RESOLUTION NO 26.XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, ADOPTING ITS MASTER
FEE SCHEDULE AND FINDING SUCH ACTIONS EXEMPT
FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, under the police power granted by Article XI, Section 7 of the California Constitution, cities may impose fees, charges and rates for certain municipal services; and WHEREAS, it is the intention of the City Council of the City of Laguna Beach that these fees, charges, and deposits shall cover up to, but not exceed, the estimated reasonable cost of providing the service for which the fee is charged; and WHEREAS, the City Council now desires to increase certain fees and adopt new fees that are not charged in order to ensure cost recovery for the services provided; and WHEREAS, based upon the evidence provided, the City Council hereby determines the fees established in Exhibit "A", attached hereto and incorporated herein reasonably cover, but do not exceed the reasonable cost of providing the service for which the fee is charged.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The foregoing recitals are true and correct and incorporated herein by this reference.
SECTION 2. The City Council hereby approves the City of Laguna Beach Master Fee Schedule, attached hereto and incorporated herein as "Exhibit A." Any newly adopted, or increased, fees, charges or deposits related to a development project shall become effective 60 days from the adoption of this Resolution. All other fees, charges or deposits shall take effect upon adoption of this Resolution.

SECTION 3. The adoption of this Resolution is not subject to the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines, as it is not a “project” and has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. (14 Cal. Code Regs. § 15378(a).) A “project” specifically does not include continuing administrative or maintenance activities, such as general policy and procedure making. (14 Cal.
Code Regs. § 15378(b)(2).) Alternatively, the proposed actions are exempt from CEQA, as there is no possibility that such action would have a significant negative effect on the environment. (14 Cal. Code Regs. § 15061(b)(3).) Rather, the proposed actions are administrative in nature and merely adjust the fees and charges for City services to reflect the costs reasonably borne by the City in providing such services.
SECTION 4. If any action, subsection, sentence, clause, or phrase of this Resolution or the application thereof to any person or circumstance shall be held invalid or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions of this Resolution that can be given effect without the invalid provisions.
SECTION 5. The documents and materials associated with this Resolution that constitute the record of proceedings on which the City Council’s findings and determinations are based are located at 505 Forest Avenue, Laguna Beach, California 92651. The custodian of these documents is the City Clerk for the City of Laguna Beach.
SECTION 6. The City Clerk shall attest as to the adoption and execution of this Resolution and cause the same to be maintained in the permanent records of the City.
ADOPTED this 12th day of May 2026.
