RESOLUTION NO. 26.XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, CERTIFYING THE AMOUNT
OF THE ABATEMENT COSTS FOR WEED, GRASS, RUBBISH
AND REFUSE REMOVAL PURSUANT TO RESOLUTION NO.
26.036 AND DIRECTING THESE COSTS TO BE FILED WITH
THE ORANGE COUNTY ASSESSOR, AUDITOR AND TAX
COLLECTOR FOR INCLUSION ON COUNTY TAX ROLLS
AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, the City Council previously adopted Resolution No. 26.018 on March 24, 2026, declaring certain weeds, rubbish, and refuse to be a public nuisance, and subsequently adopted Resolution No. 26.036 on May 12, 2026, directing the Fire Chief to proceed with the abatement of said nuisances via City contractors; and
WHEREAS, the Fire Chief has carried out the physical abatement of the public nuisances on the non-compliant parcels and has compiled an itemized cost report, attached hereto as Exhibit “A” and incorporated herein by this reference, detailing the actual costs incurred by the City for each respective parcel; and
WHEREAS, pursuant to Health and Safety Code section 14912, the City Council may provide for the collection of these abatement costsin the same manner and subject to the same penalty as, or with, other charges and taxes fixed and collected by the county on behalf of the City, and the county may deduct its reasonable costs incurred for the service before remittal of the balance to the City; and
WHEREAS, a public meeting was held on this date, July 7, 2026, to allow all interested parties and affected property owners to be heard, and the City Council has considered all objections and protests, if any, to the itemized costs listed in said report.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES RESOLVE:
SECTION 1. The City Council hereby overrules any protests and formally confirms, adopts, and approves the final report of weed and rubbish abatement costs as set forth in Exhibit “A.”
SECTION 2. The cost of abating such nuisances on each respective parcel of land, as set forth in the confirmed report, constitutes a special assessment against that parcel. These charges shall constitute a lien on the property upon recordation.
SECTION 3. The Fire Chief is hereby authorized and directed to file a certified copy of this resolution, along with the final confirmed report (Exhibit “A”), with the Orange County, California Assessor, Auditor, and Tax Collector, on or before the 10th day of August 2026, for inclusion on the upcoming property tax roll.
SECTION 4. The annual abatement of public nuisances qualifies for a categorical exemption pursuant to Section 15304 of the State CEQA Guidelines – Minor Alterations to Land (Class 4), which applies to minor public or private alterations to the condition of land, water, or vegetation. The abatement of vegetation and weeds that pose a public nuisance to pedestrians and vehicles constitutes a minor alteration to land and does not involve the removal of mature, scenic trees. Moreover, none of the exceptions to the exemptions set forth under State CEQA Guidelines Section 15300.2 apply. There are no cumulative impacts resulting from successive projects of the same type on the same sites over time because the vegetation and weeds are removed as needed and do not require permanent or repeated abatement. There are no unusual circumstances associated with the proposed action that would create a reasonable possibility of a significant 4 -3- Reso. #26.XXX
environmental effect, as the activities are limited to the minor removal of vegetation and weeds.
There are no scenic resources within an officially designated scenic highway on or near the abatement areas that would be impacted. The properties listed in Exhibit A of the attached resolution are not included on any list compiled pursuant to Government Code Section 65962.5.
There are no historical resources on or near the properties such that the proposed action would result in a substantial adverse change to the significance of a historical resource.
SECTION 5. If any action, subsection, sentence, clause, or phase of this resolution or the application thereof to any person or circumstance shall be held invalid or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions of this Resolution that can be given effect without the invalid provisions.
SECTION 6. This Resolution shall take effect immediately upon its adoption.
