Interim City Manager/Director of Public Services
ISSUE: Residential Permit Parking Area on Streets in the Lomas Laguna Residential Neighborhood South of Alicia Parkway
RECOMMENDATION: That the City Council: 1) Find and determine that the proposed permit parking controls are not subject to the California Environmental Quality Act pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, Cal. Code of Regs, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; and 2) Adopt a Resolution entitled, "A Resolution of the City Council of the City of Laguna Hills, California, establishing a Residential Permit Parking Area on streets in the Lomas Laguna residential neighborhood south of Alicia Parkway".

SUMMARY:

Residents of the “Lomas Laguna Neighborhood” south of Alicia Parkway along the streets of Ramona Street, Yolanda Street, Amalia Street, Carmel Street, Eva Street, Lupita Street, Patricia Street, Rosa Street, Andrea Street and a portion of Louisa Street have requested the establishment of a Residential Permit Parking Area. The residents are concerned with preserving parking for residents and guests and controlling overflow parking from other areas. Based upon the resident’s concerns, and in accordance with the Laguna Hills Municipal Code (LHMC), staff provided a petition form for the residents to circulate to other residents of residential property abutting the proposed Residential Permit Parking Area. The residents submitted signed petitions indicating 69% of the

area’s residents support the establishment of a Residential Permit Parking Area in the Lomas Laguna Neighborhood, which qualifies the request for consideration by the City Council Staff recommends the establishment of a Residential Permit Parking Area in the Lomas Laguna Neighborhood. The Traffic Commission, at its regular meeting of January 19, 2022, voted to recommend to the City Council the establishment of a Residential Permit Parking Area in the Lomas Laguna Neighborhood.

BACKGROUND:

Residents of the Lomas Laguna Neighborhood contacted staff with a request to implement a permit-based parking control which would otherwise prohibit general overnight parking in their neighborhood and also provide for no parking during street sweeping days. Staff provided a petition form, as permitted by the LHMC, to be circulated by any resident of residential property abutting the proposed Residential Permit Parking Area. The affected area includes the streets of Ramona Street, Yolanda Street, Amalia Street, Carmel Street, Eva Street, Lupita Street, Patricia Street, Rosa Street, Andrea Street and a portion of Louisa Street, all of which are public residential streets within the Lomas Laguna Neighborhood south of Alicia Parkway. There are 185 single family residences within the affected area. Please see the attached Vicinity Map.

According to LHMC Chapter 11-24, Residential Permit Parking Program, permit parking can be established only if a petition is signed by residents representing 67% or more of the properties abutting the residential street(s) upon which the permit parking is proposed. Based upon the petitions submitted by the Lomas Laguna Neighborhood residents, signatures for 149 of the affected residences were obtained in support of a no overnight permit parking zone and of those signatures, ownership of 127 residences were verified resulting in support of 69% of the 185 affected residences. No overnight parking would be implemented on these streets between the hours of 10:00 p.m. and 6:00 a.m. for vehicles without a parking permit, along with the existing control of no parking during posted days and hours of street sweeping. The existing street sweeping parking control exists on the second and fourth Tuesday of each month between the hours of 8:00 a.m. and 12:00 p.m.

The implementation of the proposed Residential Permit Parking Area would also include, without limitation, the following provisions:
• One permit parking decal per each vehicle registered to the property address • Four guest parking permit placards

• Unlimited one-day special event permits upon request
• Issuance of parking permit decal for private service personnel as specified in LHMC § 11-24.060
• An annual $15.00 administrative fee per each parking decal Staff recommends the establishment of a Residential Permit Parking Area in the Lomas Laguna Neighborhood. The Traffic Commission, at its regular meeting of January 19, 2022, voted to recommend to the City Council the establishment of a Residential Permit Parking Area in the Lomas Laguna Neighborhood.

