CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: September 20, 2022
SUBJECT: Approval of Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering for the Marina Hills Park Improvements Project

RECOMMENDATION
Staff recommends that the City Council:

1. Approve Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering to provide engineering services for the Marina Hills Park Improvements Project for a total not- to-exceed amount of $90,724;

2. Approve a not-to-exceed 10% contingency of the total contract in the amount of $9,073 for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work for a total not-to-exceed amount of $99,797 if needed; and,

3. Authorize the City Manager to execute Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering, subject to the City Attorney making non-substantive changes.

BACKGROUND
Marina Hills Park has served the residents of Laguna Niguel since 1994. Park amenities include a baseball field, one full basketball court, one half basketball court, three bocce ball courts, a playground, two soccer fields, and site furnishings (benches, shade structures, etc.).

In May 2022, the Citywide Park Needs Assessment was completed. One of the recommendations included improvements to Marina Hills Park, consisting of the conversion of a half basketball court to a full basketball court, additional walkways to improve pedestrian access from on-street parking to the playground, new landscaping

Page 2 ends

and irrigation, and improved site furnishings (new wayfinding signage, benches, trash receptacles and shade structures).

Design plans and specifications are now required to implement the recommendations from the Citywide Park Needs Assessment. A vicinity map for the project is provided in Attachment "A". Completion of the proposed park improvement project supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.

ANALYSIS
On June 17, 2022, the Public Works Department issued a Request for Proposals (RFP) to provide design engineering, plans and specifications preparation, bid assistance, and construction support services (Attachment "B") to seven consultants from the On-Call Professional Engineering Services List. In response to the RFP, the City received three proposals.

Rank Consultant Proposal Amount
1 Willdan Engineering (Recommended) $90,724
2 David Volz Design $86,572
3 NUVIS $183,076
The proposals were independently evaluated, and scores were averaged to determine the highest-rated firm. Each proposal was evaluated based on qualifications of key personnel, project approach, experience, and cost. The RFP Evaluation Summary can be found in Attachment "C". Copies of the proposals are on file with the City Clerk's Office.

After completing the RFP evaluation process, and based on all relevant factors, Willdan Engineering's proposal represents the best overall value to the City for the requested services. Willdan Engineering was selected for its highly qualified staff, methodology, extensive experience providing similar services, and cost. Willdan's proposal included necessary structural evaluation to complete the design as requested. The second ranked proposal from David Volz Design did not include structural evaluation. Had David Volz Design's proposal included structural evaluation, their proposed fees would have been substantially increased
Staff recommends approving Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering to provide professional engineering services for the Marina Hills Park Improvements Project for a total not-to-exceed of $90,724 (Attachment "D"). Staff also recommends approving a not- to-exceed 10% contingency of the total contract in the amount of $9,073 for a total not- to-exceed amount of $99,797. The contingency will cover unforeseen conditions that may arise if additional design work is needed.

Page 3 ends

If approved by the City Council, design services will start in October 2022 and the construction plans and specifications completed in Spring 2023. The construction contract for the project will likely be awarded in FY 2023-24.

ALTERNATIVES CONSIDERED

1. The City Council may decide not to approve Amendment No.5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering and direct staff to reissue the RFP. Staff believes that reissuing the RFP will not result in more desirable proposals.

2. The City Council may decide not to approve Amendment No.5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering and not issue a new RFP. This alternative is not recommended as the project would not be able to move forward to construction and the park facilities and amenities will remain in its current condition.

FISCAL REVIEW
There is adequate funding available in the Fiscal Year 2022-23 Capital Improvement Program and the Fiscal Year 2022-23 Public Works Department operating budget to fund the cost of Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering.

LEGAL REVIEW
The City Attorney's Office has reviewed Amendment No. 5 and this staff report and has approved both documents as to form.

CONCLUSION
Staff recommends that the City Council:

1. Approve Amendment No. 5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering to provide engineering services for the Marina Hills Park Improvements Project for a total not- to-exceed amount of $90,724;

5 to the Professional Services Agreement for On-Call Professional Engineering Services with Willdan Engineering, subject to the City Attorney making non-substantive changes

This document outlines the requirements, selection process, and the information necessary to submit a proposal for this assignment. The selected firm will require final contract approval from the City Council.

The following is the anticipated Request for Proposals (RFP) Timeline. The City reserves the right to make changes to the below tentative schedule for selection and award of the Agreement. Any and all changes in this RFP will be made by written Addendum.

Milestone Date
RFP Issued Friday, June 17, 2022
Deadline for RFP Questions Friday, July 8, 2022, 2:00pm Responses to Questions/Addendum Issued Friday, July 15, 2022 RFP Submittal ("RFP Due Date") Friday, July 22, 2022, 2:00pm Award of Agreement Tuesday, Sept 20, 2022
The City invites qualified firms to submit written proposals for the design and project management services for the "Marina Hills Park Improvements" project. Should an award of contract be made, the 1 selected proposer will enter into an Amendment to its On-call Professional Engineering Services Agreement with the City to provide these on-call consulting services.

