STAFF REPORT
Meeting Date:

April 14, 2026

CONSENT
10 SUBJECT: SECOND AMENDMENT TO TEMPORARY STAFFING PROFESSIONALS, INC.,

AGREEMENT FOR ON CALL TEMPORARY STAFFING SERVICES
RECOMMENDATION: It is recommended that the City Council:

1. Authorize the City Manager to execute a Second Amendment to Agreement No. 25-72 with Temporary Staffing Professionals, Inc., to increase the contract by $150,000 for a revised total not to exceed the amount of $250,000 and extend the term through September 30, 2026; and

2. Find that the action does not constitute a project under the California Environmental Quality Act pursuant to Guidelines Section 15378.

SUMMARY OF THE MATTER
This report recommends that the City Council authorize a Second Amendment to Agreement No. 25-72 with Temporary Staffing Professionals, Inc., (TSP) for on-call temporary staffing services as needed. The amendment would increase the contract amount by $150,000, resulting in a revised not-to-exceed amount of $250,000.

DISCUSSION
The original Agreement No. 25-72 with Temporary Staffing Professionals, Inc., (TSP) was executed within the $100,000 threshold and, therefore, did not require City Council approval, falling under the City Manager’s purchasing authority at the time of award. Since then, the City has continued to rely on these services to address ongoing temporary staffing needs, including coverage for position vacancies and employee leaves of absence. As a result, the contract is now approaching its authorized not-to-exceed amount. The proposed Second Amendment increases the total contract value beyond the $100,000 threshold and extends the term, requiring City Council approval
The second amendment is necessary to ensure there is no disruption in critical staffing support while the City conducts a formal Request for Proposals (RFP) for on-call staffing services. The City has nearly exhausted the current not-to-exceed compensation amount of $100,000. TSP has provided temporary staffing resources to the Finance, Public Works, and Transit & Community Services Departments as vacancies have occurred. As of March 30, 2026, the Finance and Public Works Departments are no longer utilizing temporary staffing services from TSP, however, the Transit & Community Services Department is still utilizing TSP’s services while the recruitment for the related vacant position is on hold pending an assessment of the Transit Division’s operational needs. In addition, another City Department will have a need for temporary staffing services soon when an employee is on an extended leave. This request provides the necessary time to complete a formal solicitation process while ensuring continued support as needs arise.

New State Law: Pursuant to Assembly Bill 339, which requires that affected City labor unions receive at least 45 days’ notice prior to contracting for or amending services within represented job classifications, the City notified Nicole Bovey, President of the Laguna Beach Municipal Employees’ Association, via SECOND AMENDMENT TO TEMPORARY STAFFING PROFESSIONALS, INC.,

email regarding this matter on February 19, 2026. The RFP for on-call staffing services was released on Monday, April 6th.

FINANCIAL ANALYSIS
Funding for temporary staffing services as needed is funded from the salary savings from the vacant positions being temporarily filled.

ENVIRONMENTAL ANALYSIS
The requirements of the California Environmental Quality Act ("CEQA") do not apply to the proposed action as it is not a "project" because there is no substantial evidence to show that the proposed action has the potential to result in a direct or reasonably foreseeable indirect physical change to the environment. (State CEQA Guidelines, section 15378(a). Further, this Ordinance does not qualify as a project pursuant to State CEQA Guidelines, section 15378 (b)(4) and (b)(5) as an amendment to the City’s Financia Guidelines and Budgeting Procedures is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment and it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment.
