Each Council Member may address the Council and public on matters of general information and/or concern. This is also the time for Council Members to report on conferences and/or meetings they have attended per Assembly Bill 1234.
Council Member Lau highlighted several events celebrating local businesses, promoted community participation in fall sports and supporting Bonita High School athletic programs, encouraged residents to explore activities in La Verne, and recognized the economic and community benefits generated by visitors attending local sporting events.
Council Member Crosby will be attending the Pomona Valley Transit meeting tomorrow and thanked those in attendance and encouraged them to keep attending.
Council Member Johnson is looking forward to the Farmer’s Market and the Taste of La Verne.
Mayor Pro Tem Kashifalghita will be attending the Mosquito Vector Control Board meeting and was honored to represent the City on the 1.3 mile Walk of Honor at the 5-Year Anniversary of the loss of 13 service members and met the mother of one of the service members lost, who is a Family Member of a Marine Corp’s Gold Star Family. Encouraged all to stand strong and remember this Friday, September 11th.

City of La Verne,City Council
Agenda Report
DATE: September 21, 2026
TO: Honorable Mayor and City Council
FROM: Ken Domer, City Manager
SUBJECT: ADOPTION OF AN ORDINANCE UPDATING DEVELOPMENT IMPACT FEE
CODE SECTIONS AND RESOLUTION ESTABLISHING SPECIAL REVENUE FUNDS TO ACCOUNT FOR FEES.
SUMMARY
The City Council conducted a First Reading and waived further reading of an Ordinance compiling regulations and setting authority for the City's development impact fees on September 8, 2026. This item adopts that Ordinance and approves a Resolution establishing special revenue accounts to specifically account for revenues generated by the fees for strict accountability.
RECOMMENDATION
That the City Council:
1. Adopt an Ordinance, titled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LA VERNE, CALIFORNIA, ADOPTING A NEW DEVELOPMENT IMPACT FEE
CHAPTER AND REPEALING IN PART EXISTING SECTIONS OF THE LA VERNE MUNICIPAL CODE RELATING TO DEVELOPMENT IMPACT FEES" and,
2. Approve a Resolution titled, "A RESOLUTION OF THE CITY COUNCIL, CITY OF LA
VERNE, CALIFORNIA, ESTABLISHING SPECIAL REVENUE FUNDS TO ACCOUNT
FOR CITY ADMINISTRATION AND PUBLIC FACILITIES, POLICE, AND FIRE DEVELOPMENT IMPACT FEES."
DISCUSSION
Over the past year, the City Council approved nexus studies and updated fees for Public Facilities, Police, Fire, Parks, Storm Drain, Undergrounding, Affordable Housing In-Lieu, and Affordable Housing Linkage. While the nexus studies and adopted rates establish the legal basis and amounts of the fees, the Municipal Code provides the administrative framework for their day-to-day implementation. Currently, these provisions are dispersed throughout various sections of the Municipal Code; therefore, the proposed ordinance consolidates them into a new Chapter 3.18, Development Impact Fees, to provide a centralized and clearer reference for staff and the public. The amendments are organizational and administrative in nature and do not modify previously approved fee amounts, nexus findings, or substantive requirements.
A public hearing was held for this item at the September 8, 2026, City Council meeting. At that meeting, the City Council did not direct staff to make any modifications to the proposed ordinance and approved introducing the Ordinance for first reading, and waiving further reading

on a unanimous vote. This action also contains a Resolution establishing new special revenue funds as explained in the Fiscal Analysis section.
FISCAL ANALYSIS
This item is administrative and has no direct financial impact. Council approval is required to establish new special revenue funds for the separate accounting of development impact fee revenues and related expenditures. Establishing these funds will improve financial transparency and compliance by allowing each funding source, expenditure, and fund balance to be independently tracked and reported. This action does not appropriate funds or authorize expenditures; any future expenditures will be subject to City Council appropriation through the annual budget, a budget amendment, or other Council action.
ENVIRONMENTAL ANALYSIS
Not applicable.

Agenda Packet - September 21, 2026
Section 1. Chapter 3.20 of Title 3 of the La Verne Municipal Code titled Parks and Recreation Charges is hereby repealed in its entirety.