PROJECT BACKGROUND
Currently Marina Hills Park has a half basketball court with no seating areas or shade structures adjacent to the existing basketball court. There is limited pedestrian access from the on-street parking to the playground and other park amenities. The City's vision is to eliminate the existing half basketball court and install a full basketball court with site furnishings. Additionally, the City seeks to enhance pedestrian connectivity by the installation of walkways that create a circular walkway path and improve access to park amenities. The installation of this new route will go hand in hand with new wayfinding signs, benches and shade structures.

The project will include demolition of the existing basketball court, sod, trees and irrigation. The project incorporates earthwork, site drainage, SWPPP compliance, irrigation modifications, and hardscaping which includes pedestrian walkways, basketball court concrete and resurfacing. Site furnishings include benches, pod tables, various shade structures, trash cans, landscaping improvements and wayfinding signs. The selected consultant will work with the City to provide recommendations for tree planting that will complement the shade structures.

A preliminary study of the project was performed and has produced probable construction costs, a site plan conceptual drawing and a draft image of the proposed basketball courts. Ownership of the land was determined by using existing city GIS parcel layers. The attached Exhibit A shows more detail of the City's existing graphical data.

The final design of this project will include the following tasks:

Topographic Mapping
Geotechnical Investigaton
Utility Coordination
Grading Plans
Structural Design
Wayfinding Signage Design
Landscape and Irrigation Design
Specifications and Cost Estimates
Traffic control plans will be the responsibility of the project contractor who will be required to submit these documents for city review and approval.

The project will include a Site Research Phase, Preliminary Design Phase, Final Design Phase, Deliverables and an optional Bid Assistance and Construction Support Phase. 2 SCOPE OF SERVICES
Typical duties the consultant shall perform include, but are not limited to, the following:

A. Site Research Phase

1. Kick-off Meeting - Consultant will schedule a design kick-off meeting with City staff to discuss the scope of work, objectives, design criteria, technical requirements, and project schedule. Additionally, throughout the development of the plans monthly meetings will be conducted by the consultant. The consultant will schedule these meetings and provide meeting minutes for all participants. The consultant should expect to hold the kickoff meeting on October 15t, 2022.

2. Research & Review Available Data - Consultant will compile and review all related records and documents from the City, if available. Existing documentation that could be available includes the County, City, utility, and other pertinent records and documents, topographic data maps, geotechnical reports, environmental reports, record drawings, street and utility plans, survey centerline and private property monument data, and other important information. If this documentation is not available, the consultant shall follow the procedures necessary to assure a proper professional design. All records will be compiled and returned to the City upon project completion. The consultant will conduct an existing records research in the area and all design work will be coordinated with the affected utilities.

3. Utility Research & Notification - Consultant will conduct a detailed local utility investigation to confirm the most recent contacts for all affected utilities and cross-reference the findings with any information provided by the City. Each company will be initially contacted to inform them of the upcoming project and request information pertaining to their utilities such as verification of the sizes, depths, and locations of their underground lines, facilities, and substructures within the project vicinity. Once the requested information is received from the utility owners, the consultant will cross-check the plotted locations with field review information to ensure the existing utility lines are shown in their proper locations. The compiled information will be integrated into the 60% construction plans. Consultant will ensure the final design is compatible with all utilities to be installed, relocated, adjusted, or otherwise modified within the project area. If it is determined upon completing the design for the project that the utility research data gathered is not sufficient to accurately determine the locations of the utilities or there is a concern that conflicts may exist that require field verification, the recommendation will be made for utility potholing to be conducted prior to construction. 3 4. Site Evaluation - Consultant will schedule a site inspection and project evaluation. Consultant will verify records drawings and data, evaluate the physical condition of the existing park and confirm limits of repairs vs. replacement. These recommended limits, along with corresponding construction cost estimates will be submitted, reviewed and approved by the City prior to the consultant proceeding with the next phase of the project.

Photographs should also be taken of key project areas to document existing conditions. The overall limits of the project will be referenced in Exhibit A, Marina Hills Location Map.

5. Topographic Survey - Consultant will perform a Field Topographic Survey of the project area to be used as a base map for the project. The survey should be used to address the new drainage pattern for the proposed basketball court as well as the new bocce ball shade structure.

6. Geotechnical Investigation - The consultant shall determine the extent of the geotechnical investigation required to replace the existing half basketball court and the bocce ball shade structure. Consultant will provide a report of the findings along with any recommendations.

B. Preliminary Design Phase

1. Base Sheets - Consultant will provide base sheets that are prepared through the compilation of the researched records, topographic survey data, site visit findings, and underground utility line records obtained from as-built plans from utility companies. All plans shall be developed at 1" = 40' scale using the latest AutoCAD Civil 3D software and drafted using conventional line style and text annotation stored as a separate layer.

2. Preliminary Design - Consultant will assess within the project limits, the need to repair and/or replace landscaping, hardscaping and site furnishings. Final consultant recommendations will be presented to the City for approval prior to proceeding with the Final Design Phase. All repair/replacement work will be limited to the area located within the Marina Hills Park parcel (see Exhibit A).