CEQA:

The permit parking controls are not subject to the California Environmental Quality Act pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, Cal. Code of Regs, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

FISCAL IMPACT:

The Residential Permit Parking Area proposed for the residential neighborhood of Lomas Laguna south of Alicia Parkway will require some administrative staff time, the printing of permit decals, and the posting of signs. The cost of the permit decals is expected to be recovered through an annual fee to the permit applicants of $15 per decal. There is an estimated cost of $1,000 for the installation of the legally required signs to implement the Residential Permit Parking Area regulation. Funds are available for this work in the FY 2021-2022 Public Works Maintenance budget.

Interim City Manager/Director of Public Services
ISSUE: Meeting Cancellation and Continuance of Hearing/Meeting Regarding the Proposed Village at Laguna Hills Project and Proposed Development Agreement (Case No. USE-0010-2019), a Request by MGP Fund X Laguna Hills, LLC to Modify the Previously Approved Five Lagunas Project to Continue to Redevelop the Former Laguna Hills Mall Site Located at 24155 Laguna Hills Mall, Including Adoption of the Fifth Addendum to the City of Laguna Hills General Plan Program Environmental Impact Report as Previously Addended (State Clearinghouse No. 20080811100) and Approval of Site Development Permit, Master Sign Program, Conditional Use Permits, Parking Use Permit, Vesting Tentative Tract Map, Precise Plan and Development Agreement
RECOMMENDATION: That the City Council/Planning Agency: 1) Cancel and continue the continued hearing/meeting regarding the proposed The Village at Laguna Hills Project, previously scheduled for February 8, 2022, to a Joint Meeting of the City Council/Planning Agency at the Regular Meeting of the City Council scheduled for March 8, 2022 at 7:00 p.m. (or as soon thereafter as possible), in the City Council Chamber, or at such earlier time and date as may be determined appropriate by the Interim City Manager; and 2) Direct the City Clerk to provide notice of the continued hearing/meeting as required by law.

BACKGROUND:

On June 29, 2021, the City Council/Planning Agency held a continued joint public hearing regarding the proposed The Village at Laguna Hills Project and related proposed Development Agreement (the “Project”). The public hearing concluded and was closed

4.7 Packet Pg. 64
Meeting Cancellation and Continuance of Hearing/Meeting Proposed Village at Laguna Hills Project

Page 2 ends

at the June 29th meeting. The public hearing is now closed. After closing the public hearing, the City Council voted to direct the Interim City Manager to continue negotiating the terms of the proposed Development Agreement with the applicant/developer, MGP Fund X Laguna Hills, LLC (MGP), consistent with the City Council/Planning Agency Member comments and feedback given at the meeting and to continue the joint meeting to December 14, 2021. The City Council subsequently retained special counsel to assist in negotiation of the proposed Development Agreement and, thereafter, appointed an ad hoc subcommittee to work with special counsel in doing so.

Since December 14, 2021, the ad hoc subcommittee met on numerous occasions to discuss the substance of the proposed Development Agreement and give direction to special counsel. The ad hoc subcommittee and special counsel also met with representatives of MGP in an effort to further negotiate the terms and conditions of the proposed Development Agreement that could be presented to the City Council for its consideration. The ad hoc subcommittee, special counsel, and MGP representatives have worked diligently and cooperatively in an effort to further negotiate and refine the terms of a proposed Development Agreement.

Discussions between City staff, special counsel, the ad hoc committee, and MGP regarding proposed terms and conditions of the required Development Agreement are continuing to progress and are nearing completion; however, additional time is still needed to conclude the negotiations and to prepare a revised proposed Development Agreement for the City Council’s consideration. As such, this matter is not ready for a decision at this time.

Because it would be premature for the City Council/Planning Agency to further discuss or act on the proposed Project while mutually cooperative and productive development agreement negotiations are nearing completion, the continued hearing/meeting previously scheduled for February 8, 2022 must once again be canceled.

Additionally, since December 14, 2021, the City has completed its formal recruitment process, interviewed qualified candidates, and recently hired a new Community Development Director. The City's new Community Development Director began work on January 24, 2022, and is now in the process of reviewing the proposed Village at Laguna Hills Project in its entirety and the required Development Agreement.