Section 2. Chapter 3.25 of Title 3 of the La Verne Municipal Code titled Fire Equipment Fee is hereby repealed in its entirety.
Section 3. Chapter 3.27 of Title 3 of the La Verne Municipal Code titled Fire Development Fees – Hillside Development Overlay Zone is hereby repealed in its entirety.
Section 4. Sections 12.23.050 (Storm Drain Fees), 12.23.060 (Deposit of Fees), and 12.23.070 (Expenditure of Funds) are hereby repealed in their entirety.
Section 5. A new Chapter 3.18 of Title 3 is hereby added to the La Verne Municipal Code to read as follows:
CHAPTER 3.18 DEVELOPMENT IMPACT FEES.
3.18.010 Purpose and Findings.
A. The purpose of this Chapter is to establish development impact fees to mitigate the impacts of new development on public facilities and capital improvements necessary to protect the public health, safety, and welfare.
B. The City Council finds and determines that in general:
1. New development creates a demand for additional public facilities.
2. Absent the imposition of development impact fees, existing service levels would decline.
3. The fees to be adopted in accordance with this Chapter shall be supported by an impact fee nexus study in order to assure that the fees are proportional to the impacts of new development as required by law.
3.18.020 Definitions.
For purposes of this Chapter, the following definitions apply:
“Accessory Dwelling Unit (ADU)” means a dwelling unit as defined in Government Code section 66313, or any successor statute.
“Affordable Housing” means housing that is restricted to and occupied by households of very low-, low-, or moderate-income, as defined by the California Health and Safety Code, and that is available at a cost that does not exceed 30 percent of gross household income, or such other standard as may be established by State law.
Agenda Packet - September 21, 2026
“Capital Improvements” means public facilities and related assets required to accommodate new development that increase system capacity and have a useful life of ten (10) years or more, including the planning, design, acquisition, and construction of such facilities, as identified in the City’s adopted Development Impact Fee Nexus Study.
“Development” means any project requiring a building permit, grading permit, or other entitlement from the City resulting in new residential or nonresidential square footage, dwelling units, or land use intensification.
“Impact Fee” or “Development Impact Fee” means any monetary exaction imposed on development to fund public facilities required to serve the development. “Nexus Study” means any report adopted by the City Council establishing the relationship between development and necessary public facilities that meets the requirements of the Mitigation Fee Act.
“Nonresidential Development” means any new or expanded building floor area space, including but not limited to commercial, office, retail, industrial, institutional, and other nonresidential land uses.
“Public Facilities” means public capital improvements including but not limited to transportation facilities, parks and related infrastructure, public safety facilities, storm drainage, water systems, sewer systems, and general city facilities. “Residential Development” includes single-family detached homes and singlefamily attached homes. It also includes buildings with attached residential units including apartments, town homes, condominiums, mobile homes, and all other residential units not classified as single-family that results in either an addition of 500 square feet, an increase in square footage of the existing livable area by 25%, or the addition of new units, except Accessory Dwelling Units which are 750 square feet or less in size.
3.18.030 Applicability.
A. General Applicability. All new development within the City is subject to the impact fees established by this Chapter.
B. Types of Projects Subject to Fees:
1. New residential dwelling units.
2. New residential additions greater than 500 square feet in size, or 25% of the existing living area, or the addition of new units, except for ADUs as set forth hereinbelow.
Agenda Packet - September 21, 2026
3. New nonresidential floor area.
4. Expansions or intensification of existing uses where new demand is created on relevant facilities.
5. ADUs that are more than 750 square feet in size.
C. Exemptions. The following developments are exempt unless otherwise required by law:
1. Accessory dwelling units 750 square feet or less in size.
2. Reconstruction, replacement, or repair of a lawfully established structure that does not result in any net increase in floor area, dwelling units, or intensity of use.
3. Structures or portions of structures that do not create additional demand for public facilities, provided that such structures do not increase residential units, occupancy, or intensity of use.
4. Development undertaken by or on behalf of a public agency for public facilities.
5. Public school facilities of school districts or other public educational agencies.
6. Development within mobilehome parks that does not involve the construction of new mobile homes or expansion of habitable space, or that is otherwise regulated under separate state or local provisions governing mobilehome park development.
