NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
Attachment 1
4 -2- Reso. #
SECTION 1. The foregoing recitals are true and correct and incorporated herein by this reference.
SECTION 2. The City Council of the City of Laguna Beach hereby acknowledges receipt of the following report by the LBFD regarding the inspections required by California Health & Safety Code Sections 13146.2 and 13146.3 in compliance with California Health & Safety Code Section 13146.4:

Educational Group E occupancies are generally those public and private schools, used by more than six persons at any one time for educational purposes through the 12th grade.
Within the Fire Department’s jurisdictional boundaries, there are eight known Group E occupancies, buildings, structures, and/or facilities.

compliance rate for this reporting period.
Additionally, the Fire Department completed the annual inspection of 156 Group R-2 occupancies, buildings, structures, and/or facilities. This represents a compliance rate of 100% for the current reporting period.
SECTION 4. The Resolution is not a project within the meaning of Section 15378 of the State of California Environmental Quality Act (“CEQA”) Guidelines because it is an organizational or administrative activity of the City that will not result in a direct or indirect physical change in the environment and therefore does not constitute a “project” within the meaning of the California Environmental Quality Act. (CEQA Section 21065; CEQA Guidelines Section 15378(b)(5).) Further, under CEQA Guidelines Section 15061(b)(3), this Resolution is nonetheless exempt from the requirements of CEQA in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
As this is the City Council acknowledging receipt of LBFD inspection reports, there is no potential for resulting physical change to the environment.
SECTION 5. If any action, subsection, sentence, clause, or phrase of this Resolution or the application thereof to any person or circumstance shall be held invalid or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions of this Resolution that can be given effect without the invalid provisions.
SECTION 6. The City Clerk shall attest as to the adoption and execution of this Resolution and cause the same to be maintained in the permanent records of the City. 6 -4- Reso. #