4.7 Packet Pg. 65
Meeting Cancellation and Continuance of Hearing/Meeting Proposed Village at Laguna Hills Project
February 8, 2022

Page 3 ends

Since the continued hearing/meeting previously scheduled for February 8, 2022, must now be cancelled, it is necessary for the City Council/Planning Agency to continue the continued hearing/meeting to a new date and time. City staff and special counsel anticipate that a revised proposed Development Agreement will be ready for consideration by the City Council, without further delay, upon completion of the negotiation process and redrafting of the proposed Development Agreement, by no later than the City Council’s March 8, 2022 regular meeting.

As previously advised, pursuant to State law, a city may not conduct more than five hearings/meetings in connection with the approval or disapproval of a proposed housing development project. Continued hearings count as one of the five hearings allowed. (Government Code Section 65905.5) Thus far, the City Council/Planning Agency has conducted a total of three hearings/meetings regarding the proposed The Village at Laguna Hills Project, which are as follows: 1st) April 27, 2021, 2nd) June 24, 2021, and 3rd) June 29, 2021.

ALTERNATIVE:

The City Council/Planning Agency could, alternatively, continue the continued hearing/meeting to a Joint Meeting of the City Council/Planning Agency at the Regular Meeting of the City Council scheduled for Tuesday, February 22, 2022, at 7:00 p.m. (or as soon thereafter as possible), in the City Council Chamber. Special counsel and City planning staff have expressed a concern that there may not be enough time left in the schedule to conclude negotiations, finalize the proposed Development Agreement, and prepare the agenda packet for release to the public not later than the February 17, 2022 agenda posting deadline for the February 22, 2022 City Council meeting. Please also be advised that Monday, February 21, 2022, is a holiday and City Hall will be closed.

Interim City Manager/Director of Public Services
ISSUE: Assembly Bill 1595 Letter of Support for Site Development of a Veterans Cemetery at Gypsum Canyon in Orange County.

RECOMMENDATION: That the City Council approve a letter of support for Assembly Bill 1595 for site development of a veterans cemetery at Gypsum Canyon in Orange County.

SUMMARY:

Orange County is the State’s largest county without a veterans cemetery. In July 2021, the Orange County Board of Supervisors (Board) approved an allocation of $20 million for the planning and construction of a veterans cemetery at Gypsum Canyon in Orange County. All 34 cities in Orange County adopted resolutions of support of the construction of a veterans cemetery at Gypsum Canyon.

To move forward with the project, the California State Legislature must amend existing law by introducing a new bill to study and approve the location of a veterans cemetery.

Consequently, Assembly Bill (AB) 1595, introduced by Assembly Member Quirk-Silva and Assembly Member Choi, will authorize the California Department of Veterans Affairs (CalVet) to acquire, study, design, develop, construct, and equip a state-owned and state-operated veterans cemetery in Orange County.

AB 1595 represents an important milestone in finding a final resting place for Orange County veterans and their families. Staff recommends that the City Council approve the attached letter of support for AB 1595.

Assembly Bill 1595 Support Letter
February 8, 2022

Page 2 ends

BACKGROUND:

Orange County is the State’s largest county without a veterans cemetery. In 2014, CalVet estimated that Orange County was home to approximately 117,000 veterans.

However, Orange County veterans and their families must travel to the Riverside National Cemetery in order for their service members to be interred at a final and proper resting place.

In 2014, the California State Legislature approved AB 1453 to begin the process of bringing a state-owned and state-operated veterans cemetery to Orange County at the Amended and Restated Development Agreement (ARDA) site located at the decommissioned Marine Corps Air Station El Toro in the City of Irvine. A lack of consensus, public opposition, and fiscal concerns over this site prompted a renewed debate pertaining to the most suitable location for a veterans cemetery in Orange County.

In 2017, a second local site known as the Strawberry Fields was proposed and accepted by the City of Irvine for consideration. In 2018, a grassroots effort was passed at the local level overturning the City of Irvine’s previous action. The City of Irvine then directed staff to study a third proposed site known as the Golf Course site, which subsequently led to the introduction and passage of AB 368 in 2019.

