PUBLIC COMMUNICATIONS
****************************
Bree Burgess, No Square Theatre, announced their upcoming stage musical Footloose, with a special performance on Thursday, August 11, with adaptations for those on the autism spectrum.
Craig Cooley, Laguna Beach Pride, announced their upcoming annual fundraiser, the Pride Festival, on Saturday, August 6, 4:00 p.m. - 10:00 p.m., at the Neighborhood Congressional Church. Cooley also requested Council support for a rainbow lifeguard tower at West Street Beach.
Chris Catsimanes again questioned the timing of the creation of the parking subcommittee and the City's decision to not buy the fourth lot and instead let the Laguna Presbyterian Church buy it.
Catsimanes also referenced his emails suggesting that the Council use California Government Code section 36813 to address Councilmember Peter Blake's behavior.
Toni Kellenberg, Laguna Plein Air Painters Association (LPAPA), thanked the Council for its support of the arts community, and for the opportunity to showcase artwork at City Hall and at their gallery in North Laguna. Kellenberg announced their Annual "From Dusk to Dawn" Juried Nocturne Art Show from LPAPA members during the month of August, and the Invitational October 1-9.
Pat Gallis referenced a Laguna Beach Independent article on the Kirby lawsuit that mentioned cost recovery, and asked for clarification. He also requested clarification on the status of the lawsuit against the City's historic preservation ordinance now that it is certified by the California Coastal Commission.
Mike Beanan, Laguna Bluebelt Coalition, showed the winning photos of their photo contest, and invited the public to the exhibition's opening reception at 6:00 p.m. on Thursday at the LCAD Gallery on Ocean Avenue.
John Thomas noted that the Council opted not to move forward with its own ballot initiative, and asked if the $75,000 approved to hire Stu Mollrich for ballot advisory services will be available for other uses.
Gene Felder requested information regarding that red tag issued on Mo Honarkar's property at 153 Cedar Way. He also referenced a letter from Community Development Director Marc Wiener directing Honarkar to provide a comprehensive plan, schedule, and description for the Hotel Laguna project, and asked if the plan has been provided.
Paula Hornbuckle-Arnold, Chamber of Commerce, thanked the Council for its support, especially during her time serving as Interim President/CEO, and she advised that she will steward newly- appointed President/CEO Erin Slattery through the transition period and continue to serve on the Board of the Directors for the Laguna Beach Chamber of Commerce. -2-

COUNCIL AND STAFF REPORTS
*******************************
City Clerk Ann Marie McKay reminded everyone that the nomination period is open until August 12 for Laguna Beach residents interested in running for City Council in the November 8 general election, and will be extended to August 17 if an incumbent does not file. Appointments for nomination papers can be made by emailing or calling her directly at [email protected] or (949) 497-0309.
City Manager Shoreh Dupuis advised that West Street Beach is a County beach; therefore, the request for a rainbow lifeguard tower in that location will have to go through the County. She advised that Assistant City Manager Ken Domer is working with the County and Craig Cooley on the request.
Regarding the contract with StuMollrich, City Manager Shoreh Dupuis advised that the $75,000 was for the entire contract, with a $10,000 per month retainer. She stated that staff worked with StuMollrich for three months on drafting the proposed ordinance that was introduced at the July 26 Special meeting, equating to a cost of $30,000, and the contract was terminated on July 27, after the Council voted to not put the ordinance on the ballot as a ballot measure.
Regarding the stop work order issued on the Cedar Way property, Community Development Director Marc Wiener advised that a permit was issued to remodel the property; however, the work stopped for a significant time period, and started again in May, replacing wood that had deteriorated during the period of time no work occurred. Wiener advised that since the stop work order was issued, new permits were issued with the updated work, and the applicant had to pay all the fees again since the previous permits expired. Wiener stated that the work at the Cedar Way property is now fully permitted. Regarding Hotel Laguna, Wiener advised that the plan requested in his letter referred to the phases of the project, which was presented at a recent Planning Commission meeting.
Community Development Director Marc Wiener reported that the City's Building Division scored an Insurance Services Office (ISO) rating of 2, with 1 as the highest, an improvement from the Division's previous rating of 4. Wiener noted that a good ISO rating leads to lower insurance rates for homeowners.
Communications Manager Cassie Walder presented a video on the promenade public input process.
Regarding Government Code section 36813, City Attorney Phil Kohn noted that it was enacted 75 years ago, and there have since been court cases that determined any action taken by the Council beyond censure would likely be a violation of constitutional rights.
Regarding the pending CEQA-related lawsuits, City Attorney Phil Kohn advised that there is a 60- day appeal period for the Kirby judgment that was recently entered, and cost recovery does not include attorney fees. For the historic preservation ordinance lawsuit filed in San Francisco against the California Coastal Commission and the City, Kohn advised that it will be transferred to San Diego County.

