CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: August 16, 2022
SUBJECT: Approval of Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Psomas for the Crown Valley Parkway Westbound Widening I-5 to Oso Creek Project
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Psomas to provide engineering design services for the Crown Valley Parkway Westbound Widening I-5 to Oso Creek Project for a total not-to-exceed amount of $599,700;
2. Approve a not-to-exceed 10% contingency of the total contract in the amount of $59,970 for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work for a total not-to-exceed amount of $659,670, if needed; and,
3. Authorize the City Manager to execute Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Psomas subject to the City Attorney making non-substantive changes.
BACKGROUND
The Gateway Area is located in the northeastern corner of the City, bounded by the Interstate 5 (I-5) Freeway to the east, the San Joaquin Hills Transportation Corridor (SR- 73) and Cabot Road to the west, and the City limits to the north and south. The Gateway Area has a linear configuration, with circulation that is defined by geographic features such as Oso Creek, the BNSF rail line, a major electrical transmission corridor, and steep topography. On November 15, 2011, the City Council adopted a comprehensive update to the Laguna Niguel Gateway Specific Plan that included widening existing streets and intersections to effectively manage traffic flow and enhance pedestrian and bicycle mobility in the area.
Widening existing streets and intersections in the Gateway Area started approximately ten years ago with the widening project for eastbound Crown Valley Parkway from Cabot Road to I-5. The next phase of widening includes the addition of a fourth westbound lane on Crown Valley Parkway from the I-5 southbound off-ramp to the Oso Creek Bridge completing the westbound segment to Cabot Road. A vicinity map for the project is provided in Attachment "A".
This project will provide for final construction and bidding documents for widening the Oso Creek Bridge and the overhead bridge spanning the railroad, intersection improvements at Forbes Road, median and parkway landscaping improvements, street furniture, lighting, and signage.
The engineering design phase for the required widening was substantially completed then put on hold in 2020 due to the pandemic and the sudden halt of most development activities in the Gateway Area. Development activities in the Gateway Area have now resumed and grant opportunities for this project are becoming available in the Fall 2023 through the Orange County Transportation Authority (OCTA) Measure M2 program. To qualify for grant funding, the City will have construction phasing documents prepared and obtain permits from the County of Orange, CA Fish and Wildlife, Southern California Regional Rail Authority (SCRRA), and Caltrans.
Future work related to continued residential development within the Gateway Area includes creating a citywide storm drain master plan and constructing improvements at the Cabot Road/Crown Valley Parkway intersection. A location map showing the Crown Valley Parkway Westbound Widening I-5 to Oso Creek Project is provided in Attachment "B".
Completion of the project supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.
ANALYSIS
On May 5, 2022, the Public Works Department issued a Request for Proposals (RFP) to provide engineering, design and right of way acquisition services for completion of the project (Attachment "C"). In response to the RFP, the City received two proposals. The proposals were independently evaluated, and scores were averaged to determine the highest-ranked firm. Each proposal was evaluated based on qualifications of key personnel, project approach, relevant experience, and cost. The RFP evaluation sheets can be found in Attachment "D".
Proposed Contingency Total Contract
Rank Consultant
Contract (10%) Amount
1 Psomas $599,700 $59,970 $659,670
Michael Baker $59,298
2 $592,982 $652,280
International
Psomas was selected for their highly qualified staff, methodology, and extensive experience providing development engineering, plan checking, and program management services. Psomas has experience working on earlier phases of street widening in the Gateway Area and provided unique and forward thinking recommendations for value engineering that may result in construction cost savings and ultimately reduce the overall final cost of the project.
The proposed Amendment No. 5 with Psomas proposes final stage design scope of work items primarily related to storm water regulatory and environmental permitting changes, combining the project into one phase and additional permit and plan processing time related to these changes.
Staff recommends approving Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Psomas to provide engineering design services for the Crown Valley Parkway Westbound Widening I-5 to Oso Creek Project for a total not-to-exceed amount of $599,700 (Attachment "E"). Staff also recommends approving a not-to-exceed 10% contingency of the total contract in the amount of $59,970 for a total not-to-exceed amount of $659,670. The contingency will cover unforeseen conditions that may arise if additional design work is needed.