AB 368 directed CalVet to work with the California Department of General Services to deliver a site study analysis of the ARDA and Golf Course locations. The study was completed in 2021, but the Irvine City Council took no action on the item, effectively preventing CalVet from submitting an application for a federal grant to move forward the process of building a veterans cemetery.

Consequently, on July 27, 2021, the Board approved an allocation of $20 million for the planning and site development of a veterans cemetery at Gypsum Canyon, in Orange County, near the interchange of State Route 91 and 241 Toll Road. The resolution deeded the property to the Orange County Cemetery District (OCCD) for the purpose of financing and building a state-owned and state-operated veterans cemetery.

Furthermore, all 34 cities in Orange County adopted resolutions in support of constructing a veterans cemetery at the Gypsum Canyon site.

Each time a new site is proposed for a veterans cemetery, the California State Legislature must introduce a new bill to amend the current law, a process that generally takes at least a year or more to complete.

4.8 Packet Pg. 68
Assembly Bill 1595 Support Letter
February 8, 2022

Page 3 ends

Existing law only authorizes CalVet to evaluate the placement of a veterans cemetery in one of two locations in Orange County, thereby excluding from consideration any other site that may be deemed suitable by CalVet and the local community.

AB 1595 simplifies this process by broadly authorizing CalVet, in cooperation with local government agencies, to acquire, study, design, develop, construct, and equip a stateowned and state-operated veterans cemetery in Orange County. This bill also includes an urgency clause to allow CalVet to immediately begin an acquisition study of a proposed cemetery location, as required by law.

AB 1595 represents an important milestone in finding a final resting place for Orange County veterans and their families. Staff recommends that the City Council approve the attached letter of support for AB 1595.

ISSUE: Support for the County of Orange and Orange County Law Enforcement Agencies in Their Effort to Eliminate the Threat of Fentanyl in Orange County Communities.

RECOMMENDATION: That the City Council adopt a Resolution entitled: “A Resolution of the City Council of the City of Laguna Hills, California, supporting the County of Orange and Orange County Law Enforcement Agencies in their effort to eliminate the threat of Fentanyl in Orange County communities."
SUMMARY:

Orange County has seen a significant rise in the selling and use of the synthetic version of the opioid Fentanyl. Over the five-year period from 2016 to 2020, fentanyl-related deaths in Orange County have increased by a factor of 11, and statewide they have increased by a factor of 16. In 2020, Fentanyl and opioid-related emergency room visits and hospitalizations amounted to 1,181 and 269, respectively, in Orange County. The Orange County Sheriff’s Department (OCSD) seized 388 pounds of fentanyl from 2017 to 2020, which amounts to approximately 88 million lethal doses of the drug.

Recently, the Orange County Board of Supervisors adopted a Resolution joining Orange County law enforcement agencies together in their commitment to eliminate the threat that fentanyl poses to Orange County communities. The Fifth District Supervisor, Lisa A.

Orange and Orange County law enforcement agencies to eliminate the threat of fentanyl in Orange County communities.

BACKGROUND:

On January 25, 2022, the Orange County Board of Supervisors adopted a Resolution joining Orange County law enforcement agencies together in their commitment to eliminating the threat of Fentanyl in Orange County. The opioid Fentanyl continues to pose a significant public health and safety risk to Orange County communities.

Fentanyl-related deaths in Orange County and statewide have been rising significantly over recent years. From 2016 through 2020, fentanyl-related deaths in Orange County increased by a factor of eleven from 37 to 432. During that same time period, fentanylrelated deaths statewide increased from 239 to 3,857, representing a factor of sixteen.

Furthermore, in 2020, Orange County emergency department visits and hospitalizations related to opioids, including Fentanyl, amounted to 1,181 and 269, respectively.

From 2017 to 2020, the Orange County Sheriff’s Department (OCSD) seized over 388 pounds of Fentanyl, which is estimated to contain approximately 88 million lethal doses of the narcotic. Additionally, the street value of the seizures is estimated to be $43 million.

