RESOLUTION NO. 26.XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, DIRECTING THE FIRE
CHIEF TO PROCEED WITH ABATING ALL NOTICED
NUISANCES ON PROPERTIES THAT DO NOT ABATE THE
NUISANCES WITHIN THE PRESCRIBED TIME AND FINDING
THE SAME EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, the City Council adopted Resolution No. 26.018 on March 24, 2026, which by its terms the Council declared as a public nuisance weeds, rubbish, and refuse located upon the streets, sidewalks, parkways and private property in the City of Laguna Beach (“City”) and listed the properties in the City upon which or in front of which said weeds, rubbish, and refuse are located; and
WHEREAS, that a hearing date was set for May 12, 2026 for the City Council to hear and consider all objections and protests, if any, to the proposed removal of said weeds and rubbish and public notices were sent to all persons owning property subject to Resolution No. 26.018; and WHEREAS, the City Council held said hearing on February 17, 2026, to hear objections and protest to the proposed removal of weeds, rubbish, refuse and dirt.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The City Council finds and determines that the foregoing recitals, which are incorporated herein by this reference, are true and correct.
SECTION 2. The City Council, after hearing and considering any and all objections and protests to the proposed removal of said weeds and rubbish, hereby directs the Fire Chief to abate the nuisances declared by this Resolution and Resolution No. 26.018. The Fire Chief is directed to cause the removal of weeds, rubbish, and refuse located upon the streets, sidewalks, parkways and Attachment 1

private property in the City of Laguna Beach at the properties listed in Exhibit A. The Fire Chief or the Fire Chief’s designees may enter upon private property to abate the nuisance. However, no abetment activities shall occur prior to (INSERT DATE) to allow property owner(s) the ability to abate the nuisance at their own expense.
SECTION 3. The Fire Chief or Fire Chief’s designees shall keep an account of the cost of abatement for each property and shall submit an itemized written report to the City Council at its July 7, 2026, where property owners can hear any object to the cost of any work abatement to be assessed through the property tax bills.
SECTION 4. This Resolution and the annual abatement of public nuisances are exempt from the California Environmental Quality Act exemption pursuant to Section 15304 of the State CEQA Guidelines – Minor Alterations to Land (Class 4), which applies to minor public or private alterations to the condition of land, water, or vegetation. The abatement of vegetation and weeds that pose a public nuisance to pedestrians and vehicles constitutes a minor alteration to land and does not involve the removal of mature, scenic trees. Moreover, none of the exceptions to the exemptions set forth under State CEQA Guidelines Section 15300.2 apply. There are no cumulative impacts resulting from successive projects of the same type on the same sites over time because the vegetation and weeds are removed as needed and do not require permanent or repeated abatement. There are no unusual circumstances associated with the Project that would create a reasonable possibility of a significant environmental effect, as the activities are limited to the minor removal of vegetation and weeds. There are no scenic resources within an officially designated scenic highway on or near the abatement areas that would be impacted by the Project. The properties listed in Exhibit A of the attached resolution are not included on any list compiled 5 -3- Reso. #26.XXX
pursuant to Government Code Section 65962.5. There are no historical resources on or near the properties such that the Project would result in a substantial adverse change to the significance of a historical resource .
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
ADOPTED this ______ day of __________, 2026.
