CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
1989
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: September 20, 2022
SUBJECT: Approval of Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with C&C Engineering, Inc., dba CNC Engineering for Design Engineering Services for the Crown Valley Parkway Landscape Improvements, North of Club House Drive Project
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with C&C Engineering, Inc., dba CNC Engineering to provide design engineering services for the Crown Valley Parkway Landscape Improvements, North of Club House Drive Project for a total not-to- exceed amount of $90,900;
2. Approve a not-to-exceed 10% contingency of the total contract in the amount of $9,090 for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work for a total not-to-exceed amount of $99,990 if needed; and,
3. Authorize the City Manager to execute Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with CNC Engineering, subject to the City Attorney making non-substantive changes.
BACKGROUND
The screen wall along the east side of Crown Valley Parkway, north of Club House Drive wall was constructed with the development of the adjacent neighborhood in the 1970's and since that time the wall has significantly aged. Noted observations included the inconsistent use of materials, missing sections, and visible cracking in numerous locations. Additionally the parkway landscaping along the east side of Crown Valley Parkway, north of Club House Drive has mostly died off as no working irrigation system exists. A land survey has determined which portions of the wall are within the public right of way, and under maintenance by the city, and which portion of the wall is on private
property and maintained by the homeowners.
This project proposes to install new wall repairs, aesthetic treatment, landscaping, and irrigation improvements to Segment 1 (City owned wall and parkway) from Clubhouse Drive to approximately 1100 feet north of Clubhouse Drive. In addition, the project will install new landscape and irrigation improvements to Segment 2 (Privately owned wall and City owned parkway) from 1100 feet north of Clubhouse Drive to 460 feet south of Hillhurst Drive. A vicinity map for the project is provided in Attachment "A".
In 2021, staff hired a consultant to conduct a preliminary study to evaluate possible wall improvements and landscaping treatments. The preliminary study recommended repairing portions of the City owned wall and applying a decorative textured wall surface treatment to enhance the wall aesthetics. The study also recommended replacing the parkway landscaping and installing a reclaimed water irrigation system along the wall and adjacent slope.
Design plans and specifications are now required to implement the recommendations from the study. Completion of the proposed landscape improvements project supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.
ANALYSIS
On June 17, 2022, the Public Works Department issued a Request for Proposals (RFP) for design engineering, plans and specifications preparation, bid assistance, and construction support services (Attachment "B") to seven consultants from the On-Call Professional Engineering Services list. In response to the RFP, the City received two proposals.
Rank Consultant Proposal Amount
1 CNC Engineering (Recommended) $90,900
2 NUVIS $183,906
The proposals were independently evaluated, and scores were averaged to determine the highest-rated firm. Each proposal was evaluated based on the qualifications of key personnel, project approach, experience, and cost. The RFP Evaluation Summary can be found in Attachment "C". • Copies of the proposals are on file with the City Clerk's Office.
After completing the RFP evaluation process, and based on all relevant factors, CNC Engineering's proposal represents the best overall value to the City for the requested services. CNC Engineering was selected for its highly qualified staff, methodology, extensive experience providing similar services, and cost. CNC Engineering's fee was determined to be fair and reasonable and was the lowest fee proposed.
Staff recommends approving Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with CNC Engineering to provide professional engineering services • for the Crown Valley Parkway Landscape Improvements, North of Club House Drive Project for a total not-to-exceed amount of $90,900 (Attachment "D"). Staff also recommends approving a not-to-exceed 10% contingency of the total contract in the amount of $9,090 for a total not-to-exceed amount of $99,990. The contingency will cover unforeseen conditions that may arise if additional design work is needed.
If approved by the City Council, design services will start in October 2022 and the construction plans and specifications are anticipated to be completed in Summer 2023.
Construction for the project will likely be awarded in Fall 2023 using the formal bidding process and selecting the lowest responsible bidder.
ALTERNATIVES CONSIDERED
1. The City Council may decide not to approve Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with CNC Engineering and direct staff to reissue the RFP. Staff believes that reissuing the RFP will not result in more desirable proposals.
2. The City Council may decide not to approve Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with CNC Engineering and not issue a new RFP. This alternative is not recommended as the project would not be able to move forward to construction and the screen wall will continue to further deteriorate.
