SUMMARY OF THE MATTER
This report recommends authorizing the City to use NASPO ValuePoint Master Agreement No. 23026, led by the State of Minnesota, to purchase computer equipment and services from Dell Marketing L.P., up to a not-to-exceed amount of $300,000 through June 30, 2026.

In order for a local agency to participate under NASPO agreements, its home state must have signed onto the cooperative contract. The State of California has signed onto Master Agreement No. 23026, making this procurement option and associated discounts available to the City of Laguna Beach. The California participating addendum is included as Attachment 1.

The agreement is effective through June 30, 2026, and is subject to extension through June 30, 2028. Staff recommends following the NASPO agreement term. If the $300,000 spending limit is reached before the agreement expires, staff will return to City Council for additional purchase authority.

DISCUSSION
Dell Marketing L.P. is one of the City’s primary technology providers, supplying computer hardware, peripherals, and related services. Large software and hardware vendors such as Dell generally do not enter into direct purchasing agreements with smaller agencies, including the City. Staff previously attempted to negotiate a standalone goods agreement with Dell, but Dell was not willing to enter into such an agreement.

To address this, staff recommends utilizing NASPO ValuePoint Master Agreement No. 23026, which was competitively bid by the State of Minnesota and is available to California agencies through the State’s executed participation. This method allows the City to secure competitively bid pricing, standardized terms, and streamlined procurement.

The NASPO agreement is valid through June 30, 2026, with the possibility of extension through June 30, 2028. The City’s authority to make purchases under the agreement would be capped at $300,000. If that limit is reached prior to expiration, staff would return to Council to request additional authorization.

FINANCIAL ANALYSIS
The total expenditure under NASPO Agreement No. 23026 shall not exceed $300,000 through June 30, 2026. These purchases will be funded by existing, approved departmental operating budgets. No additional appropriations are required.

ENVIRONMENTAL ANALYSIS
The proposed recommended actions are exempt from CEQA pursuant to State CEQA Guidelines Section 15061 (b)(3), the "common sense" provision of CEQA, which applies to projects which may have the potential for causing a significant effect on the environment but that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The proposed action will not result in any new development or physical change and it can be seen with certainty that the purchase of computer equipment will not have a significant effect on the environment. Further, none of the exceptions to the listed CEQA exemption apply.
