CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: February 15, 2022
SUBJECT: Adoption of Resolution No. 2022-1378, Authorizing the Project List for Coronavirus
Subrirations Act o2027 CRA Funding Through the Orange mental Transportation Authority 2021 Pavement Management Relief Funding Program
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 2022-1378, authorizing the project list submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) Funding through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program.
BACKGROUND
On December 27, 2020, the federal Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) was signed into law, appropriating $10 billion for Highway Infrastructure Programs. The Orange County Transportation Authority (OCTA) was tasked with distributing nearly $11 million in CRRSAA funds to local agencies through the 2021 Pavement Management Relief Funding (PMRF) Program. The PMRF Program was established as a one-time funding program to provide funding assistance for local streets and roads maintenance and rehabilitation projects. Funds are being allocated to each City in the County of Orange based on population. The City of Laguna Niguel's share is $200,000.
Applying for the CRRSAA funds through the PMRF Program supports City Council Goal 2 (Fiscal Sustainability) and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.
ANALYSIS
CRRSAA was signed into law to help offset revenue losses from Measure M2 and SB1 funds due to the coronavirus pandemic. The PMRF Program will require no matching funds but since federal funds are involved, local agencies must follow all applicable
requirements by the California Transportation Commission (CTC), Caltrans, and the Federal Highway Administration (FHWA).
To be eligible for the funds, the City must adopt a resolution to certify a project list, which identifies all projects that will use CRRSAA funds (Attachment"A"). Staff is recommending the Marina Hills Drive (Niguel Road to Golden Lantern) Resurfacing Project be included on the City of Laguna Niguel's project list. A vicinity map is provided as Attachment "B." The $200,000 grant will help offset the cost of the Marina Hills Drive Resurfacing Project.
The design of Marina Hills Drive is currently underway and is scheduled to be completed by June 2022. Construction of the project will be proposed in the Fiscal Year 2022-23 Capital Improvement Program budget for City Council consideration.
ALTERNATIVES CONSIDERED
The City Council may decide not to adopt Resolution No. 2022-1378 and direct staff to propose another project. This alternative is not recommended because the City will miss the opportunity to receive CRRSAA grant funds. The resolution must be adopted by the City Council by February 28, 2022.
FISCAL REVIEW
If the City's application is approved, the City will receive $200,000 of CRRSAA funding to help offset the cost of resurfacing Marina Hills Drive from Niguel Road to Golden Lantern.
LEGAL REVIEW
The City Attorney's Office has reviewed the resolution and this staff report and has approved both as to form.
CONCLUSION
Staff recommends that the City Council adopt Resolution No. 2022-1378, authorizing the project list submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) Funding through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program.
