State Density Bonus Law
(Government Code Section 65915 etseq.)
The California State Density Bonus Law (“SDBL”), California Government Code Section 65915, encourages construction of affordable and senior housing units by allowing a developer to increase density in a residential or mixed-use housing project above the maximum allowable in a City’s General Plan and utilize incentives, concessions, or waivers or reductions in development standards in exchange for providing a certain percentage of affordable units within its project. SDBL offers three categories of benefits:
1. A project may seek an increase in residential density;
2. A project may receive incentives or concessions (generally defined as a reduction of development standards, modifications of zoning code requirements, or approval of mixed-use zoning) to offset the costs of providing affordable housing on-site; and
3. The City must waive any local development standard that would preclude construction of the project with the additional density or the incentives or concessions. The amount of the density bonus and the number of incentives or concessions depends on the amount and level of affordability of the on-site affordable units.
What types of projects are qualified to use Density Bonus Law, and what is the allowable density bonus? Residential projects with five or more unitsthat meet at least one of the following types of development and affordability:

1 “Senior Citizen Housing Development” means a residential project of at least 35 dwelling units developed, substantially rehabilitated, or substantially renovated for occupancy by senior citizens. (Cal. Civ. Code, § 51.3.) Mobile home parks for older persons may also qualify for a density bonus. 2 All units in a “Student Housing Development” must be used for undergraduate, graduate, or professional students enrolled fulltime at an accredited institution of higher education. “Student housing development” to mean a development that contains bedrooms containing 2 or more bedspaces that have a shared or private bathroom, access to a shared or private living room and laundry facilities, and access to a shared or private kitchen.
2 v. 1/16/2026
4921-9663-1945, v. 1
CONCESSIONS AND INCENTIVES, WAIVERS, AND PARKING
CONCESSIONS AND INCENTIVES
An applicant for a density bonus may request a “concession” or “incentive” of a development standard in order to facilitate the construction of the residential housing project, including the density bonus or “extra” units. A concession or incentive is a reduction in site development standards or modification of zoning code or objective design requirements that results in identifiable and actual cost reductionsto provide for the onsite affordable housing, approval of mixed-use zoning in conjunction with the housing project if commercial, office, industrial, or other land uses will reduce the cost of the housing development and are compatible with the housing project and proposed development in the area, and/or other regulatory incentives or concessions that result in identifiable and actual cost reductions to provide for affordable housing costs.
A density bonus applicant of a qualified housing development is eligible to receive the following number of incentives or concessions, based on the overall percentage of provided affordable units and the provided affordable units’ levels of affordability.
WAIVERS
Applicants may also request waivers or reductions of development standards that will physically preclude the construction of a qualifying development at the densities or with the concessions or incentives permitted under the State Density Bonus Law. Unlike concessions and incentives, which are aimed at reducing the cost of constructing affordable housing, there is no limit to the number of waivers that can be requested and awarded to remove physical constraints that would physically preclude the construction of an approved project.
DENIAL OF AN INCENTIVE, CONCESSION OR WAIVER
The City can deny the requested incentive, concession, or waiver if it finds, based upon substantial evidence, that the request would either:
• Not result in an identifiable and actual cost reduction to providing affordable units (incentive/concession only);

****Except up to 20% of units may be for moderate-income households.
3 v. 1/16/2026
4921-9663-1945, v. 1
• Have a specific, adverse, and unavoidable impact on public health and safety; • Have an adverse impact on a property that is listed in the California Register of Historical Resources; or
• Be contrary to state or federal law.
PARKING REQUIREMENTS
Another way the State Density Bonus Law incentivizes the construction of affordable and senior citizen housing units is by allowing the reduction of the minimum number of parking spaces required for Density Bonus projects.
Unit Type Parking Requirement
Studio 1 space
1 bedroom 1 space
2 bedroom 1.5 spaces
3 bedroom 1.5 spaces
4 bedroom 2.5 spaces
Bedspace in Student Housing 0 spaces
Reductions in parking space requirements differ depending on whether a project is within ½ mile of a “Major Transit Stop” (as defined below) and has unobstructed access to such a Major Transit Stop.
Development Type Parking Requirement
Rental/for sale projects with at least 11% very low income or 20% lower income units, within 1/2 mile of accessible major transit stop 0.5 spaces per unit Rental projects 100% affordable to lower income, within 1/2 mile of accessible major transit stop 0 spaces per unit
Rental senior projects 100% affordable to lower income, either with paratransit service or within 1/2-half mile of accessible bus route (operating at least eight times per day)
0 spaces per unit
Rental special needs projects 100% affordable to lower income households, either with paratransit service or within 1/2-half mile of accessible bus route (operating at least eight times per day) 0 spaces per unit
Rental supportive housing developments 100% affordable to lower income households 0 spaces per unit
Under California law (Public Resources Code § 21155), a major transit stop is generally:
• An existing rail transit station.
• A ferry terminal served by bus or rail.
• The intersection of two or more major bus routes with service every 20 minutes or less during peak commute hours.
These can be existing, under construction, or in regional transportation plans.
4 v. 1/16/2026
4921-9663-1945, v. 1
LAND DONATION
Density Bonus Law offers a sliding scale bonus for land donations, enabling market-rate housing developers to outsource the development of affordable units to local agencies or experienced developers. Applications that propose a donation of land to the City may also be entitled to an increase in density, subject to certain requirements identified Govt. Code Section 65915. The land must satisfy all of the following requirements:
• Has the appropriate general plan designation and zoning to permit construction the number of units affordable to very low-income households in an amount not less than 10% of the units in the residential development;
• At least one acre in size or of sufficient size to permit development of at least 40 units; and • Served by adequate public facilities and infrastructure.
If the proposed land donation meets the above requirements, applicants are eligible for an increase in density in addition to any density bonuses related to the inclusion of affordable units above, up to a combined maximum density of 35%. Additional density increases are dependent on the number of units reserved for very low-income households over the 10% minimum threshold, as shown in the table below:
DENSITY BONUS ALLOWANCES
The following chart shows the eligible amount of the density bonus based upon the percentage of affordable units at each income level for a project.3
3 Developments may also be eligible for additional density bonuses above the amounts shown in the table under specified circumstances if they include childcare facilities or additional very low or moderate-income units.
