A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, DIRECTING THE
DIRECTOR OF PUBLIC WORKS & UTILITIES TO PROCEED
WITH ABATING ALL NOTICED NUISANCES ON
PROPERTIES THAT DO NOT ABATE THE NUISANCES
WITHIN THE PRESCRIBED TIME AND FINDING THE SAME
EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
WHEREAS, the City Council adopted Resolution No. 26.017 on March 24, 2026, which by its terms the Council declared that all vegetation or weeds located upon streets, sidewalks, parkways and private property in the City of Laguna Beach (“City”) and listed the properties in the City upon which or in front of which said vegetation or weeds are located; and WHEREAS, the City Council adopted Resolution No. 26.017 on March 24, 2026, which by its terms the Council declared that all vegetation or weeds upon any property at intersecting streets in the City and listed the properties in the City upon which or in front of which said vegetation or weeds are located; and
WHEREAS, a hearing date was set for May 12, 2026 for the City Council to hear and consider all objections and protests, if any, to the proposed removal of said vegetation or weeds and public notices were sent to all persons owning property subject to Resolution No. 26.017; and WHEREAS, the City Council held said hearing on May 12, 2026, to hear objections and protests to the proposed removal of vegetation or weeds and the noticed locations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The City Council finds and determines that the foregoing recitals, which are incorporated herein by this reference, are true and correct. $WWDFKPHQW

SECTION 2. The City Council, after hearing and considering any and all objections and protests to the proposed removal of said weeds and rubbish, hereby directs the Director of Public Works & Utilities to abate the nuisances declared by this Resolution and Resolution No. 26.017.
The Director of Public Works & Utilities is directed to cause the removal of vegetation or weeds located upon the streets, sidewalks, parkways and private property in the City of Laguna Beach at the properties listed in Exhibit A. The Director of Public Works & Utilities or designees may enter upon private property to abate the nuisance. However, no abatement activities shall occur prior to June 12, 2026 to allow property owner(s) the ability to abate the nuisance at their own expense.
SECTION 3. The Director of Public Works & Utilities or designees shall keep an account of the cost of abatement for each property and shall submit an itemized written report to the City Council at its July 7, 2026, where property owners can hear any object to the cost of any work abatement to be assessed through the property tax bills.
SECTION 4. This Resolution and the abatement of public nuisances (including privately maintained vegetation or other improvements presenting obstructions to pedestrians and vehicles) is a project subject to the California Environmental Quality Act (CEQA). This project qualifies for a categorical exemption pursuant to Section 15304 of the State CEQA Guidelines – Minor Alterations to land (Class 4), which applies to minor public or private alterations to the condition of land, water, or vegetation. The abatement of public nuisances, which include the removal of weeds and vegetation, constitute minor alterations to land, and does not involve the removal of mature, scenic trees. Moreover, none of the exceptions to the exemptions set forth under State CEQA Guidelines section 15300.2 apply. There are no cumulative impacts resulting from successive projects of the same type on the same sites over time because the weeds and vegetation only need be removed permanently one time. There are no unusual circumstances that apply to the 5 -3- Reso. #26.XXX
project that would result in a reasonable possibility for a significant effect on the environment since these involve minor removal of weeds and vegetation. There are no scenic resources within an officially designated scenic highway on or near the abatement of these nuisances that would result in damage to those scenic resources as a result of the project. The properties on which these nuisances are located are not included on any list compiled pursuant to Government Code section 65962.5. There are no historical resources on or near the properties such that there would be a substantial adverse change in the significance of such historical resource. Thus, the project is exempt pursuant to Class 4, and no further environmental review is required.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
