CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: March 15, 2022
SUBJECT: 2021 Housing Element Annual Progress Report

RECOMMENDATION
Staff Recommends that the City Council authorize staff to submit the 2021 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and Governor's Office of Planning and Research (OPR) by April 1, 2022.

BACKGROUND
The Laguna Niguel General Plan (LNGP) Housing Element, covering the 2013-2021 planning period, was adopted by the City Council and certified by the HCD as being in full compliance with State law in 2013. State law requires each jurisdiction to prepare and file APRs describing status and progress in implementing its housing element using forms and definitions adopted by HCD. The 2021 APR must be submitted by April 1, 2022 to HCD and OPR.

ANALYSIS
The 2021 APR consists of a spreadsheet template created by HCD (Attachment A) to capture housing activity and includes the following information:
• Annual building activity reports for new housing units (Table A and A2); • Regional Housing Needs Allocation (RHNA) progress (Table B); and • Housing Element Program implementation status including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing (Table D).

Notable development activity in Laguna Niguel, during the current reporting period, included:
• A 192 unit residential development was issued a building permit, Blue I| (12 VL units).
• Two ADU building permits were completed.

Page 2 ends

In September 2017, SB 35 was signed into law creating a streamlined ministerial approval process for eligible residential projects in jurisdictions found to have not yet made sufficient progress toward meeting their RHNA allocation in the Very Low/Low and Above Moderate income categories. In 2017, at the planning period mid-point Laguna Niguel was the only Orange County jurisdiction to meet its prorated RHNA allocation per SB 35 guidelines. The City's status relative to SB 35 will be re-evaluated after data for 2021 is reported to HCD. Table 1 below summarizes progress made during the end of the current planning period towards meeting the City's RHNA.

Current RHNA 43 30 34 75

Remaining RHNA
*Moderate income category does not count against the SB 35 requirements.

Laguna Niguel has met its Housing Element program goals and objectives for the 2013- 2021 period in regard to the SB 35 guidelines. City Staff continues to promote equal housing oportunities for all residents; attend regional planning meetings that address homelessness; and allocates CDBG funding to professional service providers working with those at-risk of becoming homeless.

ALTERNATIVES CONSIDERED
The City Council can decide not to authorize staff to submit the 2021 APR to HCD and OPC by the April 1st deadline which may result in the City being subject to the SB 35 Streamlining Act.

FISCAL REVIEW
There is no fiscal impact as a result of this action.

LEGAL REVIEW
No legal review is required for this report.

CONCLUSION
Staff Recommends that the City Council authorize staff to submit the 2021 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and Governor's Office of Planning and Research (OPR) by April 1, 2022.
