10. APPOINTMENT OF CITY COUNCIL MEMBERS TO JOINT COMMUNITY POOL

SUBCOMMITTEE
Staff Report: Senior Recreation Supervisor Alexis Braun gave a presentation updating the City Council on the progress to further discussions pertaining to a new community pool and to appoint two Councilmembers to serve on a subcommittee with the Laguna Beach Unitied School Board (LBUSB) to discuss pool options and joint-use opportunities.

Public Testimony: Steve McIntosh, Sensible Laguna, requested that Sensible Laguna be included on the community pool subcommittee.

Interim City Manager Sean Joyce clarified that tonight's action was to propose the appointment of two Councilmembers to a subcommittee to work with staff and the LBUSB to determine the best options for the community.

Steve Brown said he supported the statements made by McIntosh and that Sensible Laguna could lend its assistance to the City and the District on this important endeavor.

Sheri Morgan said that a proposed pool design needed to support the entire community.

She commented that it would be important to include the community in the process.

Gary Kasik reported on public comments made by the LBUSB concerning the city's support of its plans for a new pool. He voiced concerns about the lack of input from the community. Kasik suggested that if these comments made by the LBUSB were incorrect, that the City Council make a public statement that the city had not made any decisions with the school district to create a joint-use pool or a community pool and the city would fairly and without bias consider a resident-focused pool as well as participating with the school district ensuring a size of a pool yet to be determined. He urged the City Council to include residents in the decision-making process.

Jennifer Zeiter suggested that as a condition of adding the two-Councilmember appointment to the joint pool committee with the LBUSB, the City Council apply the condition that would expand the committee to include community members.

Interim City Manager Sean Joyce restated that tonight's agenda was an opportunity for the City Council to appoint a subcommittee made up of two of its members to work independently and with the school district to understand what they are contemplating and the implications of those contemplations for the services that city provided to its residents.

He stated that he knew of no representations that the city had made on any decision being contemplated by the school district at this time.

Mayor Bob Whalen commented that the city needs to perform required analyses before it is ready to meet with the school district to discuss any community pool designs.

City Attorney Megan Garibaldi responded that the meeting was noticed this evening to appoint a subcommittee to address the community pool issues. -6-
Laguna Beach City Council Minutes October 10, 2023
Mayor Pro Tem Sue Kempf confirmed that as to date, no pool design discussions had been conducted between the city and the school district. She added that the city had been looking into uses of the pool and how the city could best serve the community.

Councilmember Alex Rounaghi asked about an ad hoc committee versus a subcommittee.

City Attorney Megan Garibaldi answered that an ad hoc committee would be limited to two City Councilmembers for a specific project.

Councilmember Alex Rounaghi confirmed with the City Attorney that the ad hoc committee would not be making any decisions but would bring their findings to the City Council for approval. He clarified that although they had shared concerns, the City Council represented the city's interests and the LBUSB acted for the interests of the school. He stated that the goal of the City Council subcommittee would be to work with staff and community members to understand the implications for the community. Councilmember Rounaghi said it was important to gather information from all of the stakeholders to make an informed decision about the pool design. He said he supported an ad hoc subcommittee with Mayor Whalen and Mayor Pro Tem Kempf that would work with the community services department to establish a list of stakeholders, take their input, and then come back to the City Council with their recommendations.

Councilmember Mark Orgill supported more public participation; however, he said it would be important to work with an outside consultant to understand the costs and usage of a community pool.

Councilmember George Weiss questioned whether a two-councilmember subcommittee had been voted on in a prior meeting. He nominated himself to be on the ad hoc subcommittee, and he explained. Councilmember Weiss added that after the subcommittee had conducted its work, then they could recommend a consultant, if necessary. He commented that input from the community and stakeholders would be important.

Mayor Bob Whalen clarified that there had been no prior City Council vote regarding a pool subcommittee, and this was the reason it was before the City Council tonight. He said there had been data collected; however, he said he supported bringing on a pool consultant to assist in gathering additional information. Mayor Whalen added that the ad hoc subcommittee would be looking for input from all of the affected public.

Councilmember Alex Rounaghi suggested the ad hoc subcommittee return to the City Council with an update within a few months.

Mayor Pro Tem Sue Kempf said she supported engaging a pool consultant.

Interim City Manager Sean Joyce confirmed that staff could return to the City Council within a few months with preliminary information.

Moved by Councilmember Alex Rounaghi, seconded by Mayor Pro Tem Sue Kempf, and carried 4/1 (Councilmember Weiss dissented) to appoint Mayor Bob Whalen and Mayor Pro Tem Sue Kempf to serve on an ad hoc subcommittee to work with staff and stakeholders to discuss pool options and joint use opportunities with the Laguna Beach Unified School Board, and report back to the Council on the results of the discussions and data gathering.

COUNCIL REVIEW

11. PUBLIC TREE REMOVAL AT 387 EL CAMINO DEL MAR (WEISS) Staff Report: City Arborist Matthew Barker gave a presentation describing the public tree removal process at 387 El Camino Del Mar.

Questions of Staff: Councilmember Alex Rounaghi asked Barker to expand on the risk matrix that was the basis for removal of the tree. City Arborist Matthew Barker explained the tree removal risk matrix.

