1 SUBJECT: INTERVIEWS AND APPOINTMENTS TO THE VIEW RESTORATION

COMMITTEE
RECOMMENDATION: It is recommended that the City Council:

SUMMARY OF THE MATTER
Members of the View Restoration Committee adjudicate view claims submitted by property owners to restore pre-existing views that are alleged to be significantly impaired by vegetation. The five-member committee conducts public hearings to review claims, hear testimony, and determine significant view impairment. The Committee may approve a view restoration order and establish a maintenance schedule for the subject vegetation on the property. The View Restoration Committee generally meets on the second Wednesday of each month at 5:00 p.m.

DISCUSSION

Or, the City Council can opt to appoint Mr. Kisiel, and leave the one remaining position open until additional applications are received.

EDWIN C. KISIEL
Laguna Beach, California |
City of Laguna Beach
505 Forest Ave.

Laguna Beach, CA 92651
Dear City Council:

Nearly 15 years ago, I was a law school graduate in the right place at the right time who landed an incredible opportunity – to use my abilities to serve my country as an attorney in the Air Force. My calling has been formidable: interpret environmental laws and regulations, work alongside with environmental scientists to ensure environmental protection and sustainability efforts while accomplishing the mission, and reviewing facts, evidence, and law to make decisions for military personnel actions and financial claims. I count myself extremely lucky that circumstances blessed me to make a home in this beautiful city we call Laguna Beach. I would love to bring the strengths I’ve honed over my career to serve on the View Restoration or Environmental Sustainability Committee.

What, specifically, can I bring to the City of Laguna Beach in a committee assignment? Civic & community involvement: Public service has been my professional calling over the course of my career, both as an active duty & reserve Air Force attorney as well as in civil service for the Department of Defense. I have provided pro bono legal services to the community for environmental law & land use matters and arbitrate investor claims for the Financial Industry Regulatory Authority. I have been recognized for award by one of my bar association’s Pro Bono Honor Society. I also volunteer my time to support local artists at the Sawdust Art Festival. Finally, I have served as a member of the Personnel Board for the City of Laguna Beach from June 2023 – June 2025.

Interest in committee service: My interest in committee service stems from my calling to support and give back to my community. My specific interest in serving on the View Restoration Committee is that I have deep experience and gain fulfillment from hearing and making decisions on cases. I am also impressed by Laguna Beach’s approach to view preservation and restoration, which I evaluated in my 2020 law journal article, The War on Trees: How to Diffuse Neighborly Feuds over View Rights. My specific interest in serving on the Environmental Sustainability Committee comes from my extensive experience in handling environmental law matters, drafting major policy recommendations, and engagement with environmental scientists to synthesize their expertise and viewpoints with my own.

Relevant experience: As an Air Force and Department of Defense attorney, I have nearly 15 years of experience in conducting research, engaging with subject matter experts, and preparing recommendations for action and policy across all environmental facets, both terrestrially and in Earth orbit. I have published many peer-reviewed articles in environmental law, including comparative evaluation of Laguna Beach’s view rights process, options to ensure environmental protection of surfing resources, and how to achieve both environmental sustainability and mission accomplishment. During my career, I have been called upon for dozens of cases to sit as an arbitrator or hearing officer, to hear the facts and evidence presented by parties, and make a decision based on legal and regulatory criteria. This experience would serve well on any committee assignment. During my residency in Laguna Beach, I also have built strong professional relationships with City employees in the Community Development and Legal departments.

Thank you very much for your time and consideration of my application for service on the View Restoration or Environmental Sustainability Committee.

Kind regards,
Edwin C. Kisiel, Esq.

EDWIN C.

INTERVIEWS
6 SUBJECT: INTERVIEWS AND APPOINTMENTS TO THE DESIGN REVIEW BOARD RECOMMENDATION: It is recommended that the City Council:

1. Interview the five applicants and appoint two residents to the Design Review Board/Board of Adjustment for two-year terms beginning April 1, 2026, through March 31, 2028.

SUMMARY OF THE MATTER
The Design Review Board/Board of Adjustment is a five-member body appointed by the City Council to evaluate new one- or two-unit residential projects, or additions thereto, for compliance with the General Plan, Zoning Code, City-adopted design guidelines, and general neighborhood compatibility; and may also consider granting a variance from provision(s) of the zoning code if warranted. Board members are compensated in the amount of $392.00 per month. The Board meets generally on the second and fourth Thursday of the month at 5:00 p.m. and may, from time-to-time, hold a special meeting depending on the volume of pending applications.

A substantial time commitment of approximately 10 hours per week is necessary to be a Board member. In addition to the bi-monthly meetings, Board members are expected to visit each project site as well as affected neighboring properties and to review project plans prior to the meeting. The Board acts on an average of 10 items per meeting. It is desirable to have or be able to acquire certain skills or aptitudes, such as the ability to understand and conceptualize architectural drawings, and to visualize building mass and volumes based upon on-site staking plans. Experience in the building trades, architecture, historic preservation, landscaping, planning and/or real estate would be an asset.

(1) MJ Coveny (Incumbent)

Salty Horse Cafe, Costa Mesa
Before After
I tranformed a neglected 1930s feed barn into one of the most popular restaurants in Orange County.

The property was boarded up, occupied by squatters, and was a haven for transient drug addicts. The adjacent residential neighborhood was crippled by crime and vandalism. I reimagined the building from scratch, brought in utilities, planted trees, and activated the building with a high quality restaurant. The resulting foot traffic from my investment in the community virtually eliminated the crime and homelessness issues in the neighborhood and has encouraged adjacent commercial owners to reinvest in their properties. I performed all aspects of the project, including design, permitting, construction, leasing, and ongoing property management.
