INCONSISTENT HEREWITH
WHEREAS, on July 11, 2023, the City Council awarded Agreement No. 23-132 to CR&R Incorporated ("Contractor") for the collection, transportation, processing, diversion, and disposal of municipal solid waste, which agreement became effective July 1, 2024 (the "Agreement"); and WHEREAS, the Agreement has been amended by the First Amendment, Second Amendment, and Third Amendment; and

WHEREAS, the City Council determined that the number of valid written protests received did not constitute a majority protest under Article XIIID, Section 6 of the California Constitution; and
WHEREAS, the City Council desires to set the maximum solid waste service rates shown in Exhibit A and approve the Fourth Amendment to the Agreement in substantially the form shown in Exhibit B; and
WHEREAS, the proposed action is exempt from the California Environmental Quality Act pursuant to State CEQA Guidelines section 15061(b)(3) or alternatively is not a project pursuant to State CEQA Guidelines section 15378.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The foregoing recitals are true and correct and are incorporated herein by this reference.
SECTION 2. The City Council hereby finds and determines that a majority protest does not exist with respect to the proposed maximum solid waste service rates.
SECTION 3. The maximum solid waste and recycling collection service rates set forth in Exhibit A are hereby approved and shall become effective July 1, 2026. The rates adopted by this Resolution shall supersede rates previously adopted to the extent inconsistent with this Resolution.
Additionally, the rates set forth in Exhibit A shall be subject to automatic annual adjustments as described below without a further public hearing. The City shall mail a written notice of each annual adjustment to all property owners and customers of record subject to the 23 -3- Reso. #26.XXX
adjustment not less than 30 days prior to the effective date. In no event may an automatic increase cause the rates to exceed the City’s actual cost of providing Solid Waste Service:
PPI — Collection and Processing Component: Beginning July 1, 2027, and each July 1 thereafter through and including July 1 2031, the collection and processing components of the Solid Waste Service Charges shall be adjusted by the annual percentage change (January– December) in the Producer Price Index for Finished Goods Less Food & Energy (WPUFD4131), not to exceed 5% per annum; if the index is negative, the adjustment shall be set to zero.
PPI — Fuel Sub-Component: Beginning July 1, 2027, and each July 1 thereafter through and including July 1 2031, the fuel sub-component of the collection component shall be adjusted by the annual percentage change in the Producer Price Index for Natural Gas (WPU0531), subject to a cap of ±25% per annum.
Disposal (Tip Fee) Adjustment: Beginning July 1, 2027, and each July 1 thereafter through and including July 1 2031, the disposal component shall be adjusted annually to reflect the actual change in the Orange County landfill tipping fee charged by the County of Orange, not to exceed 25% per annum.
SECTION 4. The Fourth Amendment to Agreement No. 23-132 with CR&R Incorporated is hereby approved in substantially the form attached as Exhibit B. The City Manager is authorized to execute the Fourth Amendment and any minor, non-substantive revisions approved by the City Attorney.
SECTION 5. The City Council finds the action exempt from CEQA pursuant to State CEQA Guidelines section 15061(b)(3), or alternatively determines that the action is not a project pursuant to State CEQA Guidelines section 15378.
24 -4- Reso. #26.XXX
SECTION 6. All resolutions or portions of resolutions inconsistent with this Resolution are hereby repealed to the extent of such inconsistency.
ADOPTED this 23rd day of June, 2026.
