SUMMARY OF THE MATTER
Approved for Placement on the Agenda By:
Dave Kiff, City Ma~ ger
On February 27, 2024, the City Council appointed Mayor at the time, Sue Kempf, and Councilmember Mark Orgill as a City Council Ad Hoc Committee (Committee) for the Promenade on Forest project (Project). On April 23, 2024, the City Council received an update from the Committee regarding the Project's work plan and reaffirmed the Project's description as a pedestrian plaza. On July 23, 2024, the City Council approved the Ad Hoc Committee's request to increase the number ofresidents to serve on the resident focus group from 7 to 12 to provide feedback to the Committee regarding the Project's design. This evening, the Ad Hoc Committee will present the proposed conceptual design for the Project and request feedback from the community and direction from the City Council regarding the next Project steps. The presentation will also include the work the Ad Hoc Committee has completed to date.
BACKGROUND
Today, the Promenade is a pedestrian plaza in Downtown Laguna Beach providing a mix of uses including outdoor dining, shopping, and community gathering. The Promenade was initially created by the City Council in 2020 in response to the COVID-19 pandemic and is currently authorized until January 31, 2027, through Temporary Use Permit 23-1966 and Coastal Development Permit 23-1967. On January 12, 2021, the City Council directed staff to solicit proposals for design and entitlement to convert the Promenade to a permanent installation. Permanent conversion includes creation and construction of a pedestrian plaza to preserve and enhance the unique character of Downtown Laguna Beach, and to transform the Promenade into a strong city center, permanently establishing it as an iconic destination that meets the needs and desires of residents, employees, and visitors.

City's Guiding Documents
General Plan - The City has a number of guiding documents and policies that contribute to the design of City Projects and land use decisions. The City's General Plan, a blueprint for meeting the community's long-term vision for the future, recognizes that the downtown represents the commercial, economic, and social center of the community. The plan also discusses the physical separation of the downtown (Central Business District) from other regions of the City, which enhances the importance of the identity of this area and its function as a community focal point. The proposed Promenade as a permanent pedestrian plaza is consistent with the City's General Plan Land Use Element Goals and Policies, such as General Plan Goal 3, which is to preserve, enhance, and respect the unique, small-scale village character and individual identity of Laguna Beach's commercial areas. Specifically, the Project is consistent with Policy 3.5, which promotes safe and adequate pedestrian access to and within commercial areas.
Creative Placemaking Assessment - The City's Creative Placemaking Assessment is a master plan to strengthen arts and culture for the entire community. The City Council approved the plan at its meeting on September 25, 2018, and provided direction to staff for implementation. Expanding the Civic Arts District and strengthening walkable arts precinct, and improving utilization and public access to arts venues such as the Laguna Playhouse, Festival of Arts, and Sawdust Art Festival sites was included in the plan. The assessment discussed the pedestrianization of Forest Avenue and the inclusion of art activations. The proposed Promenade as a permanent pedestrian plaza is consistent with implementing the plan and provides the opportunity for art activation, and strengthens the walkable arts precinct.
Project Description
On April 23, 2024, the City Council reaffirmed the Promenade on Forest Project as a pedestrian plaza:
The Promenade transforms a former street into a vibrant and shaded pedestrian plaza, offering a place to leisurely shop, eat, rest, and relax. Respectful of our history as a unique community, the Promenade will celebrate the influence of art, music, and our treasured landscape character of Laguna.
This includes both the creation of a permanent pedestrian mall on lower Forest A venue and the approval of a design for the above-referenced Project and the letting of a contract for construction for the improvements.
Scope of Work for Ad Hoc Committee
The City Council approved the scope of work for the Promenade Ad Hoc Committee, which consisted of collaborating with residents, community members, staff, and consultants in delineating the parameters and limitations of the Project. Additionally, the Committee's objective was to undergo a comprehensive strategy for advancing the Project, integrating public engagement methods to gather feedback from the community's proficient volunteers with diverse expertise in relevant fields. The Committee engaged SW A Group, a reputable local firm, as the Project's design consultant. The firm has been doing work since 1976 and has completed a long list of community design Projects in the region.

