4 RESOLUTION NO. 25.XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAGUNA BEACH, CALIFORNIA, ESTABLISHING
PARKING RESTRICTIONS ON NYES PLACE AND
FINDING THE PROJECT EXEMPT FROM CEQA
PURSUANT TO STATE CEQA GUIDELINES SECTIONS
15061(b)(3) AND 15304
WHEREAS, California Vehicle Code Section 22507(a) and Laguna Beach Municipal Code (“LBMC”) Section 10.03.010 provide for and authorize the City Council to establish traffic controls within the City; and
WHEREAS, at its meeting on July 24, 2025, the City’s Parking, Traffic and Circulation Committee reviewed, considered, and made a recommendation regarding a request to establish parking restrictions on Nyes Place adjacent to 432 and 438 Nyes Place; and WHEREAS, the Public Works Department has reviewed the proposed parking restrictions for safety, in accordance with LBMC Section 10.03.010(b); and WHEREAS, at its meeting on August 12, 2025, the City Council considered the recommendation of the Parking, Traffic and Circulation Committee.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The recitals above are true and correct and are incorporated herein by reference.
SECTION 2. Ten feet of “No Parking” restrictions shall be installed on the northwesterly side of Nyes Place between the driveway aprons of 432 Nyes Place and 438 Nyes Place.
SECTION 3. The Director of Public Works and Utilities shall establish and maintain signage and/or markings to indicate the parking restriction as established in Section 2 and is authorized to take incidental actions necessary to carry out Section 2.
SECTION 4. Portions of all prior resolutions in conflict herewith are hereby repealed to the extent of such conflict and are of no further effect. 5 Reso. #
SECTION 5. For purposes of the California Environmental Quality Act (“CEQA”), the establishment of 10 feet of parking restrictions on Nyes Place adjacent to 432 and 438 Nyes Place is a part of the recommendations made by the Parking, Traffic, and Circulation Committee, which also include the modification of the existing commercial loading zone, the installation of one golf cart parking space and the installation bicycle parking on Ocean Avenue adjacent to 176 South Coast Highway (collectively referred to as the “Project”). The approval of the Project is not subject to CEQA pursuant to State CEQA Guidelines sections 15060(c)(2) and 15061(b)(3) because it will not result in a direct or reasonably foreseeable physical change in the environment. Here, it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment because it does not involve any significant physical actions that could present harm to the environment.
Alternatively, the Project is also categorically exempt pursuant to State CEQA Guidelines Section 15304 - Class 4, Minor Alterations to Land, which consists of minor alterations to the land, water and/vegetation that does not involve the removal of healthy, mature, scenic trees. Here, the proposed parking restrictions are minor in nature and do not have the potential to cause a significant physical effect on the environment. Further, none of these actions involves the removal of any healthy, mature, scenic trees.
Further, none of the exceptions outlined in CEQA Guidelines section 15300.2 apply. The project site does not contain any environmentally sensitive areas. There will be no cumulative impact resulting from successive projects of the same type in the same place over time. There are no unusual circumstances resulting in a significant impact on the environment. There will be no damage to scenic resources, including trees, historic buildings, rock outcroppings or similar resources, within a highway officially designated as a state scenic highway in that project is temporary. The project is not located on a hazardous waste site or any other site included on a list compiled pursuant to Government Code section 65962.5. The Project will not result in significant adverse impacts to historical resources as the existing structures onsite are not on the California Register of Historical Resources. Thus, the Project falls under the Class 4 exemption. Upon 6 Reso. #
adoption of this Resolution, staff is directed to cause a Notice of Exemption to be filed with the County Clerk and State Clearinghouse within five working days.
ADOPTED this 12th day of August 2025.