If approved by City Council, design services will start in August 2022 and will be completed by July 2023. Construction for the project will likely be awarded using the formal bidding process and selecting the lowest responsible bidder.
ALTERNATIVES CONSIDERED
1. The City Council may decide not to approve Amendment No. 5 to the Professional Services Agreement with Psomas and direct staff to reissue an RFP. Staff believes that issuing the RFP will not result in more desirable proposals.
2. The City Council may decide not to approve Amendment No. 5 to the Professional Services Agreement with Psomas and not issue a new RFP. This alternative is not recommended as the project would not be able to move forward to construction and the roadway will remain in its current condition.
FISCAL REVIEW
Adequate funds have been allocated in the FY 2021-22 Capital Improvement Program and will be carried over to the FY 2022-23 Capital Improvement Program to fund the cost of Amendment No. 5 to the Professional Services Agreement with Psomas.
LEGAL REVIEW
The City Attorney's Office has reviewed Amendment No. 5 and this staff report and has approved both documents as to form.
CONCLUSION
Staff recommends that the City Council:
1. Approve Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Psomas to provide engineering design services for the Crown Valley Parkway Westbound Widening 1-5 to Oso Creek Project for a total not-to-exceed amount of $599,700;

Subject: Crown Valley Parkway Westbound Widening Final Design Services Dear Mr. Martin:
Psomas is pleased to submit this proposal to provide final design services for the Crown Valley Parkway Westbound Widening project.
In our proposal, you will see that Psomas has offered a pool of resources with broad knowledge of this significant widening project, which is essential in bringing this design to its successful completion. Our Project Manager, Carrie Davis, has more experience on this project than any other design consultant as evidenced by Exhibit 1 on page 22. Carrie began work on this corridor in approximately 2010, when she was the Design Manager for the eastbound widening from Cabot Road to the Interstate 5 (I-5) northbound entrance loop ramp. Her work on the westbound widening project began in 2011 with the preliminary design, which was used to secure OCTA grant funding. In 2016, Carrie began the final design of this project, until it went on hold due to complexities related to right-of-way acquisition.
The Psomas Team is comprised of many talented professionals who will step into the design and take it across the finish line. We are confident we can provide the right combination of experienced leadership and specific capabilities needed for this project. Psomas is excited to continue our relationship with the City and to complete this project.
As Vice President, Arief Naftali, PE, TE, EE, ENV SP, RSP1, is authorized to execute legal documents on behalf of Psomas. Carrie Davis, PE, will serve as Contract/Project Manager and will be the single point of contact for this contract. The cost proposal will remain valid for a period of at least 90 days from the date of submittal. Please do not hesitate to contact me at 714.481.8014, or by email at [email protected], should you have any questions regarding our proposal.

PROJECT APPROACH
Project Understanding and Approach
The Psomas team understands that the final PS&E for Phases 1 and 2 of the Crown Valley Parkway Westbound Widening Project (Project) are approximately 95% complete. The City is looking tor qualified firms to take ownership of the design and coordination completed to date and to obtain final approved plans, agreements, licenses, and encroachment permits, and right-of-way acquisition.
Prior to joining Psomas, the Psomas team's Project Manager, Carrie Davis, was the Project Manager for the preliminary and final design phases of this Project. The preliminary design that was completed in 2012 was the foundation for the Project as well as for the off-site improvements to Crown Valley Parkway and Cabot Road that were conditions of approval of the Apex and blu Apartment developments. In fact, Carrie has been working for and with the City for over 15 years and has spent most of that time working on projects throughout the Gateway Specific Plan area.
Carrie's knowledge of the Project details and their interconnection with surrounding improvements, and with the City's requirements and processes, make Psomas the right choice to complete this project for the City. As demonstrated by Exhibit 1 on the following page, there is no other Project Manager that has more recent relevant experience with the Crown Valley Parkway Westbound Widening Project than her.
