Once an appeal is filed, the City Council has to approve the withdrawal. At that time, the City Council will determine how much, if any, of the appeal fee to direct staff to refund. It depends on many factors, such as how much staff involvement there has been, if there was any noticing done, etc. I will reach out to Community Development to advise them to draft a withdrawal agenda report, with recommendations regarding any refund of the appeal fee.

Best,

I am going to cancel my appeal that is scheduled for August 12 regarding the view preservation at 280 Cajon. Am I able to get a refund for the $2,000 fee? Sorry for any extra work.

In response to your request, staff is changing their recommendation to instead continue the appeal hearing to August 12. The Mayor typically takes continuances out of order, at the beginning of the meeting, so anyone in attendance on that item do not have to wait hours for such a simple action.

[NOTICE: This message originated outside of City of Laguna Beach -- DO NOT CLICK on links or open attachments unless you are sure the content is safe.] Good morning,
I will attend tonight's meeting tonight to put in my request. Looks like it's the last agenda item. Is there a chance that agenda items are addressed out of order, or should I plan on being the last item?
I co-own the building. Plus, people involved (tenants and our attorney) as well as one of the owners are not able to attend June 10.
8 Thank you
Garth

Garth, if you want a date that’s later than the one recommended by staff, you should definitely attend Tuesday’s meeting to make the City Council aware of your request.

June 24 is likely not an option due to other appeals already scheduled for that date. The applicant is not available for July 22, so the hearing may get pushed to August 12, if need be.

What do you mean by “one of the owners” or “people involved”? Best,

[NOTICE: This message originated outside of City of Laguna Beach -- DO NOT CLICK on links or open attachments unless you are sure the content is safe.] Hi,
Can I request a different date through you, or should I attend Tuesday's City Council meeting to request a date other than June 10? I would like the topic pushed to either the June 24 or July 22 meeting. One of the owners isn't available June 10, and neither is my attorney. Similarly, July 8 has challenges for people involved.

Unless you say otherwise, I plan to attend the May 20 meeting to request a 9 meeting date that works for people helping me with this appeal.

Thank you for working with me.

It will not be heard on May 20. Only the continuance request will. The staff report is recommending June 10; at most, the City Council could direct a different date.

So, you would only need to attend if you want to request a specific date or oppose a later date.

Best,
Ann Marie

Hello Ann Marie,
The agenda item regarding the appeals to the Design Review exemption on vegetation dimensions for
276 Cajon street still appears on the May 20th agenda. There readsw a staff recommendation to continue the appeal at a later date. You 10 said probably June 10th. Should I be prepared for the May 20th meeting in case the City Counsel addresses the item then rather than postpone?
Thank you for your help.

No. Appeals are heard during regular City Council meetings (which start at 5pm), and are at the end of the meeting.

Depending what is on the agenda for that meeting, your appeal may be heard as early as 7pm or as late as 9pm.

Subject: Appeal Date
Garth, City staff need more time to adequately address all the issues related to your appeal in the staff report that will go to the City Council; therefore, please let me know if a revised date of June 10 works for you, for your appeal to be heard by the City Council
Best,
