June 23, 2026

CONSENT
8 SUBJECT: AMENDMENT TO SERVICE PROVIDER AGREEMENT FOR DAY PORTER

AND SIDEWALK CLEANING SERVICES
RECOMMENDATION: It is recommended that the City Council:

1. Authorize the City Manager to execute Amendment No. 5 to Agreement No. 20-121 with Spectrum Facility Maintenance to extend the agreement term through June 30, 2027, and increase the contract amount by $1,104,628 for continued day porter and sidewalk cleaning services; and

2. Determine that the action consists of organizational or administrative activities of the City that will not result in a direct or indirect physical change in the environment and therefore does not constitute a “project” within the meaning of the California Environmental Quality Act. (Public Resources Code Section 21065; 14 CCR Section 15378(b)(5).)

SUMMARY OF THE MATTER
On September 22, 2020, the City Council awarded Agreement No. 20-121 to Spectrum Facility Maintenance (Spectrum), for day porter and sidewalk cleaning services at various high-traffic visitor locations citywide (Attachment 1). The current agreement is scheduled to expire on June 30, 2026.

This report recommends that the City Council approve Amendment No. 5 to Agreement No. 20-121 to extend the agreement through June 30, 2027, and increase the contract amount by $1,104,628 to ensure the continued provision of these services without interruption. Spectrum has agreed to maintain existing contract pricing during the extension period. The total not to exceed amount for this Agreement, inclusive of all amendments is $5,692,396.

DISCUSSION
Spectrum currently provides daily day porter services year-round within downtown, Main Beach Park, Heisler Park, Aliso Beach Park, Thousand Steps, and other South Laguna beach areas. Day porter services are provided between the hours of 6 a.m. and 10 p.m. and include litter collection, restroom cleaning and restocking, and trash receptacle servicing. In addition, the current contract also provides for routine sidewalk cleaning services within downtown, and several sections of Coast Highway, including Coast Highway from Cliff Drive to Pearl Street, and Coast Highway from Catalina Avenue to 5th Avenue.

Spectrum has provided these services for the City since 2020 and has consistently met the operational needs of the City's high-traffic visitor-serving areas. These services are essential to maintaining clean, safe, and welcoming public spaces for residents and visitors and help preserve the condition and appearance of the City's beaches, parks, sidewalks, and public facilities.

The current agreement expires on June 30, 2026. This report recommends that the City Council approve Amendment No. 5 to Agreement No. 20-121 to extend the agreement through June 30, 2027, and increase the contract amount by $1,104,628 to ensure the continued provision of these services without interruption.

Spectrum has agreed to maintain existing contract pricing during the extension period and has not requested

any rate increases. Maintaining current pricing will allow the City to continue receiving the same level of service while avoiding additional costs during Fiscal Year 2026-27.

The proposed one-year extension will also provide staff with sufficient time to evaluate current service levels and operational needs, review opportunities for service enhancements and efficiencies, and prepare updated procurement documents for a competitive Request for Proposals (RFP) process. Given the importance and visibility of these services, staff believes it is prudent to conduct a comprehensive review of the scope of work to ensure future service requirements, performance expectations, and pricing structures accurately reflect the City's needs and operational objectives.

During the extension period, staff intends to prepare and issue a competitive solicitation for day porter and sidewalk cleaning services. The solicitation process will provide the City an opportunity to evaluate market conditions, service delivery approaches, contractor qualifications, and pricing to help ensure the City continues to receive high-quality services at competitive rates following the expiration of the proposed extension on June 30, 2027.

FINANCIAL ANALYSIS
The proposed amendment will increase Agreement No. 20-121 by $1,104,628 for services through June 30, 2027. The Proposed Fiscal Year 2026-27 Budget includes funding for the contracted services, and no additional appropriations are required for the recommended action.

ALIGNMENT WITH CITY COUNCIL GOALS AND PRIORITIES
The recommended action supports the City Council's Stewardship priority by ensuring the continued maintenance, cleanliness, and functionality of public facilities, beaches, parks, sidewalks, and visitorserving areas throughout the City. Continued day porter and sidewalk cleaning services help preserve public assets, enhance the visitor experience, and maintain community standards.

ENVIRONMENTAL ANALYSIS
The recommended action consists of organizational or administrative activities of the City that will not result in a direct or indirect physical change in the environment and therefore does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”). (Public Resources Code Section 21065; CEQA Guidelines Section 15378(b)(5).) Contracting for routine litter collection, restroom cleaning and restocking, and trash receptacle servicing will not result in any physical change in the environment and thus does not constitute a “project.”