Proposed Conceptual Design - Forest
Project Narrative
Defined by its relationship to the sea, its natural and manmade landscape, and its unique artistic heritage, Laguna Beach sits alone amongst California's seacoast communities. As early as 1886, plein air painters came to Laguna Beach to hone their craft and capitalize on the clear, dramatic natural light that illuminated the coast's exquisite natural beauty; these artists found a welcoming home full of captivating vistas including picturesque cliffs and coves along the sea. Over the years, Laguna Beach has evolved into a thriving coastal destination cherished by many, as both residents and tourists savor the City's scenic splendor side by side.
The Forest Avenue Promenade design (Figure 1) draws inspiration from this rich character and history, seeking to create a place for all - a place that is simultaneously simple, timeless, strong, and flexible, articulating Laguna Beach's unique qualities while allowing for artistic expression and the community's growth and evolution. Serving as a multifaceted living room for Laguna Beach, Forest Avenue provides a central gathering place for residents and visitors alike. Framed by eucalyptus and showcasing an eclectic mosaic of coastal gardens and plants, Forest A venue provides a stage for seasonal events and an immersive setting for strolling, shopping, gathering, performance, music, dining and savoring the majesty of the sun setting over the Pacific. It's a singular destination where the mountains meet the sea, shaped organically by generations of artists, families and tourists drawn to its incredible climate and unmatched scenery - a celebration of that eclectic and inspired history.

• The Ad Hoc Committee met with representatives from the Alcoholic Beverage Control (ABC), which explained the regulatory requirements associated with the service of alcohol. The service of hard liquor outside the restaurants would require additional defined areas with barriers (Figure 2).
The service of just beer and wine would require barriers at the end of each side of the street/Project area. A Conditional Use Permit (CUP) may be required depending on the selected design option. • For the consumption of hard liquor, restaurant dining spaces will need to be further secured with a close proximity barrier, as demonstrated in the following site plan.

Project Drainage Strategy
The downtown area is subject to certain environmental hazards, such as flooding, liquefaction, and wave run-up. Laguna Canyon Channel, which drains a 5,900-acre watershed, is the major watercourse through the City. The total drainage area is about six miles in length and averages about 1.4 miles in width. Nearly 80 percent of the watershed is characterized by a wide, hilly basin. This basin, in turn, funnels into a welldefined, narrow canyon that eventually opens onto the coastal floodplain. Most of the area is within the coastal floodplain. Despite the Laguna Canyon flood control channel, flood damage to the downtown area can be substantial during years of unusually high rainfall. The flood control improvements can handle, at most, a 25-year storm; however, some sections of the channel have even less capacity. Since the downtown area is within the 100-year floodplain, it is evident that the present storm drainage system provides very inadequate flood protection. The 100-year storm represents the amount of run-off produced by a storm that has a one percent chance of occurring in any given year, or that would occur on an average once every 100 years. The flooding produced from a 100-year storm, termed the "base" flood, is the flood level used in flood hazard planning. In the event of a 100-year flood in the Laguna Canyon watershed, floodwaters overflow the flood control channel and inundate portions of the downtown. This area, referred to as the 100-year or base floodplain, generally extends across the width of the downtown between Broadway and Mermaid Streets.
All new construction and substantial improvements of structures within this area are subject to the standards outlined in the City's Floodplain Management Ordinance (Laguna Beach Municipal Code Chapter 25.38).
Generally, new construction would be required to have the lowest floor, including the basement, elevated above the base flood elevation.
The downtown area is also subject to wave run-up. This type of flooding is typically caused by large swells produced by storms at sea occurring at high tide. Approximately every 10-15 years, waves wash up on Coast Highway between Broadway and Ocean A venue. In the past, water and debris led by the waves have Consideration of Promenade on Forest Conceptual Design
February 4, 2025
typically caused no damage to the commercial area, but Coast Highway has been blocked off to traffic.
Main Beach Park has suffered damage from wave run-up and heavy sand deposition. This impact will increase with the threatened rise in sea level.
Given this, the Project team met with the City's Public Works department and have assembled a drainage strategy for the Project. The drainage strategy consists of a combination of drainage methods to handle high water volumes and increase water quality (Figure 3). The system will be overdesigned by providing an abundance of drain locations and infiltration areas in efforts to create resiliency for periods of high storm water volumes. The design of the plaza is graded to appear even level in appearance with cross slopes of 1 % and maintaining the existing slope towards PCH. Two trench drains, set 15 ' away from the building faces, run parallel along the length of Lower Forest which connect via laterals to the existing stormwater pipe under the road. These trench drains will be wide in design for ease of maintenance and access to clean out obstructions. The pea gravel areas will allow for stormwater infiltration and have a subsurface drain system that provides a means for improving the water quality. In order to accommodate for the roof water volumes that drain into the pedestrian walkway, small catchment basins treated with pea gravel or planting will be at the basin of each downspout.

