CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: June 21, 2022
SUBJECT: Orange County Transportation Authority OC Go (Measure M2) Eligibility Package Submittal
RECOMMENDATION
Staff recommends that the City Council:
1. Adopt Resolution No. 2022-1394, adopting a Seven-Year Capital Improvement Program for Fiscal Years 2022-23 through 2028-29 for compliance with the Measure M2 eligibility requirements;
2. Adopt Resolution No. 2022-1395, concerning the status and update of the Pavement Management Plan for the City of Laguna Niguel; and,
3. Direct staff to submit the City's OC Go (Measure M2) Eligibility Package to the Orange County Transportation Authority prior to June 30, 2022.
BACKGROUND
In November 2006, Orange County voters approved Measure M2, also known as OC Go, which authorized the 30-year continuation of a one-half percent retail transaction and use tax to fund needed transportation improvements. In order to receive OC Go funds from the Orange County Transportation Authority (OCTA), local jurisdictions must comply with the eligibility criteria. If the City is found to be non-compliant, then the City risks the possibility of losing funds from the Comprehensive Transportation Funding Programs (CTFP) and annual OC Go Local Fair Share formula funds (Measure M2 turnback funds).
The CTFP provides competitive grant funding for various improvements such as street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects. The City receives approximately $1.3 million in Measure M2 turnback funds annually, the amount varies each year depending on sales tax revenue.
Local jurisdictions are required to adopt some or all the following prior to July 1 of each year in order to continue to be eligible for funding:
Seven-Year Capital Improvement Program - Annually;
Maintenance of Effort Certification - Annually;
3. An Eligibility Checklist - Annually;
4. A resolution confirming that the City is in compliance with the Master Plan of Arterial Highways and Mitigation Fee Program - Biennially; A Congestion Management Plan Compliance Checklist - Biennially;
6. An Updated Pavement Management Plan - Biennially; and,
7. An Updated Local Signal Synchronization Plan - Every three years As part of this year's submittal package to OCTA, the City is required to submit documentation for items 1, 2, 3, and 6 listed above. Items 4, 5, and 7 will be required for submittal in June 2023. Maintaining OC Go eligibility supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.
ANALYSIS
Seven-Year Capital Improvement Program
The City is required to prepare a Seven-Year Capital Improvement Program (CIP) to be eligible for OC Go funding. This CIP includes all transportation-related projects and programs funded with competitive OC Go funds but can also include other projects. The purpose of the CIP is to identify intended or potential use of OC Go revenues (fair share and/or grant funds). For each project listed in the CIP, projected funding amounts for design, right-of-way, and construction costs are included, where applicable. Some of the projects included in the CIP are Marina Hills Drive Resurfacing Project, Pacific Island Drive Drainage and Wall Improvements Project, Residential Overlay Program, and the Residential Annual Resurfacing Program Zones III and IV.
Staff is recommending adoption of Resolution No. 2022-1394, which identifies transportation-related projects and programs (Attachment "A").
Maintenance of Effort Certification
The purpose of the Maintenance of Effort (MOE) certification is to document and demonstrate that cities continue to spend at least the same amount of General Fund money for the maintenance of local roads and transportation-related streets projects as they did prior to the passage of OC Go. The original MOE benchmark figure was based upon a historic five-year average of General Fund expenditures from Fiscal Year 1985- 86 to Fiscal Year 1989-90. The benchmark figure is adjusted once every three years
(beginning in 2014) based upon the lesser of the Caltrans Construction Cost Index or general revenue growth for the City over the prior three-year period.
In April 2017, the OCTA Board of Directors approved a benchmark figure of $908,566 for the City of Laguna Niguel. In 2020, due to the financial impacts related to the COVID-19 pandemic, the OCTA Board of Directors allowed all eligible agencies to use either the 2017 benchmark or a percentage of the General Fund revenue. The City of Laguna Niguel opted to use the 2017 benchmark in 2020. A new benchmark figure will be approved by the OCTA Board of Directors in 2023.
Each June, the City must certify that it will meet its MOE in the upcoming fiscal year.
OCTA requests excerpts of the City's budget showing how the MOE benchmark will be met.
The Fiscal Year 2022-23 Public Works Operating and Capital Improvement Program budgets include the following eligible General Fund expenditures:
Median Island Maintenance $ 431,550
Street Lighting $ 650,000
Street Sweeping $ 273,000
Fiscal Year 2022-23 Total $ 1,354,550
Based on the above budget amounts, the City can certify that it will meet its MOE benchmark requirements as the budget exceeds the MOE benchmark requirement of $908,566 (Attachment 'B").
Pavement Management Plan (PMP) Update
The City is responsible for the maintenance and repair of approximately 141.5 centerline miles of pavement which includes 37.4 miles of Master Plan of Arterial Highways (MPAH) and 104.1 miles of local streets. In order to maintain City streets in good condition, the denies descenares and remends progent a improvet Pre Pavement Contin Index (PCI) of City streets, with a goal to bring the citywide PCI up to 80 or greater. The Pavement Management Program was presented to the City Council on May 11, 2021 and adopted as part of the Fiscal Year 2021-22 Operating and Capital Budget on June 1, 2021. The Pavement Management Program supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan. Benefits of the Pavement Management Program include:
• Improving the citywide PCI year over year
• Satisfying MOE reporting requirements
• Saving money because it costs less to maintain streets in good condition than to repair those that have failed
• Meeting needs of the community
For its PCI reporting, the City uses PAVER pavement management software and collects pavement distresses in compliance with ASTM D6433-11 and as outlined by the OCTA Countywide Pavement Management Plan Guidelines.
Every two years, the City must update a certified Pavement Management Plan (PMP) that conforms to the criteria established by OCTA including some of the following elements:
• Current status of road pavement conditions
• A seven-year plan for road maintenance and rehabilitation • Projected pavement conditions resulting from proposed improvements • Alternate strategies and estimated costs for future pavement construction projects A summary of the elements above are included in the PMP Final Report. The current citywide PCI is 78. OCTA requires the City to have its PMP updated on a biennial basis so that the City can qualify for the allocation of revenues generated by OC Go. Staff is recommending adoption of Resolution No. 2022-1395 to adopt the PMP (Attachment"C").
A copy of the PMP is available in the City Clerk's Office for review.
ALTERNATIVES CONSIDERED
The City Council may decide not to submit the annual eligibility package. This alternative is not recommended as this alternative would make the City ineligible for local fair share and grant funding opportunities.
FISCAL REVIEW
The Seven-Year CIP lists several transportation improvement projects. For each improvement project, the primary funding sources are listed.
LEGAL REVIEW
The City Attorney's Office has reviewed the resolutions and has approved the resolutions and this report as to form.
CONCLUSION
Staff recommends that the City Council:
1. Adopt Resolution No. 2022-1394, adopting a Seven-Year Capital Improvement Program for Fiscal Years 2022-23 through 2028-29 for compliance with the Measure M2 eligibility requirements;