Beginning in April 2016, Carrie worked directly with the City on the final design of the Project to:
• Develop the widening and pavement rehabilitation strategies • Set the new raised median at the Cabot Road intersection in a location that would accommodate the City's future plan to widen Crown Valley between Cabot Road and Greenfield Drive through highly constrained right-of-way • Engage with stakeholder agencies (Metrolink, OCTA, OCPW, and Caltrans) to inform them of the Project and establish protocols for their reviews and ultimate approvals, encroachment permits, and licenses
• Ascertain right-of-way requirements and utility conflicts Once the Project was in the design phase, Carrie was deeply involved with the echnical details of the design from developing curb lines to establishing retainin rall layouts and processing design deviations for nonstandard freeboard depth within Oso Creek Channel. Her involvement with the Project ended in January 2021, only one month before the plans that are included with the RFP were printed. With all of this background knowledge, the City can trust that the Psomas team, under Carrie's leadership, can step into the design that has been completed to date to take it across the finish line.
Our approach to successful project delivery will be for each design discipline to conduct a complete and thorough review of the design as it currently stands so that Psomas can take ownership. This will rely on the City providing project specific details such as cadd files, design reports, utility coordination documents, and response to comments matrices to name a few. For the roadway civil portions of the project, this can be done expeditiously because of Carrie's knowledge of the design completed to date. Other disciplines including structures, drainage, and traffic will PSOMAS 22

require a more detailed review, however Carrie was involved with these disciplines as well in her role as Project Manager. Each of these disciplines have reviewed the documents provided with the RFP and are confident that this review can be completed efficiently to their satisfaction allowing them to take ownership of the design.
In the Fall of 2020, the City asked for a "Punch List" of work elements remaining to be completed on the project. Based on history on the Project and the detailed review of the documents included with the RFP, some of the larger elements on this Punch List that still need to be completed include the following:
• Utility Coordination - The project impacts several existing utilities that require final coordination. Monument, as a sub consultant to Psomas, will complete the necessary utility coordination including:
• Moulton Niguel Water District (MNWD), AT&T, and Cox
Communications have several facilities being impacted, most significantly those that are strapped to the outside of the Oso Creek Bridge. Each of these will be relocated to be within the new sidewalk barrier of the widened bridge. Close coordination will be needed between the utility companies and the City's contractor to minimize disruption to service during construction. Specific language will be added to the technical specifications to make sure the contractor Existing utilities along the outside of the Oso Creek
Bridge require removal or relocatation provides the necessary working space and work windows to the utility owners' contractors.
Existing 10" Southern California Gas (SCG) has a 10" high pressure gas line on the HP Gas
north side of Crown Valley that may be impacted with the roadway widening just west of the Oso Creek bridge. The line is inside the most northerly cell of the existing bridge so it will not conflict with the bridge widening. However, the sawcut for the road widening west of the bridge is to the south of the gas line and therefor may be in conflict.
Saw Cut During early coordination with SCG, they agreed to pothole their line to determine if there is a conflict. Because the project went on hold, SCG "CVP" LINE
has not conducted this pothole. This proposal includes potholing this 10" HP Gas Line may be in conflict with the roadway
widening west of Oso Creek Bridge line.
• San Diego Gas and Electric (SDG&E) has significant facilities that are impacted by the project. In speaking with them during the preparation of this proposal, it appears that they are aware of some of these conflicts but not all. Several large above ground and below ground structures along the east side of Forbes Road and the north side of Crown Valley need to be relocated. The wiring within the conduit bank on the outside of the Oso Creek Bridge needs to be relocated to the south side of the bridge and the conduits abandoned. It is assumed that the overhead lines running perpendicular to Crown Valley will not provide the necessary vertical clearance to equipment during construction of the bridge widening over the railroad and Camino Capistrano. SDG&E was not aware of this however this was the same condition during construction of the bridge widening on the south side.
SDG&E facilities along the east side of Forbes Road
With that project, the lines were de-energized and removed during construction and replaced once construction was complete. This was made possible because of a redundancy in the system so no outages occurred. It is unknown at this time if this redundancy still exists.
