IMPLEMENTATION OF FEE

SCHEDULE

City of La Verne June 16, 2025
DRAFT Development Impact Fee Justification Study

www.FinanceDTA.com
J Indexing of DIFs
T
he DIFs presented in this report are based on current facility costs provided by the City and should be adjusted annually to account for inflation. The purpose of the adjustment is to account for future escalation in costs for land, equipment, vehicles, and construction.

DTA recommends that after adoption, the fee should be reviewed each year and adjusted by a reliable index such as the ENR BCI generally used as the primary basis for indexing construction costs. Ordinarily, land costs make up a significant portion of the costs covered by the fees and do not lend themselves to traditional cost indexes. As such, land costs should be adjusted to changes in local land prices.

K Updating the Fee Study
A
s stated in Section III, AB 602 was signed into law in September of 2021 by the Governor of California, and it provides new Statewide requirements for local jurisdictions seeking to impose DIFs on development projects. Among these requirements are that Nexus Studies shall be updated at least every 8 years as of January 1, 2023. However, DTA concurs with the generally accepted policy that 5 years is a good rule-of-thumb time period for Fee updates, particularly because the required 5-Year findings (see above) can be approved at that same time. In some instances, fees may remain valid for a longer period of time if the City’s land use and facility plans do not change. A case in point is a municipality at or near full build-out capacity. However, a dynamic, growing municipality facing significant changes in land use would do itself a disservice if it maintained the current fee structure for too long without a fee study to update the current rates.

L Administering a Fee Program
C
reating and administering an impact fee program can be a labor-intensive process requiring considerable preparation and training that should not be undertaken more often than necessary. A well-planned fee program can generate sufficient funds to allow the City to adequately mitigate impacts created by future development. Conversely, a poorly planned fee can result in either collecting too little money and being forced to pay for public facilities required as a result of future development through its General Fund or collecting too much money based on an unsupported fee program, thus exposing the City to a fee challenge or a requirement to refund unexpected proceeds.

All personnel involved in the process, including accounting, capital budgeting, and project management of any other area, must be made fully aware of the difference between impact fees and other fees, such as user fees, and of the guidelines and restrictions placed on the expenditure of Fee revenues. The building Fees generated in this report are tied to specific facility improvements and cost estimates provided by the City. The fees must be expended accordingly and must be able to withstand any challenges and show that the funds have been properly directed in accordance with proper AB 1600 guidelines.

Council Packet - November 17, 2025
City of La Verne,City Council
Agenda Report

DATE: November 17, 2025
TO: Honorable Mayor and City Council
FROM: Eric Scherer, Community Development Director
SUBJECT: AMENDING THE COMPREHENSIVE FEE SCHEDULE AND INCIDENTAL OUTDOOR SIDEWALK POLICY.

SUMMARY
The City Council previously approved an updated Outdoor Dining and Display Policy based on recommendations from the Old Town La Verne Business Improvement District’s Advisory Board. Since that approval, staff has received feedback from several Old Town businesses regarding implementation concerns and cost structure. Based on this input, Staff is proposing adjustments which involve an amendment to the City’s Comprehensive Fee Schedule and approval of a new Outdoor Sidewalk Policy.

RECOMMENDATION
That the City Council conduct a public hearing and adopt a resolution amending the City’s Comprehensive Fee Schedule to include revised outdoor dining and display permit fees, and approve modifications to the Incidental Outdoor Sidewalk Policy to align with the updated fee structure.

DISCUSSION
In late 2019, the City adopted a policy regulating the use of public sidewalks in Old Town La Verne. Implementation was delayed due to the onset of the COVID-19 pandemic, during which outdoor dining and display rules were temporarily relaxed to support local businesses. When the City Council voted to re-open D Street to vehicles, it also permitted any business to apply for a permit to create a parklet within parking spaces in the street. Only one business applied for such a permit, Café Wang, whose patio has since been taken down.

Since the introduction to the previously approved policy, Staff has continued to engage with Old Town businesses to gather feedback regarding the policy’s implementation. Several businesses expressed concerns that the existing square-footage-based lease agreement created administrative challenges and higher-than-expected costs for small-scale uses. Based on this feedback, Staff is recommending the following changes for Council consideration:

Previous Policy (Approved on January 21, 2025, City Council Meeting):

Requests for more than two tables and four chairs and/or six square feet of display area require a lease agreement and payment of:

• $0.90 per square foot per month for businesses with alcohol sales; or • $0.70 per square foot per month for businesses without alcohol sales.