Parking Analysis
The Promenade on Forest Traffic Impact and Parking Analysis was conducted in December 2020 by an independent outside consultant, DKS Associates. The report indicated that the removal of parking on Forest A venue did not significantly impact the study area:
Parking analysis showed the parking removal did not significantly impact the parking conditions of the study area throughout weekday and weekend because the combined utilization rate of the on-street and off-street parking facilities mostly remained under 85 percent.
Since the report, the City has taken over the management of 30 parking spaces located at the Library, which are available for paid public parking after Library operating hours. In addition, the City is leasing seven parking spaces in a private parking lot located on Ocean A venue, which are available to residents with a valid Shopper Permit. The City has also increased its transit services since the report, including launching Laguna Local, a free, on-demand, shared-ride transit service between residential neighborhoods and major activity centers within the City. The City's Trolley Service also provides service throughout the city and all trolleys are wheelchair-accessible. On June 13, 2023, the City also adopted its Parking Masters Plan, which contains other parking strategies to improve the quality of life within the community and promote vibrant and walkable commercial districts.
Public Safety
The City's Fire Department has advised the Ad Hoc Committee on Project constraints that relate to public safety. The fire department advised that there needs to be a 150' fire hose pull length from both sides of the street. All seating or plan arrangements need to be movable in the event of a large fire. Overhead lights (string lights) should be 13 feet or higher so the fire apparatus can drive underneath them. These important public safety project constraints have been built into the proposed Project's design. Also, at each end of the street, it is proposed to have vehicle-rated impact bollards to prevent a vehicle from driving into the street.
Utility Assessment
Staff completed a utility assessment of the Project area and a stormwater line is the only utility that runs through Forest Avenue. The assessment consisted of reaching out to various utility companies, such as Southern California Edison (SCE), Southern California Gas Company (SoCal Gas), Laguna Beach Water District, etc., to understand if they have any existing utilities underneath the street and within the Project area. The utility companies provide their best information available.
Cultural Arts Grant
The Cultural Arts Division has applied for a grant available through the National Endowment for the Arts.
Titled "Our Town," the grant is specifically to support creative placemaking projects that integrate arts, culture, and design into local community development efforts. Should the application be successful, the funding would be utilized to develop an activation plan. The Arts Commission is committed to facilitating the project, and if the application is unsuccessful would consider funding such efforts from its Special Programs budget.