FISCAL REVIEW
There is adequate funding available in the Fiscal Year 2022-23 Capital Improvement Program and the Fiscal Year 2022-23 Public Works Department operating budget to fund the cost of Amendment No. 12 to the Professional Services Agreement for On-Call Professional Engineering Services with CNC Engineering.
LEGAL REVIEW
The City Attorney's Office has reviewed Amendment No. 12 and this staff report and has approved both documents as to form.
CONCLUSION
Staff recommends that the City Council:
1. Approve Amendment No. 12 to the Professional Services Agreement for On-Call Protessional Engineering Services with C&C Engineering, Inc., dba CNC Engineering to provide design engineering services for the Crown Valley Parkway Landscape Improvements, North of Club House Drive Project for a total not-to-

PROJECT BACKGROUND
The project will include repairing and replacing sections of an existing masonry block wall located on the east side of Crown Valley Parkway from Club House Drive to approximately 1200 feet north. The parkway between this section of block wall and Crown Valley Parkway shall have irrigation and landscape established. Irrigation water for this project may be supplied by an existing potable water meter located on Westgreen Dr. Installation of a reclaimed water meter, to replace the existing potable water meter, should be investigated for feasibility in suppling water for the parkway and adjacent landscaped slope. In addition, the landscape irrigation controller located on Westgreen Dr. will need upgrading to meet the watering demands of the newly landscaped area defined by this project. All landscape shrubs considered shall be evergreen, and suitable to conceal the entire height of the wall and grow in the narrow space provided. All existing vegetation is to be removed between the block wall and Crown Valley Parkway.
A preliminary study of the project was performed and has produced inspection details, recommended wall surface treatment (Decorative Textured Fiber Cement preferred), and probable construction costs. Ownership of the land tied to the existing wall was determined by land survey with a large portion lying within the public right of way and a small portion lying on private property. The attached Exhibit A contains the results of the City's preliminary study.
The final design of this project will include the following tasks:
Topographic Mapping
Geotechnical Investigaton
Utility Coordination
Wall Layout and Profile
Grading Plans
Structural Design
Cement Fiber Color and Texture Details
Landscape and Irrigation Design
Specifications and Cost Estimates
Traffic control plans will be the responsibility of the project contractor who will be required to submit these documents for city review and approval.
The project will include a Site Research Phase, Preliminary Design Phase, Final Design Phase, Deliverables and an optional Bid Assistance and Construction Support Phase. The selected consultant will be responsible for generating a complete bid package for release. There is an 2 option to phase out construction into two phases at the discretion of the City. This may result in the consultant having to compile two separate bid packages.
SCOPE OF SERVICES
Typical duties the consultant shall perform include, but are not limited to, the following:
A. Site Research Phase
1. Kick-off Meeting - Consultant will schedule a design kick-off meeting with City staff to discuss the scope of work, objectives, design criteria, technical requirements, and project schedule. Additionally, throughout the development of the plans monthly meetings will be conducted by the consultant. The consultant will schedule these meetings and provide meeting minutes for all participants. The consultant should expect to hold the kick off meeting on October 15t, 2022.
2. Research & Review Available Data - Consultant will compile and review all related records and documents from the City, if available. Existing documentation that could be available includes the County, City, utility, and other pertinent records and documents, topographic data maps, geotechnical reports, environmental reports, record drawings, street and utility plans, survey centerline and private property monument data, and other important information. If this documentation is not available, the consultant shall follow the procedures necessary to assure a proper professional design. All records will be compiled and returned to the City upon project completion. The consultant will conduct an existing records research in the area and all design work will be coordinated with the affected utilities.
3. Utility Research & Notification - Consultant will conduct a detailed local utility investigation to confirm the most recent contacts for all affected utilities and cross-reference the findings with any information provided by the City. Each company will be initially contacted to inform them of the upcoming project and request information pertaining to their utilities such as verification of the sizes, depths, and locations of their underground lines, facilities, and substructures within the project vicinity. Once the requested information is received from the utility owners, the consultant will cross-check the plotted locations with field review information to ensure the existing utility lines are shown in their proper locations. The compiled information will be integrated into the 60% construction plans. Consultant will ensure the final design is compatible with all utilities to be installed, relocated, adjusted, or otherwise modified within the project area. If it is determined upon completing the design for the project that the utility research data gathered is not sufficient to accurately determine the locations of the utilities or there is a concern that conflicts may exist that require field verification, the recommendation will be made for utility potholing to be conducted prior to construction.