Proposed Fee Schedule Amendment and Policy Revision:

Page 155 of 183 ends

Council Packet - November 17, 2025
Amending the Comprehensive Fee Schedule and Incidental Outdoor Sidewalk Policy., Page 2

Requests for more than two tables and four chairs and/or six square feet of display area would instead require a flat monthly permit fee, as follows:
• $100 per month for businesses with food and/or alcohol sales; or • $50 per month for businesses with food but no alcohol sales.

Fees will be billed annually and may be prorated for businesses that wish to use the expanded outdoor areas seasonally (e.g., May through September). Businesses that wish to cancel their agreement must provide written notice to the City at least thirty (30) days in advance.

The previous implementation date of July 1, 2025, is proposed to be extended to January 1, 2026, to allow sufficient time for outreach, permit processing, and transition to the new fee structure.

Until that time, businesses may continue to use the sidewalk areas as currently permitted by the City, provided that proper insurance is maintained, and ADA access is not obstructed. No permit fees will be charged during this interim period.

If the City Council approves this fee amendment, the proposed revisions will be incorporated into the final Outdoor Dining and Display Policy document. Staff will notify all affected businesses and prepare the necessary implementation procedures prior to the January 1, 2026, effective date.

FISCAL ANALYSIS
The proposed revisions will result in a simplified and predictable fee structure for businesses while still generating modest revenue to offset the City’s administrative costs. Exact revenue impacts will depend on the number of participating businesses but are expected to remain cost- neutral relative to prior projections.

ENVIRONMENTAL ANALYSIS
Not applicable.

LEGAL REVIEW
The proposed comprehensive fee schedule amendment and associated policy revisions have been reviewed and approved by the City Attorney.

PARKLETS INFORMATION
Submittal Requirements

PURPOSE
The City of La Verne has launched the La Verne Incidental Outdoor Dining/Decorative Furniture Permit Program to help local businesses and the community further utilize public property to facilitate positive activity such as outdoor dining and shopping.

This portion of the program allows for the use of the parking lane and sidewalk for business operations, like seating, dining operations, or merchandising for businesses by the construction of a parklet or on designated sidewalk areas.

Parklets repurpose part of the street adjacent to the sidewalk into a public space. While they are funded and maintained by the businesses and property owner, they are publicly accessible and open to all.

Parklets are only intended to be installed on low-speed streets regardless of the barrier system installed.

No sidewalk or on-street dining shall occur on roadways with speed limits above 25 mph.

The safety of patrons, employees and other street users are paramount. Additionally, these parklets must be accessible to all as required by the Americans with Disabilities Act (ADA).

Moody’s defines credit risk as the risk that an entity may not meet its contractualfinancial obligations as they come due and any estimated financial loss in the event of default or impairment. The contractual financial obligations addressed by Moody’s ratings are those that call for, without regard toenforceability, the payment of an ascertainable amount, which may vary based upon standard sources of variation (e.g., floating interest rates), by an ascertainable date. Moody’s rating addresses the issuer’s ability toobtain sufficient cash to service the obligation, and its willingness to pay. Moody’s ratings do not address non-standard sources of variation in the amount of the principal obligation (e.g., equity indexed), absent an expressstatement to the contrary in a press release accompanying an initial rating. Long-term ratings are assigned to issuers or obligations with an original maturity of eleven months or more and reflect both on the likelihood of adefault or impairment on contractual financial obligations and the expected financial loss suffered in the event of default or impairment. Short-term ratings are assigned to obligations with an original maturity of thirteenmonths or less and reflect both on the likelihood of a default or impairment on contractual financial obligations and the expected financial loss suffered in the event of default or impairment. Moody’s issues ratings at theissuer level and instrument level on both the long-term scale and the short-term scale. Typically, ratings are made publicly available although private and unpublished ratings may also be assigned. It takes into consideration the creditworthiness of guarantors, insurers, or other forms of credit enhancement on the obligation and considers the currency in which the obligation is denominated. The opinion reflects S&P Global Ratings' view of the obligor's capacity and willingness tomeet its financial commitments as they come due, and this opinion may assess terms, such as collateral security and subordination, which could affect ultimate payment in the event of default.