PS OMAS 24
• Water Quality Management Plan (WQMP) and Treatment Best Management Practices (BMPs) - Analysis and design of water quality elements of the project have not been initiated. Because of the constrained right-of-way width, there are not a lot of options in terms of treatment BMPs. However, the Oso Creek Trail was designed to capture storm flows from Crown Valley through the inlet on the southeast corner of Forbes Road and Cape Drive. Runoff would then drain water through the bio-retention swale located between the roadway and the trail on Forbes Road. The treatment system was designed based on the future widening proposed with this Project. Psomas will conduct an analysis of this system to determine if additional treatment is required. • Hydromodification - The original concept included an underground detention basin just west of the bridge over the railroad to collect surface runoff and then to meter the outflow to maintain existing runoff volumes. Psomas will prepare an analysis to determine feasibility of this approach. • Storm Water Pollution Prevention Plan (SWPPP) - The SWPPP has not been initiated. Psomas will prepare the SWPPP by a Qualified SWPPP Developer/ Practitioner (QSD/P) based on the Project's Risk Level following the required documentation filing criteria.
• Orange County Public Works (OCPW) Encroachment Permit - An encroachment permit is needed from OCPW to construct the Oso Creek Bridge Widening. It is understood that the Basis of Design Report included with the RFP documents, which documents the effects the Project has on the channel, has been approved by the County. Further the design deviation for the nonstandard freeboard has also been accepted by the County. The legal description needed for the roadway easement was prepared but was not processed with the County.
OCPW Stream Gauge to be relocated or removed
Additional coordination items with the County include appraisal and acquisition of the roadway easement, relocation/removal of a stream gauge on the west bank of Oso Creek, and relocation/removal of the OCPW owned antenna located within the DG area of the Oso Creek Trail. It is assumed that the maintenance agreement between the City an OCPW for the Oso Creek Trail will not require amending based on improvements from this project.
• California Department of Fish and Wildlife Services Permit - A permit is required due to impacts during construction. The new bridge OCPW Antenna to be relocated or removed abutments for the Oso Creek Bridge require removal of the concrete channel lining to construct. Once complete, the channel lining will be reconstructed to the existing conditions. A similar permit was required when the same bridge was widened for the eastbound improvements previously discussed.
• Metrolink/Southern California Regional Rail Authority (SCRRA)/Orange County Transportation Authority/OCTA)/California Public Utilities Commission (CPUC) Approvals - Widening the Crown Valley Overhead (OH bridge requires approvals from each of these agencies
• Metrolink/SCRRA has several requirements for final approval. They have reviewed the conceptual and preliminary design packages, so the next step is to submit the final plans for their approval and preparation of the Construction and Maintenance (C&M) Agreement. It is anticipated that plan approval will require 2-3 submittals because the project has been on PS OMAS 25
hold for some time and there have been staff changes at Metrolink. The C&M Agreement can take 6-9 months to obtain final approvals, so this will be initiated as soon as possible. It is assumed that the Design Service Agreement (DSA) will need to be updated and Metrolink may require the City pay additional fees. The deposit initially paid by the City included $50,000 for the design and construction of the train signal bridge that would be impacted with the OH bridge widening. It is assumed that the design work by Metrolink has not been initiated. There is an existing utility within the railroad right-of-way that may conflict with the project. One pothole is included in the proposal to locate this facility. A Form 6 Right of Entry Permit needs to be approved by Metrolink to allow potholing within their right-of-way.
• An OCTA license agreement with the City needs to be executed based on the final approved plans and Metrolink C&M Agreement. This can take up to 4 months and must be in place prior to advertising the Project for construction.
The CPUC requires a General Order 88B application, which will be completed after the OCTA license agreement is in place.
• Caltrans District 12 Encroachment Permit - Improvements to tie in the added westbound travel lane at the I-5 southbound off-ramp, traffic signal modification at the ramp intersection, pavement rehabilitation, and temporary traffic control devices all fall within Caltrans right-of-way on the east end of the Project. Therefore, an Encroachment Permit is required from District 12.
• Right-of-Way Engineering, Appraisals, and Acquisitions - Psomas will prepare the remaining legal descriptions and Monument will complete the appraisals and acquisitions for each of the properties impacted by the Project.
