CONSENT
13 SUBJECT: RESOLUTION APPROVING SENATE BILL 1 ROAD MAINTENANCE, STREET
MAINTENANCE, REHABILITATION, AND SAFETY PROJECTS FOR FISCAL YEAR 2026-27
RECOMMENDATION: It is recommended that the City Council:
1. Adopt the Resolution titled, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2026-27 FUNDED BY SENATE BILL 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT”.
SUMMARY OF THE MATTER
In April 2017, the Governor signed Senate Bill 1 (SB 1), designated as the Road Repair and Accountability Act of 2017, to address deferred road maintenance, rehabilitation, and safety improvement needs on both state highways and local streets. SB 1 created a revenue source through an increase in motor vehicle fuel taxes and vehicle registration fees. On November 1, 2017, the bill took effect, and the State began collecting SB 1 revenues, of which the City has received approximately $400,000-$600,000 annually.
To comply with the accountability and transparency requirements of the SB 1 program guidelines, the City Council is required to approve a list of eligible projects through a separate resolution on an annual basis.
The proposed Capital Improvement Program projects for Fiscal Year 2026-27 that are eligible for SB 1 funding include street resurfacing for Zone 8 (area includes Coast View, Buena Vista, Canyon View, Terrace Way, and Cerritos Drive) and Annual Concrete Repairs for Zone 8. A map showing the locations of the street resurfacing and concrete repair zones is included as Attachment 1. It is recommended that the City Council adopt the attached resolution to facilitate the expected receipt of approximately $645,000 in SB 1 funding (Attachment 2).
FINANCIAL ANALYSIS
Adoption of the new fiscal year’s eligible project list resolution will allow the City to continue to receive the SB 1 funding.
ENVIRONMENTAL REVIEW
The proposed action is not a project within the meaning of the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15378, which states that a project does not include “government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. This resolution adopts, and authorizes submission for approval of, a list of projects proposed to receive funding under SB1 and the RMRA. If such funding is approved, the City may then potentially use such funds for the projects listed that will be reviewed at that later time – if not already approved by the City. Accordingly, adoption of this resolution is not a project and no further environmental review is necessary of the new fiscal year’s eligible project list resolution will allow the City to continue to receive the SB 1 funding.
