1. Appointment of Assistant City Attorney Nicholas Ghirelli of Richard, Watson, and Gershon (RWG) as the Interim City Attorney.

BACKGROUND
The City Attorney is the City's chief legal officer and is responsible to the City Council for the proper administration and coordination of all City legal affairs. The City of Laguna Niguel has contracted City Attorney services since incorporation. Utilizing contracted professional legal services provides the City with access to a latitude of areas of expertise to best serve the City. On January 15, 2019, the City Council formally approved a Legal Services Agreement with Richards, Watson & Gershon (RWG).
ANALYSIS
Due to the recent resignation of the City Attorney, the Council has directed that Assistant City Attorney Nicholas Ghirelli from Richards Watson & Gershon (RWG) be appointed as the Interim City Attorney. This will ensure the City has the necessary legal expertise and continuity of legal services.
At the direction of the City Council, staff has prepared a Request for Proposals (RFP) for a permanent City Attorney. (Attachment A). Upon approval by the City Council the RFP would be issued on August 3rd and it is anticipated that the appointment of a permanent City Attorney will be on the agenda for the October 4th City Council meeting.
FISCAL REVIEW
There is no fiscal impact from issuance of the Request for Proposals. For any resulting legal service agreements, the fiscal impact will be analyzed and reported prior to execution. The adopted fiscal year 2022-2023 budget is sufficient to cover all anticipated costs.
CONCLUSION
With direction provided by the City Council, the recommendation is to affirm the following:
1. Appointment of Assistant City Attorney Nicholas Ghirelli of Richard, Watson, and Gershon (RWG) as the Interim City Attorney.
2. Authorization for the City Manager to immediately release a Request for Proposals (RFP) for a permanent City Attorney.