7. Subject to City Council approval, projects in which the City enters into a Development Agreement with an applicant and receives benefits to which it would not otherwise be entitled.
3.18.040 Impact Fee Categories.
The City hereby establishes the following development impact fee categories:
A. Public Facilities
B. Police Facilities
C. Fire Facilities
Agenda Packet - September 21, 2026
D. Parks and Recreation
E. Storm Drain Facilities
F. Undergrounding Utilities
G. Affordable Housing In-Lieu
H. Affordable Housing Linkage
I. Transportation/Traffic
3.18.050 Fee Calculation.
A. Fee Adoption by Resolution. Following consideration and approval of a nexus study conforming to state law, the City Council shall adopt the specific dollar amounts for each fee category by resolution.
B. Hearing Procedure. Except for annual adjustments allowed pursuant to Section 3.18.070 below, all new fees and increases to fees shall be adopted by resolution of the City Council in accordance with the procedure set forth in Government Code section 66018.
C. Calculation Method. The impact fees shall be calculated based on:
1. The applicable land use type (e.g., single-family residential, multifamily, commercial, industrial).
2. The per-unit or per-square-foot fee established in the most recent fee schedule.
3. Adjustments as provided in this Chapter.
D. Mixed-Use Projects. For projects containing multiple land-use types, fees shall be calculated separately for each land use category.
E. When a fee is imposed as a condition of approval on a development project, the applicant may provide substantial evidence to the City to show that the required nexus does not exist or the amount of the fee should be adjusted.
3.18.060 Timing of Payment.
A. Non-Residential Development. Development impact fees shall be paid at the time of issuance of a building permit.
Agenda Packet - September 21, 2026
B. Residential Development. Development impact fees shall be paid at the time of final inspection or issuance of a Certificate of Occupancy, whichever is earlier, unless the fees are to reimburse the City for expenditures previously made, in which case they shall be paid at the time of issuance of a building permit. Any utility service connection fees shall be paid at the time of application for such connection.
C. Alternative Timing. The City Council may adopt a deferral program by resolution, allowing payment at a date certain (e.g., 6 months after Certificate of Occupancy issuance) subject to security requirements and interest provisions.
3.18.070 Annual Fee Adjustment
Impact fees shall be automatically adjusted annually on July 1 of each year based on the California Construction Cost Index (CCCI), or such other Index as City Council may approve by resolution from time to time.
3.18.080 Establishment of Fee Funds
A. The City shall establish separate interest-bearing funds for each impact fee category. All accumulated interest will become a part of the fund.
B. All collected fees and interest shall be deposited into their respective funds.
C. Funds shall be expended solely for the public facilities for which the fee was collected, consistent with Government Code sections 66006 and 66008.
3.18.090 Use of Funds
Revenues collected pursuant to this Chapter shall be used solely for the purposes identified within the City’s adopted Development Impact Fee, Affordable Housing In-Lieu, and Affordable Housing Linkage Nexus Studies.
3.18.100 Reporting and Accountability
The City shall comply with all reporting and refund requirements of the Mitigation Fee Act.
3.18.110 Protests, Appeals and Audits
All protests, appeals, and audits must be conducted in accordance with the procedures set forth in the Mitigation Fee Act, commencing with Government Code section 66020.
3.18.120 Administrative Procedures
A. The City Manager, or designee, is authorized to adopt administrative guidelines to implement this Chapter.
Agenda Packet - September 21, 2026
B. These guidelines may include application forms, credit agreements, fee calculation worksheets, and reporting standards.
Section 6. Severability
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance, or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause, or phrase be declared unconstitutional.
Section 7. CEQA. The amendment is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” pursuant CEQA Guidelines Section 15378(b)(5) because the proposed relocation and revision of development impact fees is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment in that the Ordinance will not impact the type or intensity of use already allowed on the properties, but rather simply provides procedures which establish and determine calculation and imposition of development impact fees to mitigate the effects of development. Furthermore, even if the amendment was considered to be a project, it would be exempt from environmental review pursuant to the “common sense exemption” per CEQA Guidelines Section 15061(b)(3).
Section 8. The Mayor shall sign and the Deputy City Clerk shall attest to the passage of this Ordinance. The Deputy City Clerk shall cause the same to be processed in the manner required by law.