Tree Assessment
To preserve the existing eucalyptus along Forest, the City is currently working on conducting a tree health and risk assessment to determine which trees may have nutrient deficiencies or pose a risk to public safety.
The proposed design seeks to maximize the existing trees while considering some trees may need to be replaced with a healthier tree of the same species.
Project Next Steps
Depending on the direction of the City Council tonight, once the City Council has approved a conceptual design, the City can move towards obtaining the necessary entitlements for the Project and then work on initiating its construction.
Action Item Description
Approval of the Project's Conceptual Design The City Council approves a conceptual design.
CEQA Analysis Ongoing as staff work towards obtaining the approvals for the Project.
Creation of a pedestrian mall on lower Fore st The Community Development Director may Avenue consider a Coastal Development Permit (CDP), and the City Council considers adoption of a Resolution
of Intention, and after noticing, conducts a public
hearing to establish a pedestrian mall and CEQA
approval for the project.
Obtaining Project's Entitlements The Planning Commission considers a CDP and Design Review (DR) for the proposed
improvements.
Construction Bidding Process The City opens a call for bids for the Project, receives bids, reviews bids, and presents selected
bid to the City Council for approval.
Obtain Project Funding The City Council allocates funding for the Project via the City's Capital Improvement Program.
Currently a portion of the Project is already funded.
Project Construction Construction begins on the Project.
As part of the construction bidding process and Project construction, the City will work with property owners and businesses in the Project area to minimize construction impacts and phase in the Project's construction. The cost and timeline of the Project will be better understood upon reviewing the bid proposals and awarding the bid.
FINANCIAL ANALYSIS
The next phase of design for the Promenade is included in the Capital Improvement Program, therefore, the recommended actions have no financial impact at this time.
Consideration of Promenade on Forest Conceptual Design
February 4, 2025
ENVIRONMENTAL ANALYSIS
The consideration of the proposed conceptual design for the Promenade on Forest Project and the provision of direction to the Ad Hoc Committee and staff regarding the next steps are not subject to the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines, as it is not a "project" and has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. (14 Cal. Code Regs. § 15378(a).) Furthermore, the proposed actions are exempt from CEQA as there is no possibility that such action would have a significant negative effect on the environment or limit the choice of alternatives or mitigation measures before completion of CEQA compliance. (14 Cal. Code Regs. § 1506l(b)(2).) Instead, the proposed actions are administrative in nature. There is no Project approval at this time.
Once the City Council has approved the Project description associated with the conceptual design plan, staff will initiate the next steps with a selected consultant to conduct the necessary CEQA analysis, which can be completed as staff work towards obtaining the required entitlements for the Project. Staff has received 6 proposals from consultants to conduct a CEQA analysis on the proposed Project.
The selected consultant will analyze the Project's characteristics and construction and buildout assumptions and determine if the Project qualifies for a CEQA exemption. If the consultant determines that the Project qualifies for any of the exemptions outlined in the State CEQA Guidelines, the consultant will also determine whether any exceptions to the exemption as outlined in State CEQA Guidelines Section 15300.2 apply and thereby trigger additional environmental review. If it is determined the proposed Project does not qualify for an exemption or any of the exceptions apply, the consultant would notify the City and prepare an Initial Study to determine whether a Negative Declaration, Mitigation Negative Declaration, or an Environmental Impact Report should be prepared for the proposed Project.

RE: PROMENADE ON FOREST
The Laguna Beach Chamber of Commerce supports the PROMENADE ON FOREST project and envisions a vibrant town center where residents can enjoy year-round events, along with unique dining and shopping opportunities. This outdoor space will provide additional chances for residents to visit local restaurants and enjoy outdoor meals while taking in the views and browsing shops. It aims to create a community hub for both residents and visitors.
The Laguna Beach Chamber of Commerce will continue to engage with the business community to gather public comments and ideas that we hope will be incorporated into the PROMENADE ON FOREST project.
We encourage Councilmembers Sue Kempf and Mark Orgill, as the City Council Ad Hoc Committee, to keep the PROMENADE ON FOREST project moving forward in a timely manner. We believe that any challenges can be overcome and that we can address multiple issues simultaneously.
Jeff Redeker
Chairman of the Board