Councilmember George Weiss reported that the City now owns the library, and the purchase price will be used to refurbish the library. City Manager Shoreh Dupuis advised that as of tomorrow, the lease-back to the County will be in place.
Councilmember Toni Iseman asked about business conducted on the sand in front of Hotel Laguna.
City Manager Shoreh Dupuis advised that the signs that had been put up for a special event have been removed; however, the hotel has a liquor license through ABC (Department of Alcoholic Beverage Control), which requires a sign and roping off the area where alcohol is served.
Community Development Director Marc Wiener advised that the beach is on private property, and though beaches generally cannot be restricted for private use, the previous owner filed a vested rights claim with the California Coastal Commission in 2014, so the Coastal Commission must make a determination regarding the beach use.
Councilmember Peter Blake responded to Councilmember Toni Iseman and Chris Catsimanes' comments.
Mayor Sue Kempf showed the packet of letters of thanks from the 3"d graders the City recently hosted.

MAINTENANCE OF FENCING, LANDSCAPING, AND HARDSCAPING
Staff Report: Director of Public Works Mark McAvoy gave a presentation updating the City Council on the Laguna Channel Replacement project.
Questions of Staff: Mayor Pro Tem Bob Whalen stated that he wanted to maximize the number and size of trees, and not be constrained by the budgeted $50,000 for landscaping costs.
-6-
Laguna Beach City Council Minutes August 2, 2022
Mayor Sue Kempf voiced the importance of framing the details of the project for the Planning Commission to review.
City Manager Shoreh Dupuis explained that staff would come up with a revised plan acceptable to all agencies prior to going before the Planning Commission.
Director of Public Works Mark McAvoy responded to Mayor Pro Tem Whalen that the budgeted $50,000 was only an estimate and if it was more, the additional funds would be available.
Councilmember George Weiss read a letter from Laguna Canyon resident, Penelope Milne, concerning the need to replant trees that shaded the walkway and the need for a consistency of trees along the channel.
Director of Public Works Mark McAvoy answered the statement from Milne explaining why staff was not presenting a planting plan at this time. He described the plan that intended the trees to be consistent with the Village Entrance while providing shade for the sidewalk.
Mayor Sue Kempf asked about parking concerns for residents on the north end during construction. Director of Public Works Mark McAvoy responded that staff were aware of the residents' concerns and were attempting to mitigate parking concerns by implementing construction in three phases outside of the summer season. He added that parking would be monitored throughout the project to ensure parking impacts were minimal.
Mayor Sue Kempf asked about the plan for the three bridges along the channel. Director of Public Works Mark McAvoy described the proposed design for the three bridges.
Mayor Sue Kempf commented that the residents in Laguna Canyon utilized the north end bridge and wanted to ensure it stayed in place. Director of Public Works Mark McAvoy explained the rationale for relocating the north end bridge.
Mayor Sue Kempf asked about preserving access to the pocket park along the channel.
Director of Public Works Mark McAvoy described the channel reconstruction impact to the pocket park. City Engineer Mark Trestik added that the pocket park would be needed to access that portion of the channel and he explained.
Councilmember Toni Iseman confirmed with staff that the undergrounding of utilities in the canyon would not be conducted during the reconstruction of the channel because of timing.
Councilmember Toni Iseman asked about additional parking. City Engineer Mark Trestik responded that the parking meters could be covered up during construction to allow the residents to utilize those parking spaces at no cost.