This includes four separate property owners over five parcels including:

• Updates and Completion of Plans, Specifications, and Estimates - As described in the RFP, significant work has been accomplished to bring the project to its current stage. There are several areas that must be either initiated or completed including the following:
PSOMAS 26
• Phase 1 from Cabot Drive to Forbes Road and Phase 2 from Forbs Road to the I-5 southbound off-ramp need to be combined into one bid package. Each of the PS&E documents will be reviewed and revised accordingly. • A thorough review of the design completed to date must be done so that Psomas can take ownership of the PS&E. This will include detailed review of roadway, drainage, traffic, and structural plans and calculations. To do this effectively, Psomas will request all cadd files including Civil 3D design files, reports and calculations, and review and response to agency comments. Understanding that this will be an added expense to the City, we will conduct this review with a goal of retaining most, if not all, of the design provided to us. We are committed to conducting this review as expeditiously as possible, with an eye out for design elements that may save the City money on the construction.
• Drainage plans must be updated to include design of water quality elements as a result of the WOMP and the hydromodification requirements.
Erosion Control Plans will be prepared to support the SWPPP.
Stage Construction and Traffic Control Plans need to be initiated. Traffic Control Plans are assumed to only be required to support the Caltrans encroachment permit. The contractor can develop their own Traffic Control Plans per the WATCH Manual for the remainder of the improvements. • Landscaping and Irrigation plans have not been initiated. It is assumed that the small area between the northerly curb and the northerly right-of-way on Crown Valley east of the gas station and the portion of the new 24 foot- wide median on Crown Valley not on the OH structure are the only areas that will be landscaped.
Psomas recognizes the significant investment that the City has made towards this project to date. We are very sympathetic to the need to be good stewards of public funds and to developing improvements that are compatible with the needs of the end users and surrounding communities. In this vein, we propose a revision to the planned improvements along the westerly side of Forbes Road north of Crown Valley that would reduce construction costs.
The original design for the Oso Creek Multi-use Trail north of Crown Valley included a 12-foot wide AC path and a 10-foot wide DG path. Several large utilities would have So that one delicated rigm urine the emain, his win eliminate congrection on the west side of Forbes Road altogether, thereby reducing construction cost by approximately $150,000-$200,000 and reducing driver inconvenience during construction.

Task 8 Department of Fish and Wildlife Services Permit
Psomas assumes that the proposed work will not involve construction in U.S. Army Corps of Engineers or in Regional Water Quality Control Board jurisdictions and permitting and coordination with these agencies is excluded from this scope of work.
Biological Surveys are assumed not required.
Psomas will perform a field jurisdictional delineation to determine the extent of CDFW jurisdiction in the Project's impact area. CDEW jurisdiction typically spans from top of one bank to the top of the opposite bank. If riparian vegetation is present then CDFW's jurisdiction extends to the outer most dripline of the riparian vegetation.
Prior to conducting the field visit, Psomas will review databases, such as the National Wetlands Inventory and the California Natural Diversity Database. Following the desktop analysis, a Psomas regulatory specialist will survey the project alignment to confirm the results of the analysis and record existing biological resources along the alignment.
Upon completion of the field delineation, Psomas will prepare a Jurisdiction Report.
The Report will provide the jurisdictional information necessary to support the Section 1602 Streambed Alteration Agreement. This scope assumes preparation of one draft report to be submitted to the City for review and preparation of one final version of the report that will incorporate City comments on the draft version.
A CDFW Section 1602 Agreement application for Streambed Alteration (also known as a Streambed Alteration Agreement) will be prepared and submitted to the CDFW following review and approval of the application by the City. The submittal package will include: (1) EPIMS template; (2) vicinity map; (3) project description; (4) jurisdictional delineation map; and (5) site photos. This task does not include the permit filing fee, and it is assumed the City will pay all permit fees. The CDEW permit application fee is based on the construction cost of each project component that impacts CDEW jurisdiction.
Regulatory services include working closely with CDFW to facilitate issuance of the 1602 Streambed Alteration Agreement. This will include necessary activities to process the final permit which may include preparation of correspondence; telephone calls with agency staff; and/or in-person meetings. The budget associated with this task is based on approximately 24 hours of staff time. Because it is difficult to predict the level of effort to assist regulatory agency staff for permit issuance, Psomas may submit a budget amendment request if the estimated number of hours proves insufficient.
