CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Director of Public Works/City Engineer DATE: May 17, 2022
SUBJECT: Adoption of Resolution No. 2022-1387, Authorizing an Application for the 2022 Environmental Cleanup, Tier 1 Grant Program
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 2022-1387, authorizing an application for funds for the 2022 Environmental Cleanup, Tier 1 Grant Program under the Orange County Local Transportation Ordinance No. 3 for the Purchase and Installation of Trash Control Devices on Stormwater Catch Basins 2022 Project.
BACKGROUND
On March 14, 2022, the Orange County Transportation Authority (OCTA) Board of Directors authorized the 2022 call for projects for the Measure M2 Environmental Cleanup Program (ECP), Tier 1 Grant Program, also referred to as Project X (Grant). This funding program is designed to mitigate the more visible forms of pollutants, such as litter and debris, which are collected on roadways and in the storm drain catch basins prior to being deposited in waterways and the ocean.
To comply with water quality standards, the installation of trash screens on catch basins throughout the City is required for compliance with the State's trash regulation policy and this Grant will pay a substantial portion of the cost. Connector Pipe Screen (CPS) units located inside catch basins are recommended as they prevent smaller-size trash (5 mm in size and greater) from entering the storm drain system and are considered full capture devices as defined by the State Water Resources Control Board. These units effectively remove a substantial amount of trash from entering the storm drain system.
The City's proposed project for the Grant includes the installation of CPS units on catch basins at key locations throughout the City, which are shown in Attachment "A".
Submitting the grant application supports City Council Goal 2 (Fiscal Sustainability), Goal 3 (Open Space and Environmental Preservation), and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.
ANALYSIS
Currently, there are approximately 322 catch basins throughout the City where CPS units have been installed. This grant continues the trash screen installation program to meet state requirements. Under this proposed project, CPS units would be installed in approximately 196 additional catch basins.
To apply for funding under this Grant, a local cash match of at least 20% of the total project cost is required by the Orange County Comprehensive Transportation Funding Programs Guidelines. The application process requires that the City adopt a resolution supporting the proposed improvements (Attachment "B").
This project entails minor alterations to existing catch basins to capture trash and debris that would otherwise be discharged into downstream receiving waterways and beaches.
This project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines - California Code of Regulations, Chapter 3 (Guidelines for Implementation of CEQA), Article 19 (Categorical Exemptions), Section 15301 (Existing Facilities), Subsection (C).
ALTERNATIVES CONSIDERED
The City Council could direct staff to defer the application to a future date. This alternative is not recommended as the installation of trash screens is part of the City's implementation plan for compliance with the State's trash regulation policy.
FISCAL REVIEW
The Grant requires a minimum 20% local match. The proposed grant request including the estimated local match is as follows:
Estimated Estimated
Grant
Project Project
Request Local Match
Cost
Purchase and Installation of Trash
Control Devices on Stormwater Catch $245,000 $196,000 $49,000 Basins 2022 Project
If the City is awarded the grant, there are sufficient funds in the Capital Improvement budget to meet the City match requirements.