Laguna Beach City Council Minutes August 2, 2022
Public Testimony: Gayle Waite, president of the Laguna Canyon Conservancy, voiced concerns about eliminating healthy trees and existing landscaping during construction. She requested the City Council return the proposed project to the Planning Commission so as to garner additional input from the public.
Bob Borthwick listed the goals for the residents of Laguna Canyon, and he commented that the proposed project was moving in the right direction to protect those residents and the neighborhood. He encouraged staff to further investigate options to save the existing trees.
Councilmember George Weiss confirmed with Borthwick that the existing trees could not be saved by moving them and a discussion regarding trees ensued.
Anne Caenn, president of Village Laguna, discussed the removal of mature existing trees and she suggested engineering the structure of the channel wall to accommodate large trees.
She encouraged the City Council to save as many of the existing trees as possible and replace the others with substantial trees that were consistent with the Landscape and Scenic Highways Element of the General Plan. Caenn added the importance of public review of the landscape plan.
Ruben Flores offered suggestions to retain the existing trees, and he said that maintenance was the key to the longevity of the landscape.
Penelope Milne, CANDO (Canyon Alliance of Neighborhoods Defense Organization), stated they supported sending the proposed project back to the Planning Commission for further review and she explained.
Gene Felder commented that he agreed with the prior speakers requesting to save the existing trees and the pocket park.
Ann Christoph opined that the channel wall could be engineered to accommodate larger trees and the city should not be dictated by rigid engineering standards. She encouraged the planting of oaks and sycamores along the channel.
Jen Kucera Rothman, Laguna Canyon resident, voiced concerns about the loss of large trees and the removal of bridges that would impact the neighborhood and she described Councilmember Comments: Mayor Pro Tem Bob Whalen thanked staff and Bob Borthwick for their work on the project. He commented that he would direct staff to meet with residents for a parking plan, push to plant sycamores and a variety of oak trees, support an accelerated parking meter replacement program prior to the construction, and develop a long-term plan for the other side of the road and the median to attenuate any impacts. Whalen stated that he was concerned about the language in the County agreement and he would like to see responsibilities delineated more clearly.

Laguna Beach City Council Minutes August 2, 2022
Councilmember George Weiss suggested a list of trees he supported to be planted along the channel. He commented that he was in favor of covering the parking meters during construction and meeting with residents to garner their input.
Councilmember Toni Iseman commented on the importance of saving the existing trees and maintaining historic elements in the canyon.
Mayor Sue Kempf asked the city arborist's opinion on the seven trees that were slated for removal. City Arborist Matt Barker responded to Mayor Kempf explaining his analysis of the seven trees.
Mayor Pro Tem Bob Whalen confirmed with the city arborist that the newly planted trees in the pocket park would not take too long to grow, hopefully addressing the residents' concerns.
Mayor Sue Kempf commented that she supported the city arborist's evaluation and recommendations regarding the remaining trees. She confirmed with staff that the reconstruction of the northerly bridge was not considered as part of this project.
Councilmember Toni Iseman commented that the cost of a project should not be an issue when it came to the importance of the bridge for the residents.
Mayor Sue Kempf confirmed with staff that the Planning Commission would be solely reviewing the design review of the planting plan.
Councilmember Peter Blake spoke about the importance to move the project forward and to remember the most important purpose of the channel project was to protect the downtown from flooding.
A discussion regarding the motion ensued.
Moved by Mayor Pro Tem Bob Whalen, seconded by Councilmember George Weiss, and carried unanimously 5/0 to:
(1) Approve and authorize the City Manager to execute agreement #22-82 with the Orange County Flood Control District for funding and maintenance responsibilities associated with ornamental fencing along Laguna Canyon Channel adjacent to Frontage Road, with revisions to Section 10, Hold Harmless, to reflect verbiage in Sections 9.3 and 9.4 of the Caltrans agreement that clarifies the City's liability; (2) Approve and authorize the City Manager to execute agreement #22-83 with the California Department of Transportation for maintenance of landscape and hardscape between Laguna Canyon Channel and Laguna Canyon Road, from Frontage Road to Woodland Drive;

