A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA
BEACH, CALIFORNIA, DECLARING AND DETERMINING THAT
VEGETATION OR WEEDS UPON THE STREETS, SIDEWALKS,
PARKWAYS AND PRIVATE PROPERTY IN THE CITY OF LAGUNA
BEACH ARE A PUBLIC NUISANCE, AND DIRECTING THE CITY
CLERK TO MAIL NOTICES TO DESTROY AND REMOVE SAID
VEGETATION OR WEEDS AS REQUIRED BY LAW, AND FIXING
THE TIME FOR HEARING OBJECTIONS AND PROTESTS, AND
FINDING THE PROJECT EXEMPT FROM CEQA
The City Council of the City of Laguna Beach hereby resolves and orders as follows:
Section 1. Pursuant to the provisions of Laguna Beach Municipal Code Chapter 12.12 (Abatement of Weeds and Obstructions to Intersection Visibility) and Laguna Beach Municipal Code Section 11.30.040 pertaining to abatement of vegetation and obstructions that interfere with public interest and use, the City Council hereby determines and declares that all vegetation or weeds located upon the streets, sidewalks, parkways and private property in the City of Laguna Beach hereinafter identified and described, are noxious and dangerous and endanger the public safety and are hereby declared a public nuisance. The streets, sidewalks, parkways, and private property in the City of Laguna Beach upon which or in front of which said vegetation or weeds are located are designated and described on Exhibit “A” attached hereto and incorporated herein by this reference.
Section 2. Pursuant to the provisions of Laguna Beach Municipal Code Chapter 12.12 (Abatement of Weeds and Obstructions to Intersection Visibility) and Laguna Beach Municipal Code Section 11.30.010 pertaining to abatement of vegetation and obstructions to intersection visibility, the City Council hereby determines and declares that all such vegetation or weeds located upon any property at intersecting streets in the City of Laguna Beach hereinafter identified and described are noxious and dangerous and endanger the public safety and are hereby declared a public nuisance.
The property in the City of Laguna Beach upon which or in front of which said vegetation or weeds are located are designated and described on Exhibit “A” hereto and incorporated herein by this reference.
Section 3. The City Council hereby fixes the 12th day of May 2026, at the hour of 5:00 Attachment 1
3 p.m., as the date and time for the City Council to hear and consider all objections and protests, if any, to the proposed removal of said vegetation or weeds. The notice mailed to property owners in accordance with Section 4 below shall contain instructions for presenting any objections and protests in writing and/or at the time of the hearing in person or by telephone.
Section 4. The City Clerk is hereby instructed to prepare and mail notices to destroy said vegetation or weeds as required by law, to all persons owning property described in “Exhibit A” as shown on the last equalized assessment rolls, said notice to be mailed at least five days prior to the time for hearing objections by the City Council.
Section 5. This annual abatement of public nuisances is categorically exempt from the California Environmental Quality Act pursuant to State CEQA Guidelines section 15304 – Minor Alterations to Land (Class 4), which applies to minor public or private alterations to the condition of land, water, or vegetation. This project is designed to eliminate privately maintained vegetation or weeds that are public nuisances in order to minimize obstructions to pedestrians and vehicles. This is exempt under Class 4 because the abatement of vegetation and weeds are minor alterations to land and does not involve the removal of mature, scenic trees. None of the exceptions outlined in State CEQA Guidelines section 15300.2 apply, and therefore no further environmental review is required.
City Council directs staff to cause a Notice of Exemption to be submitted to the County Clerk and State Clearinghouse within five days of the adoption of this Resolution.