CONSULTANTS
Commission Regulation 18700 defines “consultant” as an individual who, pursuant to a contract with a state or local government agency:
(A) Makes a governmental decision whether to:
(i) Approve a rate, rule, or regulation;
(ii) Adopt or enforce a law;
(iii) Issue, deny, suspend, or revoke any permit, license, application, certificate, approval, order or similar authorization or entitlement; (iv) Authorize the agency to enter into, modify, or renew a contract provided it is the type of contract which requires agency approval;
(v) Grant agency approval to a contract which requires agency approval and in which the agency is a party or to the specifications for such a contract; (vi) Grant agency approval to a plan, design, report, study, or similar item; (vii) Adopt or grant agency approval of, policies, standards, or guidelines for the agency, or for any subdivision thereof; or
(B) Serves in a staff capacity with the agency and in that capacity performs the same or substantially all the same duties for the agency what would otherwise be performed by an individual holding a position specified in the agency’s Conflict of Interest Code.
The Commission realizes that not all consultants participate in the making of decisions on behalf of public agencies and rather than amend your code each time you retain a consultant that is in a decision˚making capacity, you may use a specialized disclosure category which provides that the disclosure required of consultant shall be determined on a case˚by˚case basis by the City Manager. The City Manager may make a determination as to what disclosure, if any, is required or any particular consultant.
This consultant disclosure category should be part of the code. You should add the position “consultant” as a designated position in the appendix of the code with a footnote as shown in the following example:
*Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the code subject to the following limitation:
The City Manager may determine in writing that a particular consultant, although a “designated position”, is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements described in this section. Such written determination shall include a description of the consultant’s duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager or executive officer’s determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code.

City of La Verne,City Council
Agenda Report
DATE: September 21, 2026
TO: Honorable Mayor and City Council
FROM: Ken Domer, City Manager
SUBJECT: PUBLIC ART FUND ORDINANCE AND POLICY UPDATE AND COUNCIL DIRECTION.
SUMMARY
The proposed Public Art Ordinance and Public Art Fund Policy establish a formal framework for the collection, administration, prioritization, and use of public art funds, with clear processes for project selection, approval, and long-term maintenance. The framework is intended to build on the value of past public art investments by creating a more proactive approach to funding permanent public art projects as resources become available.
RECOMMENDATION
That the City Council provide direction on the proposed Public Art Fund Ordinance and Policy.
DISCUSSION
In April 2026, the City Council discussed the development of a formal framework governing the City’s Public Art Fund and directed staff to develop an ordinance and accompanying administrative policy to standardize the administration and use of public art funds moving forward.
The City’s Public Art Fund has provided significant value to the community by supporting a variety of public art projects throughout La Verne. These investments have enhanced public spaces, contributed to the character and identity of the community, and provided opportunities to incorporate art into locations that are visible and accessible to residents and visitors.
Building upon the success of these efforts, staff identified an opportunity to establish a more formal and proactive approach to the use of Public Art Fund revenues. Rather than identifying individual expenditures as opportunities arise, the proposed framework is intended to provide a consistent process for planning, prioritizing, selecting, approving, and maintaining permanent public art throughout the City.
Since the Council’s April discussion, staff has reviewed public art ordinances and administrative policies from other jurisdictions and used that research to develop a draft Public Art Ordinance and Public Art Fund Policy.
Under the proposed draft ordinance, the public art requirement would apply to new commercial, industrial, and other nonresidential construction, as well as new multiple-dwelling residential projects, except for Accessory Dwelling Units and Two-Unit Development projects. Qualifying development projects would be required to provide public art or an in-lieu contribution equal to

0.5 percent of project valuation for projects valued at less than $500,000 and 1 percent for projects valued at $500,000 or greater. These percentages are consistent with existing requirements for projects that require public art within the Arrow Corridor Specific Plan district.
The ordinance currently allows a development project to satisfy its public art obligation through the installation of public art on the project site, payment of an in-lieu fee into the Public Art Fund, or a combination of the two, subject to City approval.
The City’s public art requirement is not a development impact fee under the Mitigation Fee Act.