C. Final Design Phase

1. 60% & 90% PS&E - Once the limits of repair/replacement have been determined and approved by the City, the consultant will begin the preparation of the PS&E to make submissions at 60% and 90% completion. 4 The consultant shall walk the site with city staff at the submittal of the 60% PS&E stage, to confirm the specific design concepts of the project. i. Plans - Consultant will populate the plan set with the necessary information and submit the plans for city review and approval. The plans will be drafted using the City's standard title block, notes, formatting and conventional line styles. Traffic Control Plans and Construction Staging Plans will be provided by the Contractor and a statement to this effect will be included in the Specifications. All plans should be developed using the latest AutoCAD and Civil 3D software. ii. Cost Estimates - The construction cost estimate development will be a continuous process which begins at project inception and ends with design completion. Consultant will provide an updated construction cost estimate at each submittal. Consultant will coordinate and conduct value engineering study/analysis for any proposed park improvements.
ili. Specifications - Consultant will draft the specifications package utilizing a boilerplate template provided by the City. The specifications will need to list all necessary contacts and will delineate all items needing relocation by the Contractor. If specific details or photographs are required in the specifications, they will need to be included as well. iv. Submittals - Consultant will submit electronic copies of the contract documents to the City for review and feedback. Consultant will coordinate a Plan Check Meeting and field walk-through (as necessary) with the City for each submittal following the distribution of electronic copies. Consultant will also prepare a summary of the submittal review comments and scanned red-lined plans in electronic format.

D. Deliverables

1. 100% PS&E - Consultant will incorporate the plan check comments submitted by the City into the 100% PS&E Submittal. Consultant will then provide the following items:
• 100% Plans - hard copy
ii. Master Set of Specifications - hard copy
ili. Final Construction Cost Estimate - hard copy
Complete PS&E Package - digital copy

Alpine Pedal Path Rathbun Creek Extension, City of Big Bear Lake, California. Project Manager. Willdan provided design services to the City of Big Bear Lake in order to accomplish another link in the citys expanding network of bike lanes and pedestrian walking facilities in the community. This project segment (about 2050 feet in length) ran along the northerly parkway of Big Bear Blvd (SR 18) and in the easterly parkway of intersecting Sandalwood Dr. It also completed a missing link between Stanfield Cutoff to the east and two large commercial and employment centers west of Sandalwood. By providing a separated bike path and pedestrian walking path it resulted in a safer and more user inviting travel option including a walking path for local students attending the nearby elementary school site. The separate defined travel path for pedestrians and bicyclists reduced the potential for points of conflict with larger motor vehicles traveling at higher rates of speed.

Emerald Bay-PCH - Swanson Park. Civil Lead. Willdan provided civil and traffic engineering design and other appurtenant services to the Emerald Bay Service District for safety improvements connected with the community's main gate entrance. The improvements involved widening Shamrock Road 25 feet; reconstructing the entrance guardhouse approximately 40 feet north of the existing location; grading Shamrock Road and the adjacent slope to accommodate the roadway widening and desired landscaping; installing upgraded lighting; installing ADA compliant curbs and ramps and retaining and monument walls; widening the right turn pocket and installing a 175 foot long raised median at the intersection of Pacific Coast Highway and Shamrock Road; and installing street striping and signage within Caltrans right of way. The slope was graded and recompacted to accommodate the roadway widening - extending the top of the adjacent slope and extending the toe of the slope by 28 feet into Swanson Park. The subsurface at the toe of the slope was mitigated by strengthening the soil with 200 18 inch diameter drilled displacement columns.

3. Project Approach
Projects, no matter how big or small, are approached similarly by the Willdan team in that they are thought out clearly and carefully during the earliest stages of the project. This equates to a detailed study of the project requirements during the proposal stage, the assignment of a project manager experienced in those project requirements, and the establishment of a project team with individual expertise in their assigned tasks.

How we see it, the park renovation should be unique, an asset to the surrounding community and maintain its identity as a recreational environment. Good planning is an essential element of any design - whether the design is for a recreational park or institutional facility. Willdan understands the importance of well-designed park planning and is experienced in integrating solid design and planning into any setting.

Furthermore, safety and circulation are key factors in design, particularly in a well-planned park environment. These two basic design elements in a public space cannot be compromised or over- emphasized. Indeed, one of the most essential functions of landscape architecture in a park environment is to convey safe and comfortable surroundings. A well-designed park environment can only generate enthusiasm among its users.

Willdan has developed very practical and successful techniques to project development and delivery.

The following summarizes our approach to delivering your projects on time and within budget. • Willdan will provide progress updates with City staff to report any outstanding issues, and proposed resolutions including status reports regarding other agency(s) having jurisdiction with this project.
• Willdan will coordinate with City staff and pertinent stakeholders to schedule the review of project deliverables.
• Willdan will coordinate with City staff and pertinent stakeholders to schedule the required meetings with regulatory agencies for deliverables review and approval. • Willdan will complete required revisions and obtain the approval from the City and regulatory agencies for the project deliverables.
• Willdan will develop a project schedule. The schedule will be circulated to the City and other pertinent stakeholders for review and acceptance. The schedule will be developed with the City's project completion date in mind and will include and measurable milestones to ensure the project completion date is met and is consistence with the City's timeline.