Councilmember Alex Rounaghi asked if there was a city policy currently in place to determine the threshold in which a tree would be removed. Director of Public Works Mark McAvoy answered that there was no policy for the removal of a moderate risk tree; however, he explained that in this instance the staff had focused on the consequence of failure and determined the tree should be removed.

Mayor Pro Tem Sue Kempf asked about the risk assessment. City Arborist Matthew Barker described staff's analysis of the risk assessment.

Mayor Pro Tem Sue Kempf asked if there was adequate room for a replacement tree to grow in that spot safely. City Arborist Matthew Barker answered that after the removal was conducted, staff would be able to make an informed recommendation to City Council Public Testimony: Howard Englander, homeowner at 387 El Camino Del Mar, voiced his concerns about the tree and urged that the City Council approve removal of the tree for safety purposes.

Chris Reed, Ruben Flores, Kurt Wiese, Ann Christoph, and Anne Caenn said they did not support removal of the tree, and they explained offered suggestions.

Mayor Bob Whalen responded to Mr. Wiese's comment that raised the issue of the need to perform a California Environmental Quality Act (CEQA) analysis. City Attorney Megan Garibaldi recommended that tonight's item be continued to the next meeting to include the CEQA Class 4 exemption in the notice.
-8-
Laguna Beach City Council Minutes October 10, 2023
Councilmember Mark Orgill stated that the tree was part of a grove of trees and that fact could add to its significance during the CEQA analysis.

Councilmember George Weiss added that the grove of trees created a majestic quality to the roundabout in this neighborhood. He stated that public safety was important; however, he said there should be every attempt by the city to save the tree, suggesting giving the tree extra care and returning in six months with an update.

Councilmember Alex Rounaghi asked about staff's root damage determination. City Arborist Matthew Barker explained the staff's root damage determination, and a discussion ensued.

Mayor Bob Whalen confirmed with the City Attorney that tonight should be a continuation of the item whereby the City Council could direct staff to prepare a resolution to remove or maintain the tree and to include the CEQA analysis in a staff report at the following meeting.

Councilmember George Weiss voiced concerns that the City Arborist did not provide adequate findings in his report to support the root damage.

Councilmember Mark Orgill asked about trimming the tree and if that could prevent failure. City Arborist Matthew Barker explained that crown reduction would reduce branch failures; however, he said the concern in this situation was a failure at the base of the tree.

Mayor Pro Tem Sue Kempf commented that although she loved these trees, this was a safety concern for residents. She said the homeowners were worried that the tree would fall on their home because the roots were damaged as determined by the city's arborist.

Mayor Bob Whalen suggested continuing the item to the next meeting.

Moved by Mayor Bob Whalen, seconded by Councilmember George Weiss, and carried unanimously 5/0 to continue this item to the October 24, 2023, City Council meeting, to include the California Environmental Quality Act (CEQA) exemption for the removal of the Lemon Scented Gum tree located at 387 El Camino Del Mar.

APPEAL OF APPROVAL OF DESIGN REVIEW 23-0592 AND COASTAL DEVELOPMENT PERMIT 23-0593 FOR ADDITIONS AND REMODEL OF AN EXISTING SINGLE-FAMILY DWELLING AT 111 SUNSET TERRACE IN THE R-1 (RESIDENTIAL LOW DENSITY) ZONE
Staff Report: Senior Planner Chris Dominguez gave a presentation describing the appeal of the Design Review Board (DRB) approval for additions and a remodel of an existing single-family home at 111 Sunset Terrace.

Laguna Beach City Council Minutes October 10, 2023
Testimony in Support of the Appeal: Tim Carlyle, attorney representing the appellant, listed their grounds for appealing the project.

Testimony in Opposition to the Appeal: Katie Flores, architect for the project, clarified the points raised by Carlyle, including concerns regarding staking and the chimney flue.

She stated that her client was prepared to remove the proposed roof addition over the middle of the house to improve the appellant's ocean view, and to only add a small area at the front of the house.

Mayor Bob Whalen confirmed that the homeowner did not intend to change the existing chimney flue.

Arlene Algerian, architect for the project, explained that the proposed project would net 2 square feet to include an approved elevator for the disabled homeowner.

Senior Planner Chris Dominguez commented that the building division had reviewed the visuals and had indicated that it was feasible to maintain the flue in the existing location.

Miranda Barone, homeowner and applicant, stated that they had made many concessions for the neighbors. She implored the City Council to approve the project so that the elevator could be installed in her home.

Kjell Bo, David Forsythe, and Julie Bo said they were in full support of the improvements to the home, and they hoped the City Council would deny the appeal and allow the Barones to move forward with their much-needed upgrades.

Rebuttal: Tim Carlyle, attorney for the appellant, stated that the appellant was in full support of the upgrades to the home; however, he said what the Design Review Board approved was not the project currently being discussed. He voiced concerns that the chimney flue would not be maintained at the existing location or height.

Mayor Bob Whalen confirmed with the appellant that he would be supportive of the project if the applicant utilized the latest project designs from June 16, 2023, and the existing chimney flue remained at its existing location and height Moved by Mayor Bob Whalen, seconded by Councilmember Alex Rounaghi, and carried nanimously 5/0 to deny the appeal and sustain the Design Review Board's approval c esion Review 23-0592 and Coastal Development Permit 23-0593. on the conditions thi the project is per the June 16, 2023, plans as submitted, and the existing chimney flue remains in the existing location at the existing height. -10-
