A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, TO ORDER THE VACATION
OF A PORTION OF STORM DRAIN EASEMENT AT 1377
DUNNING DRIVE PURSUANT TO CHAPTER 4, SUMMARY
VACATION, STREETS AND HIGHWAYS CODE SECTION 8330
ET. SEQ
WHEREAS, the City of Laguna Beach has an easement for storm drain purposes located within Lot 19 of Tract 1970 as filed in Book 108, Pages 23 through 25, inclusive, of Miscellaneous Maps, in the Office of the Orange County Recorder, (1377 Dunning Drive); and WHEREAS, a portion of the storm drain easement is no longer required because drainage infrastructure already exists in the general project area to serve the subject and surrounding properties; and
WHEREAS, Robert Folkenflik and Vivian R. Folkenflik, as Trustees under the Folkenflik Trust dated October 24, 1988, as owners of fee title to the land encumbered by the storm drain easement, have requested abandonment of the excess public service easement; and WHEREAS, the City Council of the City of Laguna Beach has considered all information presented at a regular meeting held on December 9, 2025.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The City of Laguna Beach elects to proceed with the vacation of a portion of the storm drain easement pursuant to Chapter 4, Summary Vacation, Streets and Highways Code, section 8330 et. seq.
SECTION 2. The City of Laguna Beach hereby abandons all of that portion of storm drain easement lying within Lot 19 of Tract No. 1970 as filed in Book 108, Pages 23 through 25, Attachment 2

inclusive, of Miscellaneous Maps, Records of Orange County, in the City of Laguna Beach, State of California as described on Exhibit A and depicted on Exhibit B.
SECTION 3. The portion of storm drain easement to be vacated is excess right-of-way not required for drainage, street or highway purposes.
SECTION 4. In accordance with Resolution No. 25-2296, the Planning Commission of the City of Laguna Beach, California, has determined that the summary vacation of City-owned storm drain easement at 1377 Dunning Drive is in conformity with the General Plan pursuant to Government Code 65402; and that the summary vacation is categorically exempt from CEQA pursuant to State CEQA guidelines Section 15301.
SECTION 5. That from and after the date this resolution is recorded, the portion of storm drain easement as described on Exhibit A, attached hereto and made a part hereof is vacated and no longer constitutes a street, highway or public service easement.
SECTION 8. City staff is hereby authorized to cause the recordation of this resolution.
