SUBJECT: APPEAL OF DESIGN REVIEW BOARD APPROVAL OF DESIGN REVIEW 24- 2113 FOR MODIFICATIONS TO A PREVIOUSLY APPROVED LANDSCAPE PLAN FOR AN EXISTING SINGLE-FAMILY DWELLING AT 1813 TEMPLE HILLS DRIVE LOCATED IN THE R-1, RESIDENTIAL LOW-DENSITY ZONE,
AND CATEGORICAL EXEMPTION UNDER THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT GUIDELINES SECTION 15304 (CLASS 4) RECOMMENDATION: It is recommended that the City Council:
1. Open the public hearing, take public testimony, and continue the public hearing to the November 18, 2025 City Council meeting; and
2. Find the action is not a project within the meaning of the California Environmental Quality Act under Public Resources Code Section 21065.
SUMMARY OF THE MATTER
On February 13, 2025, the Design Review Board conditionally approved Design Review 24-1151 for modifications to a previously approved landscape plan associated with an existing single-family dwelling at 1813 Temple Hills Drive. On April 3, 2025, an appeal was filed by Rhett and Sherry Schiffman.
City staff recommends that the City Council open the public hearing, take public testimony, and continue the public hearing until the November 18, 2025, City Council meeting. City staff does not intend to provide a staff report at this October 28, 2025, City Council meeting.
FINANCIAL ANALYSIS
The recommended action has no financial impact to the budget.
ENVIRONMENTAL ANALYSIS
In accordance with the California Environmental Quality Act (CEQA), a project means an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and which is any of the following: (a) an activity directly undertaken by a public agency; (b) an activity undertaken by a person which is supported, in whole or in part, through contracts, grants, subsidies, loans, or other forms of assistance from one or more public agencies; and ( c) an activity that involves the issuance to a person of a lease, permit, license, certificate, or other entitlement for use by one or more public agencies. (Public Resources Code Section 21065.) Here, the recommended actions, which result in a continuance of a public hearing, do not constitute a project because the public hearing continuance is not an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. It is an activity which instead results in the City Council considering an appeal of a project at a future date and does not authorize any development under a permit.
