RESOLUTION NO 26.XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAGUNA BEACH, CALIFORNIA, ESTABLISHING RATES FOR
THE ANNUAL SEWER SERVICE CHARGE FOR SEWER
SERVICES FOR FISCAL YEAR 2026/27
WHEREAS, the City of Laguna Beach (“City”) provides sewer services to customers within the City’s service area and charges a sewer service charge (“the Annual Sewer Service Charge”) to operate the City’s sewer system; and
WHEREAS, City Council of the City of Laguna Beach has elected to annually collect the Annual Sewer Service Charges on the property tax roll pursuant to California Health and Safety Code Section 5473; and
WHEREAS, on June 29, 2021, the City Council considered the Annual Sewer Service Charges for Fiscal Years 2020/21 through 2025/26 during its regular public meeting; and WHEREAS, the City did not receive protests from a majority of property owners or customers of records, and adopted Resolution No. 21.053 to adopt the Annual Sewer Service Charges for Fiscal Years 2020/21 through 2025/26; and
WHEREAS, the City now wishes to collect the Annual Sewer Service Charge on the property tax roll for Fiscal Year 2026/27; and
WHEREAS, the City prepared a Sewer Assessment Roll Report (“Report”) containing a description of each parcel for real property subject to the Annual Sewer Service Charge and the amount of the Annual Sewer Service Charge to be imposed on each such parcel for Fiscal Year 2026/27 (which is the based on the same rates used to compute the Annual Sewer Service Charge collected for Fiscal Year 2025/26), which report is available for public inspection and incorporated herein by reference as Exhibit A.; and

WHEREAS, on July 21, 2026, following the publication of notice as required by law, the City Council held a full and fair public hearing with respect to the Report, and at such hearing the City Council heard and considered all protest and objections to the Report; and WHEREAS, the City Council desires to approve the Report and to submit the Annual Sewer Service Charge described herein to the County of Orange Tax Collector for collection on the Fiscal Year 2026/27 property tax roll.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The foregoing recitals are true and correct and incorporated herein by this reference. All protests and objections are hereby overruled by the affirmative vote of the members of the City Council voting in favor of the adoption of this Resolution.
SECTION 2. The Annual Sewer Service Charge for Fiscal Year 2026/27 established by this Resolution is exempt from CEQA review under Public Resources Code Section 21080(b)(8) and State CEQA Guidelines Section 15273 because the sewer service fees are necessary and reasonable to fund the administration, operation, maintenance, and improvements of the City’s sewer system and will not result in the expansion of the sewer system.
SECTION 3: The City Council reviewed the Annual Sewer Service Charge Report for Fiscal Year 2026/27 during the City Council meeting held on July 21, 2026.
SECTION 4: The City of Laguna Beach hereby imposes and levies no increase in the rates used to compute the Annual Sewer Service Charge for Fiscal Year 2026/27.
SECTION 5: Passage of this Resolution shall constitute a levy of an Annual Sewer Service Charge on each parcel connected to the City’s sanitary sewer system until such time as the rates for the sewer charge are otherwise revised by a subsequent Resolution of the City Council. 4 -3- Reso. #
SECTION 6. Pursuant to the authority of the California Health and Safety Code Section 5473, the Finance Director or their designee shall file the Sewer Assessment Roll Report for Fiscal Year 2026/27 (Exhibit A) with the County of Orange Auditor-Controller.
SECTION 7. In the event the City cannot or does not complete the actions required to collect the Annual Sewer Service Charge against a parcel for a fiscal year on the property tax roll, the Finance Director may collect such sewer charge for that year with respect to that parcel by mailing a bill to the owner of the parcel. Any Annual Sewer Service Charge billed in this manner shall be due and payable upon presentation, but no earlier than December 1 of the fiscal year or paid within thirty (30) days of the due date, then on the first day of each calendar month thereafter, a late fee of ten percent (10%) of the delinquent amount shall be added and become due. If any such Annual Sewer Service Charge remains outstanding at the time the Report is prepared for a subsequent fiscal year, the delinquent Annual Sewer Service Charge (and accrued late fees) may be included on such Report and collected on the property tax roll along with the Annual Sewer Service Charge for that fiscal year.
SECTION 8. If any section, subsection, subdivision, sentence, clause, or phrase in this Resolution or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Resolution or any party thereof. The City Council hereby declares that it would have adopted each section, irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses or phrases be declared unconstitutional, invalid or ineffective.
SECTION 9. The documents and materials associated with this Resolution that constitute the record of proceedings on which the City Council’s findings and determinations are based are 5 -4- Reso. #
located at 505 Forest Avenue, Laguna Beach, California 92651. The custodian of these documents is the City Clerk for the City of Laguna Beach.
SECTION 10. The City Clerk shall attest as to the adoption and execution of this Resolution and cause the same to be maintained in the permanent records of the City.
