12 SUBJECT: MARINE SAFETY SEASONAL AND JUNIOR LIFEGUARD UNIFORM

PURCHASE
RECOMMENDATION: It is recommended that the City Council

1. Authorize the City Manager to execute an agreement, in a form approved by the City Attorney, to purchase Marine Safety uniforms for a total of 750 lifeguards in an amount not to exceed $119,000; and

2. Find that the recommended action is not a project within the meaning of the California Environmental Quality Act under Public Resources Code Section 21065.

SUMMARY OF THE MATTER
This report recommends that the City Council authorize the City Manager to execute an agreement with Florence Marine X, LLC, for the purchase of Marine Safety and Junior Lifeguard uniforms in an amount not to exceed $119,000. The Marine Safety Department employs 200 seasonal staff and enrolls up to 550 Junior Lifeguard participants annually, all of whom require uniforms such as board shorts, rash guards, towels, shirts, and hats.

In accordance with the City’s Purchasing System (Chapter 2.30 of the Municipal Code), the Department conducted an informal bid process and received three proposals. Florence Marine X, LLC was identified as the lowest responsive and most qualified bidder. Funding for this purchase is included in the FY 2025-26 budget and no additional appropriation is required.

DISCUSSION
The Marine Safety Department employs 200 seasonal staff and registers up to 550 participants in the Junior Lifeguard program, all of whom require uniforms. To meet this demand, the department's budget includes dedicated funding for the purchase of Lifeguard and Junior Lifeguard uniforms, which consist of board shorts, rash guards, hats, towels, and shirts.

To ensure a competitive and cost-effective procurement, the Marine Safety Department followed the informal bid procedure for the proposed purchase of goods as set forth in Chapter 2.30 (Purchasing System), which requires canvassing the market place to identify the vendors most likely to provide appropriate goods at a reasonable price, soliciting at least three vendors’ written or oral bids, and awarding the purchase to the vendor that is the most qualified bidder.

Bids were evaluated based on factors specified in the Purchasing System, including:
• Price;
• The ability, capacity, and skill of the bidder;
• Whether the bidder has the facilities to perform the contract promptly, or within the time specified; without delay or interference;

• The character, integrity, reputation, judgment, experience and efficiency of the bidder; • The bidder's record of performance of previous contracts; • Previous and existing compliance by the bidder with laws and ordinances relating to the contract; • The sufficiency of the financial resources and ability of the bidder to perform the contract; • The quality and availability of the supplies, equipment, or services purchased, and the adaptability of the above to the particular use required;
• The ability of the bidder to provide future maintenance and service for the supplies, equipment, or services purchased;
• The number and scope of conditions attached to the bid; • Determination of lowest responsible bidder for construction projects in accordance with California Public Contract Code Section 20162.

In response to a request for bids, the City received three proposals from marine uniform providers based on the department's projected one-year requirements. After reviewing the proposals, Florence Marine X, LLC, based in Newport Beach, California, was identified as the lowest responsive bidder. A summary of the proposals received is below.

Vendor Location Total Bid Amount
Florence Marine X, LLC Newport Beach, CA $118,987
Patagonia Ventura, CA $137,367
Quicksilver/Nike Huntington Beach, CA $137,701
Florence Marine X, LLC, a local vendor, is known for delivering high-quality water gear. Staff recommends awarding the purchase of Marine Safety and Junior Lifeguard uniforms to Florence Marine X, LLC, as the most qualified bidder.

FINANCIAL ANALYSIS
The Department of Marine Safety’s FY 2025–26 Uniform and Laundry budget (Account No. 1102601- 55000) includes $167,000. The proposed uniform purchase, in an amount not to exceed $119,000, is fully funded within this allocation and does not require any additional appropriation.

ENVIRONMENTAL ANALYSIS
The recommended action consists of organizational or administrative activities of the City that will not result in a direct or indirect physical change in the environment and therefore does not constitute a “project” within the meaning of the California Environmental Quality Act. (Public Resources Code Section 21065; 14 CCR Section 15378(b)(5).) Here, the recommended action is to purchase lifeguard uniforms and does not authorize any new activity or use by the Marine Safety Department.
