3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH
ESTABLISHING SEWER SERVICE CHARGES TO BE IMPOSED ON REAL 4 PROPERTY AND RESCINDING ALL RESOLUTIONS INCONSISTENT HEREWITH 5 6
WHEREAS, Chapter 17.25 of the Laguna Beach Municipal Code establishes a sewer service charge and provides that the amount of said charge shall be determined by resolution of the City 7 8 Council;
9 WHEREAS, the City has complied with each of the requirements of California 10 Constitution Article XIIID, Section 6, including the notice requirements set forth in Section l l 6(A)( 1) for increasing the City's sewer service charges as set forth in this Resolution; 12 13
WHEREAS, the increase in sewer user charges will serve to fund the proposed sewer system capital improvement program;
14 15 WHEREAS, the sewer service charges as set forth in this Resolution are established at a 16 rate that does not exceed the amount permissible under Article XIIID for such a charge and is not 17 a tax;
18 WHEREAS, a majority protest, m; defined by Article XIIID, Section 6(b), does not exist 19 with respect to the proposed increased of the sewer service charge; and 20 21
WHEREAS, the sewer service charges as set forth in this Resolution fairly and equitably recover the cost of prnviding sewer service from alJ customer classes; 22 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 24 LAGUNA BEACH, CALIFORNIA that each parcel of land and improvements thereon be 25 assessed sewer service charges, including an annual increase of up to six percent (6%) for the 26 next five years, as adopted in the ten-year capital improvement and financial programs and as set 27 forth on Schedule A attached hereto and incorporated herein by this reference. 28 3

BE IT FURTHER RESOLVED BY THE CITY COUNCfL OF THE CfTY OF LAGUNA 2 BEACH, CAUFORNIA that the adopted increases in sewer service charges shall be effective as 3 of July I, 2021, with scheduled increases annually until and including July 1, 2026. The rate structure as of July I, 2026 shall remain in effect thereafter until revised. 4 5
6 All resolutions inconsistent with this Resolution are hereby repealed to the extent of such 7 inconsistency and no further.