As part of their commitment to eliminating Fentanyl in Orange County, the Orange County District Attorney’s Office, Orange County police departments, and Orange County Sheriff’s Department have begun issuing an advisement to arrestees and offenders that if a dealer sells, furnishes, or distributes drugs to someone, and that person dies as a result of using the drugs, they may be charged with murder.

Staff recommends that the City Council adopt a Resolution in support of the County of Orange and Orange County law enforcement agencies to eliminate the threat of Fentanyl in Orange County communities.

SUMMARY:

The Laguna Hills Public Improvement Corporation (PIC) is a non-profit, public benefit corporation for the purpose of assisting the City in its issuance of Certificates of Participation related to the financing of the building of the Laguna Hills Community Center and Sports Complex and the Civic Center. FROM: Erica Pezold

ISSUE: Discussion of Funding, or Equivalent Services, in Support of the Laguna Hills Chamber of Commerce
RECOMMENDATION: Council Member Pezold recommends that the City Council discuss options to support the Laguna Hills Chamber of Commerce.

SUMMARY:

Council Member Pezold is requesting the City Council discuss options to support the Laguna Hills Chamber of Commerce. Options may include: sponsorship opportunities, provide space in the Civic Center for the Chamber, etc.

BACKGROUND:

Staff is providing the following background information: The Laguna Hills Chamber of Commerce (Chamber) provides a menu of membership opportunities (Attachment A):

Membership Levels
Business Membership $225
Non-Profit Membership $165
Community – Non Business $125
President’s Circle – Bronze $1,295

Page 2 ends

President’s Circle – Silver $2,495
President’s Circle – Gold $3,995
President’s Circle – Platinum $5,000
President’s Circle – Diamond $10,000
Should the City Council decide to join the Chamber, Staff recommends the City join at the Non-Profit Membership level. The current budget does not include membership funding above this level and, as such, a budget amendment would be required for any further economic support of the Chamber.

As an alternate to joining the Chamber as a member and, should the City Council wish to provide financial assistance, it may be more appropriate for the City to provide community assistance funding. At its discretion, the City Council may provide community assistance funding to certain community groups and nonprofit organizations that provide community service, support, and/or programming efforts intended to enhance the quality of life of the City's residents, provided the City Council finds and determines that the expenditure of such community assistance funding fulfills a public purpose and provides a direct public benefit within the City of Laguna Hills. In this instance, the City Council may make the requisite “public purpose findings” for community assistance funding, in a specified amount and for a specific period of time, and approve a formal Resolution of the City Council as a means of providing municipal funding to support the Chamber. Most recently, in FY 2019-2020, the City Council authorized $7,500 of community assistance funding to the Chamber via a Community Assistance Funding Resolution. Community assistance funding has not been included in the current budget and, as such, would also require the approval of a budget amendment if it is further considered.

It should be noted that, irrespective of the funding support mechanism, Staff does not recommend City officials and/or Staff serve on the Laguna Hills Chamber of Commerce Board of Directors, should the opportunity be provided to the City. In its primary function, the City serves in a regulatory capacity, which includes some forms of regulation of businesses. While the City and the Chamber will most often have compatible views on local and State issues affecting businesses, there will be instances where the City, in its regulatory function, is not able to take a position or might even be required to take an opposing position as expressed by the Chamber of Commerce. This

could very well create a conflict of interest and, as such, should be avoided.

FISCAL IMPACT:

Staff is providing the following information: While not currently budgeted, membership in the Laguna Hills Chamber of Commerce at the Non-Profit Level could be accommodated within the 2021-2023 Biennial Budget. Should the City Council decide to join at a higher membership level or provide financial support by way of community assistance funding, a Budget Amendment would be required. Alternatively, providing valuable services to the Laguna Hills Chamber of Commerce could and should be recognized as equivalent to a financial contribution. These services have and can include providing low-cost or free access to City facilities for meetings and events, advertising Laguna Hills Chamber of Commerce events and/or co-sponsoring an annual State of the City event.
