Reporting:

Contractor shall submit a written report to the City at the conclusion of each quarterly audit following the requirements of Attachment B of the Agreement. The report shall summarize the results of the auditing program, the number of households audited, the number of non-participants for each Diversion program (Recyclable Materials and Food Scraps/Green Waste), Contamination incidents for each seasonal audit, the average fullness levels of the MSW Carts, the average observed Contamination levels for MSW Carts, locations where on-site Contamination audits were conducted, addresses of Residential Premises where prohibited Contaminants were observed, addresses where Recyclable Materials and/or Food Scraps/Green Waste program non-participation was observed, descriptions of specific contaminants found in the MSW Cart, photos supporting the findings.
 Average MSW Bin/Cart capacity utilization
 Average MSW Contamination percentage levels, by volume, by component and by Contamination types
 Any disparities between field observations and service discrepancies  Photos and descriptions of common contaminants encountered  If Contamination exceeds fifteen percent (15%), submit an action plan to reduce Contamination
 Actions taken to reduce Contamination during the reporting period  Other notable data
If the audit data shows that the observed Contamination levels, by volume, for any stream exceed 15%, Contractor shall submit an action plan to reduce Contamination as part of its report. The Contamination Reduction Action Plans submitted by the Contractor shall include a detailed plan to reduce Contamination for the neighborhoods where high levels of Contamination were observed during the audits. The plan may include presentations at neighborhood association meetings, door-to-door canvassing by Recycling Coordinators, the distribution of written materials to all households on the route where high levels of Contamination were encountered, targeted social media posts, etc. Final Action Plan will be as directed by City.

2. Commercial/Multi-family In-Field Container
Contamination Audits
The following methodology shall be used to conduct on-site field Contamination audits of Commercial and Multi-Family MSW containers.

Purpose:

To quantify the volume of Divertable materials (i.e. Recyclable Materials, Yard Trimmings and Food Scraps) in Commercial and Multi-Family MSW Containers in order to measure the efficacy of Source-Separated Recycling and Food Scrap

Collection programs. The data gathered from the on-site field Container Contamination audits will help the City to determine the following:
1) If there are Divertable materials still being deposited in the Commercial and/or Multi-Family MSW Bins/Carts after a Single Stream and/or Single Material Recycling program and a Food Scrap Collection program have been implemented.
2) The types, weights, volumes, and densities of materials being placed into the Commercial and/or Multi-Family MSW Bin/Cart after a Single Stream and/or Single Material Recycling program and a Food Scrap Collection program have been implemented.
3) Identify specific Commercial and/or Multi-Family Customers where additional outreach, education and training is needed.

Timing:

On-site field Contamination audits shall be conducted on an on-going basis and incorporated into the Recycling Coordinators’ daily site work so that annually all Commercial and Multi-Family Customers in the City will receive at least one (1) field Contamination audits of all the above listed components. Audits shall commence on the effective date of the Agreement and continue throughout the Term.

Methodology:

Using a field data sheet collaboratively developed and approved of by the City, Contractor shall note the following attributes for all MSW Bins and/or Carts present at each Customer:
 Capacity utilization (i.e. Bin/Cart percent full by volume)  Percentage, by volume, of Divertable Food Scraps and of Recyclable Materials found in the MSW Bin/Cart (percentage of each material)  Percent fullness of each MSW Bin/Cart associated with the account  Serial numbers or bar code numbers on the MSW Bins/Carts  Date of site visit
 Photo number(s)
 Discrepancies between field inventories and account service database (i.e. what equipment the Customer has compared to what that Customer is being billed for)
 Any other notable observations.

The on-site field Contamination audits shall be conducted as close as possible to the regular Collection day and time for the Bins/Carts in order to obtain an accurate assessment of the Bin/Cart contents at the time of routine Collection. All field observations shall be photo-documented and photo numbers tracked on the field data collection sheet.

NOTICE IS HEREBY GIVEN that on Tuesday, June 14, 2022, at 7:00 p.m., a public hearing will be held at the City of Laguna Hills City Council Chambers located at 24035 El Toro Rd., Laguna Hills, CA 92653 to consider proposed adjustments to the City’s solid waste rates and charges. If approved by the City Council, the proposed rate adjustments will go into effect on July 1, 2022, and will be subject to annual adjustments for inflation.

WHY RATE ADJUSTMENTS ARE NECESSARY
All cities in the State, including Laguna Hills, face the most stringent solid waste legislation in California history under State Senate Bill 1383 (SB 1383). For City residents and businesses to remain in compliance with this State Law, new organic waste services are necessary, none of which are funded by the State. Therefore, these services must be funded through the solid waste rates charged by the City’s franchised waste hauler.

SB 1383 mandates that California reduce organic waste disposal in landfills by 50% by January 1, 2020, and 75% by January 1, 2025. Organic waste is defined to include green/yard waste and food waste. As a result, green/yard waste and food waste will no longer be able to be disposed of in landfills. It should be noted that the City has already implemented a residential green/yard waste recycling program and a commercial food waste recycling program under the current franchise agreement with CR&R and these services are currently in place.

