LETTER OF AGREEMENT

BETWEEN

THE CITY OF LAGUNA BEACH
AND
THE LAGUNA BEACH POLICE EMPLOYEES’ ASSOCIATION
This Letter of Agreement (“Agreement”) between the City of Laguna Beach (“City”) and the Laguna Beach Police Employees’ Association (“LBPEA”) is entered into with respect to the following:

WHEREAS, the parties are currently parties to a Memorandum of Understanding (MOU) with a term of January 1, 2023 through December 31, 2025; and WHEREAS, the parties wish to provide additional incentive for employees in the classifications of Public Safety Dispatcher and Senior Public Safety Dispatcher to work overtime shifts when staffing is less than ten (10) mission ready employees; and WHEREAS, the following sets forth the parties’ Agreement:

1. Article 27.2 of the parties’ MOU provides that employees in the professional staff (which includes employees in the classifications of Public Safety Dispatcher and Senior Public Safety Dispatcher) receive compensatory time or overtime pay at the rate of time and one-half for all hours worked in excess of forty (40) hours in a workweek.

2. Effective on the first day of the pay period following City Council approval of this Agreement, and subject to the conditions below, employees in the classifications of Public Safety Dispatcher and Senior Public Safety Dispatcher shall receive overtime pay at the rate of double time for all hours worked in excess of fifty-two (52) hours in a workweek. If the employee chooses to earn compensatory time off, it will be earned at time and one-half.

3. Eligibility for this double time overtime pay or is subject to the following:
a. The employee must actually, physically work in excess of fifty-two (52) hours in a workweek. In determining whether the employee has worked in excess of fifty-two (52) hours in a workweek, no forms of accrued leave shall count in the calculation.
b. The double time overtime pay described above will continue until the bargaining unit represented by LBPEA is staffed with ten (10) mission ready employees in the classifications of Public Safety Dispatcher or Senior Public Safety Dispatcher. “Mission ready employees” means employees who are fully-trained, certified, and available to be assigned without needing further qualification or preparation. For the avoidance of doubt, the double overtime pay described above shall be available during the term of this Agreement, as set forth in Paragraph 4, whenever LBPEA is staffed with fewer than ten (10) mission ready employees in the classifications of Public Safety Dispatcher or Senior Public Safety Dispatcher.

4. This Agreement will sunset on March 31, 2027, unless both parties mutually agree that it will continue and specify for how long it will continue.