(3) Direct staff to incorporate enhanced landscaping within the project budget for additional trees, incorporating oaks and sycamores, and saving as many trees to the extent possible, within the project limits, subject to Design Review, Caltrans, County, and Laguna Beach County Water District approval.
(4) Direct staff to develop a parking plan for residents impacted by the construction project; and
(5) Direct staff to accelerate the parking meter replacement program in the project area.
PUBLIC HEARING REGARDING NUISANCE ABATEMENT AT 2560-2572 SOLANA WAY
Staff Report: Director of Public Works Mark McAvoy gave a presentation that described the nuisance abatement and gave a chronology of the events that took place at 2560-2572 Solana Way.
City Attorney Phil Kohn commented that no appeals had been filed by the owners of the property and therefore the only issue before the City Council this evening was the appropriateness of the abatement cost recovery associated with the water discharge onto the public right of way.
Questions of Stati: Councilmember George Weiss asked about the condominium association's recourse after the abatement cost was added as an assessment to the property tax bill.
City Attorney Phil Kohn responded to Councilmember Weiss stating that there were no further administrative proceedings for property owners to avail themselves because they failed to appeal the city's decision. He commented that if they believed there were third parties involved that should be responsible for the assessed costs, they could pursue those remedies; however, he said the city would have no participation in those dealings.
Councilmember George Weiss confirmed with staff that the city had reported that the cause of the water discharge was from 2560-2572 Solana Way.
Mayor Pro Tem Bob Whalen asked how the abatement costs were compiled. Director of Public Works Mark McAvoy described the costs outlined in the staff report.
Public Testimony: Property owners John Dameron, Janie Groze, and Matt Harrison stated they did not support staff recommendations and they explained.
Councilmember Comments: Mayor Sue Kempf commented that tonight's determination based on the costs associated with the abatement and not the responsibility of the abatement. -10-
Laguna Beach City Council Minutes August 2, 2022
Moved by Councilmember George Weiss, seconded by Mayor Pro Tem Bob Whalen, and carried 4/1 to:
(1) Confirm the report and assessments to be final and conclusive; and (2) Direct the Director of Administrative Services to file the report with the County to add the assessments to the property tax bill.

9. RESOLUTION AMENDING THE AGENDA SETTING PROCESS
Staff Report: Assistant to the City Manager Jeremy Frimond summarized the staff report regarding amending the agenda setting process.
Public Testimony: Gene Felder and John Thomas did not support the proposed agenda setting process and they explained.
Councilmember Comments: Councilmember Toni Iseman voiced concerns about the proposed agenda setting process and having to work with the City Manager.
Councilmember George Weiss gave a presentation discussing the items he had brought before the city council to be approved for the agenda, and he stated that he did not support the proposed agenda setting process.
Councilmember Toni Iseman commented that she did not want to discourage councilmembers from bringing forward items to be heard at city council meetings and she believed the proposed process would hinder important issues being raised.
Mayor Pro Tem Bob stated that the proposed changes would not substantively change anyone's ability to get an item on the agenda. He said the current process was inefficient.
Whalen highlighted that the proposed agenda setting process would not limit the number of items a councilmember wished to be added to the agenda. He added that if one of the committees came forward with an item, there would now be a clear process in place. He commented that good ideas should be brought forward and there was no veto right by the City Manager to object to an item being added to the agenda.
Councilmember George Weiss requested the timeline to have items put on the agenda be shortened from 90 to 30 days. He stated that the proposed agenda setting process transferred power from an elected official to an appointed official, and that was anti- democratic. -11-
Laguna Beach City Council Minutes August 2, 2022
Mayor Pro Tem Bob Whalen responded to Councilmember Weiss, commenting that he disagreed that it was a transfer of power, and the City Manager was obligated to bring items to the agenda. He stated that he would support bringing an item to the agenda within 30 to 60 days if no staff resources are needed.
Mayor Sue Kempf stated that she agreed with Mayor Pro Tem Whalen, and she explained.
She commented that it was important for items to come before City Council with more context from staff and vetted by committees.
Councilmember George Weiss reiterated that he did not support the proposed changes; it was overly restrictive and was not a good modification in policy.
Councilmember Peter Blake voiced concerns about the current process, and he supported the proposed changes to the agenda setting process.
Moved by Mayor Pro Tem Bob Whalen, seconded by Councilmember Peter Blake, and carried 3/2 to adopt Resolution #22.066 titled, "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LAGUNA BEACH, CALIFORNIA, ESTABLISHING POLICY
RELATING TO AGENDAS FOR CITY COUNCIL MEETINGS AND REPEALING RESOLUTION NO. 68.88," with the revision that items without the use of staff resources (Section 4B) are placed on the agenda within 30-60 days.