Rather, it is an aesthetic and land-use regulation adopted pursuant to the City’s authority, similar to requirements governing landscaping, architectural design, and other development standards. Any in-lieu payment serves as an alternative method of satisfying the public art requirement and is not imposed for the purpose of mitigating a development-created demand for public facilities.
While the ordinance establishes the legal framework for the program, the proposed Public Art Fund Policy provides the administrative procedures for determining how Public Art Fund revenues would be used. The policy is intended to ensure that expenditures are transparent, fiscally responsible, consistent with City priorities, and directed toward high-quality, durable, and publicly accessible artwork that enhances public spaces and strengthens community identity.
The policy identifies a broad range of eligible project expenses, including the commissioning or acquisition of artwork; artist design, fabrication, and professional services; site preparation and installation; conservation and restoration; interpretive signage; and public engagement associated with public art projects. Administrative costs directly attributable to implementation of public art projects would generally be limited to five percent of annual Public Art Fund expenditures unless otherwise approved by the City Council.
Project Identification and Prioritization
A primary purpose of the proposed policy is to establish a more proactive approach to identifying future public art investments. Projects may originate through City Council direction, staff recommendations, or community proposals. In evaluating potential projects, staff would consider factors such as consistency with adopted City plans and community priorities, contribution to placemaking and civic identity, visibility and public accessibility, artistic quality and durability, long-term maintenance requirements, and the geographic distribution of public art throughout La Verne.
The policy also identifies locations that may be prioritized for investment, including civic facilities and public buildings, parks and recreational facilities, gateways and major corridors, historic or culturally significant areas, and locations identified for revitalization or community enhancement.
Before a project advances, staff would develop a preliminary budget that considers the estimated project cost, available Public Art Fund balance, and anticipated ongoing maintenance obligations.
Moving forward, this framework could allow the City to establish a regular public art procurement process as funding is available. For example, staff could periodically identify priority locations or types of permanent public art and conduct an annual procurement or call for artists based on the available Public Art Fund balance. This would provide a more deliberate approach to investing public art revenues, allow potential projects to be considered collectively,
Agenda Packet - September 21, 2026
Public Art Fund Ordinance and Policy Update and Council Direction., Page 3 and help ensure that public art is distributed strategically throughout the community.
The availability of funding would continue to determine the scale and frequency of procurements. In years when sufficient Public Art Fund revenues are available, the City could advance one or more projects through a competitive process; when funding is limited, revenues could remain in the restricted fund until sufficient resources are available to support an appropriate project.
Review and Approval Process
Both privately developed public art projects and City-initiated projects will be required to be approved by the Development Review Committee. The Committee's review would focus on considerations such as design compatibility, scale, materials, placement, and consistency with the surrounding environment.
Public art programs, initiatives, or projects that utilize monies from the Public Art Fund with a significant fiscal impact, consistent with the thresholds and requirements of the City's Purchasing Policy, would require City Council approval for the expenditure of those funds. Once the City Council has approved a broader program or project, implementation of individual components, artist stipends, contracts, or related expenditures could be authorized administratively when they fall within the authority established by the City's Purchasing Policy.
This structure is intended to maintain appropriate City Council oversight of significant investments while allowing staff to efficiently administer projects that have already been authorized and fall within established purchasing authority.
Long-Term Ownership and Maintenance
Permanent artwork acquired or commissioned using Public Art Fund revenues would generally become the property of the City upon acceptance. Prior to approving a project, staff would evaluate its anticipated maintenance requirements and lifecycle costs so that long-term obligations are considered alongside the initial investment.
The policy also establishes a process for the future relocation, removal, or deaccession of Cityowned public art when warranted by deterioration, public safety concerns, redevelopment, or other circumstances. Any decision to remove or deaccession artwork would require City Council approval.
Collectively, the proposed ordinance and policy are intended to preserve the benefits the Public Art Fund has already provided to La Verne while creating a more deliberate and sustainable program for future investment. The framework would establish clear rules for the collection and use of funds, provide objective considerations for selecting projects, formalize the review and approval process, and allow the City to proactively plan for permanent public art opportunities as funding becomes available.
FISCAL ANALYSIS
The proposed ordinance would require public art for specific development projects, in which inlieu payments could be made that would result in financial contributions to the Public Art Fund
