Some Charter Policy Questions
A. City Council (Form of Government, Section 401):
1. Should the charter include provisions that change the way in which we fill vacancies, or defer to State law (GC 36512/34902)?
2. Should the charter include provisions that change the eligibility criteria for Council candidates, or defer to State law?
3. Should the charter include provisions that change Council compensation, or defer to State law (GC 36516) and the City’s existing ordinance?
4. There is a qualified initiative measure for term limits. If passed, that measure will be effective irrespective of the outcome of the outcome of the charter. Should the charter include a provision that states that term limits, if any, shall be set forth in the Laguna Beach Municipal Code, if any such ordinance is adopted by a majority vote of the legally registered voters of the City?
B. Other Required Official Positions (Form of Government, Sections 402 and 403):
1. These sections are optional, and if not included, will default to our Municipal Code provisions and state law.
a. Should the charter include provisions that change qualifications, compensation, duties, or other matters related to other elected positions? b. Should the charter include provisions that specify that other positions (e.g., the City Attorney) remain appointed, or defer to existing Municipal Code provisions?
c. Should the charter include provisions that specify rules for appointment and operation of a CM, or defer to existing Municipal Code provisions? C. Personnel and Retirement Systems (Articles V and VI):
1. Many other charters expand upon these sections. They are currently drafted to maintain status quo. Should the charter expand on these provisions, or maintain status quo through existing ordinances and regulations? D. Potential Other Issues (not presently included, not exhaustive):
1. Should the charter include provisions that change limits and/or rules from what is specified in the Public Contract Code?
2. Should the charter include provisions that change certain regulations relating to local legislative acts or regulation of meeting actions, such as:
a. Adoption/publication of ordinances/resolutions that differs from state law b. Publication of legal notices?
3. Should the charter include provisions that adopt additional conflict of interest or anti-nepotism standards?