Deliverables:
• CDFW Permit

PSOMAS 39
Assumptions and Exclusions
General:
• This scope of work and fee assume that the City will provide all design files for work products completed to date. At a minimum, this includes all cadd files, design Civil 3D files, design reports, survey files, right-of-way mapping files, and potholing reports. If relevant files and/or documents are not provided, Psomas can recreate the designs, however this will require a contract amendment for addition budget.
Psomas will conduct a complete review of the design as provided with the documents included with the RFP and the previous bullet. Substantial deviations are not anticipated. If substantial changes are required, Psomas will discuss these with the City to determine if they should be implemented and if a contract amendment is required. The design revision associated with the changes to the westerly curb on Forbes Road are not included with this proposal.
• Temporary Traffic Signal plans are assumed not required and are excluded. • Design Exceptions and the development of Caltrans' Design Standard Decision Document is assumed not required and is excluded.
• Plans will be subjected to review and approval by the City, OCPW, Metrolink, and Caltrans District 12 where applicable. No submittals to any other stakeholder agency are included.
• Temporary traffic control plans within City jurisdiction will be prepared by the contractor.
• Temporary street/trail lighting plans are assumed not required and are excluded.
• Signal timing development, or synchronization plan is assumed not required and is excluded.
• The fees established with this scope of work are based on a 10-month design duration.
• The Landscape and Irrigation Plans will closely adhere to the those included with the Oso Creek Trail project. Substantial deviations will require additional budget.
• No electronic submittal of the cadd drawing files will be required. • Psomas will update construction unit costs before bid phase. • All permit and review fees will be provided by the City.
Structures:
• The design check for the bridge widening will only include design calculations since the design and independent check calculations were previously conducted.
• The project configuration, bridge widths, span lengths, etc. will remain as described in the current plans.
PS OMAS 40
• No Type Selection or APS is required.
• The item cost estimates were completed and independently verified, therefore Psomas will not modify them based upon revisions included with this contract.
Water Quality, Hydromodification and Drainage Improvements:
• Water quality treatment is assumed to be satisfied by the capturing storm runoff on westbound Crown Valley from the I-5 southbound off-ramp to the existing catch basin on the southeast corner of Forbes Road and Cape Drive, which drains into the existing bio-retention swale. No additional water quality design elements will be required.
• Hydromodification is assumed to be satisfied by constructing an underground storage facility under the westbound travel lanes on Crown Valley. It is assumed that this storage facility will outlet to an existing storm drain west of Forbes Road.
• Improvements to the drainage plans are assumed to be required only for water quality and hydromodification purposes. Drainage improvements shown on the current plans are assumed to remain as currently designed.
Right-of-Way and Utilities:
• Right-of-way acquisition is required from four (4) property owners over five (5) parcels, including APNs 636-034-06, 636-034-07, 636-034-08, 636-043-08, and 636-033-04. Partial fee acquisition and temporary construction easements are needed from APNs 636-034-06, 636-034-07, 636-034-08, and 636-043-08. A roadway easement is required for APNs 636-043-08 and 636-033-04. • All properties are considered partial acquisitions and will not result in the displacement of any business or reconfiguration of the existing site. • The Chevron station operates a full-service carwash and convenient store on a very constrained location. Mitigating potential impacts to the price sign, driveways, carwash entrance and on-site circulation will be imperative to maintain operation of the station and lesson the City's risk to a loss of business goodwill claim.
• It is assumed that the Legal Description and Plat that was prepared by Michael Baker for the OCFCD property is still valid and a new one isn't required. • Scope and fee for utility coordination is based on conflicts shown on the plans included with the REP. Conflicts are anticipated with AT&T - Distribution, Cox Communications, Moulton Niguel Water District, SDG&E, Southern California Gas - Distribution, and Southern California Gas - Transmission. Psomas can perform additional coordination upon a contract amendment if additional conflicts are identified requiring additional budget for coordination. • Utility relocation design is explicitly excluded. Utility companies having facilities that conflict with the proposed improvements will prepare relocation plans with their own forces. In addition, it has been assumed that the utility companies will be responsible for permit procurement for any interim utility relocations requiring temporary easements.
