in the increased employer cost share as CalPERS adjusts annually the split of normal costs and the PEPRA groups saw a 1% increase in their formula already.

The attached resolutions detail the Classic employees participating in cost -sharing with the City . CalPERS is mandating proof of a simple majority agreement from affected employees to proceed with the contract amendment making it necessary to bring the following resolutions forward in preparation of the CalPERS contract amendment.

Implementing cost-sharing involves procedural steps, with the next being the Council's consideration of a resolution providing notice of the City's intent to approve a contract amendment with CalPERS which will be brought to Council at a future date.