The SB 1383 unfunded mandate will increase the costs of collection and processing of the waste stream in the City, which requires an increase in collection rates charged by the City’s franchised waste hauler as shown in Table 1 on page 2. The City is fortunate to have very competitive rates among solid waste collection rates in the County.

PROPOSED SOLID WASTE RATES
The proposed initial maximum rates (Rates) for solid waste collection services will be considered by the City as part of an amendment to the Contract for the Collection and Transportation of Recyclable Materials to Processors for Diversion between the City of Laguna Hills and CR&R Incorporated (the Amended Agreement). The Amended Agreement will ensure the City will be in compliance with the State’s SB 1383 requirements to implement organic waste recycling programs that includes a residential food waste recycling program.

The Rates include charges for automated curbside, bin collection, and roll-off box service. The Rates represent the estimated maximum amount CR&R may charge Rate payers as compensation due pursuant to the Amended Agreement for all labor, equipment, materials and supplies, taxes, insurance, bonds, letters of credit, overhead, disposal, transfer, processing, profit, and all other things necessary to perform all the services required by the Amended Agreement.

Single-Family dwellings with cart service will be charged a base rate, which includes a trash cart, a recycling cart, and an organics recycling cart. Commercial and Multi-Family customers with container (cart and/or bin) service are charged a monthly rate based on the number and size of containers, and the number of weekly pickups.

The Amended Agreement includes a clearly defined formula for adjusting the rates for inflation in labor, fuel, vehicle, insurance, and other operating costs as well as adopted increases in the wholesale cost of disposal. If approved, the initial rates will go into effect July 1, 2022. The residential and commercial rates are proposed to be automatically adjusted on October 1, 2023, pursuant to Section 53756 of the Government Code.

Table 1 on page 2 compares the current rates for typical residential and commercial services with those proposed for July 1, 2022. The entire rate schedule and rate adjustment formula can be viewed on the City’s website at https://www.ci.lagunahills.ca.us/206/Trash-Recycling-Services. For more information regarding the State’s SB 1383 unfunded mandate please visit CalRecycle’s website at https://www.calrecycle.ca.gov/organics/slcp.

PUBLIC HEARING AND PROTEST PROCEEDINGS
Property owners, as defined under Proposition 218, may protest the proposed rate adjustment in writing prior to or during the public hearing. Consistent with the provisions of Proposition 218 and Government Code Section 53755, this notice has been mailed to all record owners of the affected properties at the addresses as they appear on the latest equalized assessment roll. If you are a property owner as defined under Proposition 218 and object to the proposed rates as described in this Notice, you may file a written protest with the City at or before the time set for the public hearing. Original written protests can be mailed or personally delivered to the City Clerk as follows:

City Clerk
City of Laguna Hills
24035 El Toro Rd.

Laguna Hills, CA 92653
A valid written protest must include:

1. The name of the record owner or owners of the property; and

2. Identification of the property by either assessor’s parcel number or street address; and

3. A statement of protest (“I/we protest” will suffice); and

4. The original signature of the protesting owner or owners (photocopies, electronic mail, electronic copies, e-comments, or facsimiles will not be accepted).

Please note that each property owner will be counted as a single vote, regardless of the number of owners. If there are two record owners, both must sign the written protest. If there are more than two owners, the protest must be signed by a majority of the owners.

Multiple protests returned for a single property will be disallowed and the City Clerk will only accept one protest per property.

The City Clerk will determine the validity of all protests submitted and exclude any invalid protests from the final tabulation. The City Clerk may confer with the City Attorney in determining the validity of written protests. As part of this process, the City Attorney may view contested or suspect protest forms. The City Clerk’s decision shall be final and binding.

If you have any questions regarding this Notice or the proposed rate adjustments, or would like even more detailed information, please call contact David Reynolds at (949) 707-2685.

Attachment: Attachment 3 - CR&R Rate Schedule Summary (2879 : CR&R Amendment No. 2) City of Laguna Hills
City Council/Planning Agency
Staff Report
DATE: June 14, 2022
TO: Mayor and Council Members
FROM: Janine Heft
Mayor Pro Tempore
ISSUE: Laguna Hills Heritage Day
RECOMMENDATION: Mayor Pro Tempore Heft recommends that the City Council establish Heritage Day as its third signature annual event for the residents of and around Laguna Hills.

SUMMARY:

Laguna Hills has had two well established signature events for many years, the Memorial Day Half Marathon/10K/5K Race and 4th of July Celebration. In addition, a number of smaller events, such as the Daddy Daughter Dance and Breakfast with Santa are beloved traditions as well.

Several of our sister cities have established wonderful celebrations to honor the history of their cities, calling them Frontier Day, Founder’s Day, or Heritage Day. Our city of Laguna Hills also has a rich heritage in Lewis F. and Nellie Gail Moulton, two amazing pioneers that more or less put South Orange County on the map. Lewis Moulton’s iconic farm home was located in Laguna Hills at the site of what is now the El Torito restaurant and of course, our beautiful equestrian community is named directly after Nellie Gail herself.

For this reason, it is time that we establish a 3rd annual signature event to honor our own incredible history while at the same time furthering the celebration of our 30th Anniversary and helping to promote the brand-new Moulton Museum that will be having its highly-anticipated grand opening on September 3.