4. Site Evaluation - Consultant will schedule a site inspection and project evaluation. Consultant will verify records drawings and data, evaluate the physical condition of the existing wall and confirm limits of repairs vs. replacement. These recommended limits, along with corresponding construction cost estimates will be submitted, reviewed and approved by the City prior to the consultant proceeding with the next phase of the project.
Photographs should also be taken of key project areas to document existing conditions. The overall limits of the project will be from Station 0+68 to Station 11+78 as referenced in Exhibit A, Preliminary Engineering Study.
5. Topographic Survey - Consultant will perform a Field Topographic Survey of the project area to be used as a base map for the project.
6. Geotechnical Investigation - The consultant shall determine the extent of the geotechnical investigation required to address the cause of displaced walls.
The consultant will provide a report of the findings along with any recommendations for wall design.
B. Preliminary Design Phase
1. Base Sheets - Consultant will provide base sheets that are prepared through the compilation of the researched records, topographic survey data, site visit findings, and underground utility line records obtained from as-built plans from utility companies. All plans shall be developed at 1" = 40' scale using the latest AutoCAD Civil 3D software and drafted using conventional line style and text annotation stored as a separate layer.
2. Preliminary Design - Consultant will assess within the project limits, the need to repair and/or replace the wall. Consultant will assess the condition of the wall and construction costs when determining the extent of wall repair/replacement. Final consultant recommendations will be presented to the City for approval prior to proceeding with the Final Design Phase. Wall repair/replacement will be limited from Station 0+68 to Station 9+51 (see Exhibit A). The scope of work from Station 9+51 to Station 11+78 will be limited to installing new planting and irrigation within the public right of way adjacent to the existing wall located on private property within these limits.
This segment of the wall will not be altered.
4 C. Final Design Phase
1. 60% & 90% PS&E - Once the limits of wall repair/replacement have been determined and approved by the City, the consultant will begin the preparation of the PS&E to make submissions at 60% and 90% completion.
The consultant shall walk the site with city staff at the submittal of the 60% PS&E stage, to confirm the specific design concepts of the project. i. Plans - Consultant will populate the plan set with the necessary intormation and submit the plans for city review and approval. The plans will be drafted using the City's standard title block, notes, formatting and conventional line styles. Traffic Control Plans and Construction Staging Plans will be provided by the Contractor and a statement to this effect will be included in the Specifications. All plans should be developed using the latest AutoCAD and Civil 3D software. ii. Cost Estimates - The construction cost estimate development will be a continuous process which begins at project inception and ends with design completion. Consultant will provide an updated construction cost estimate at each submittal. Consultant will coordinate and conduct value engineering study/analysis for any proposed wall improvements.
ili. Specifications - Consultant will draft the specifications package utilizing a boilerplate template provided by the City. The specifications will need to list all necessary contacts and will delineate all items needing relocation by the Contractor. If specific details or photographs are required in the specifications, they will need to be included as well. iv. Submittals - Consultant will submit electronic copies of the contract documents to the City for review and feedback. Consultant will coordinate a Plan Check Meeting and field walk-through (as necessary) with the City for each submittal following the distribution of electronic copies. Consultant will also prepare a summary of the submittal review comments and scanned red-lined plans in electronic format.

ENGINEERING Project Approach
The following is detailed description of services for the successful completion of this project A. SITE RESEARCH PHASE
1. KICK-OFF MEETING - CNC will request and coordinate a design kick-off meeting with City staff to refine the scope of services and objectives, review the project schedule, and to finalize any administrative details such as point-of-contact for each team member.
Thereafter, we will be available to attend up to three (3) design coordination meetings as necessary with the City to discuss design issues and possible impacts to the surrounding properties and the community and with utilities to discuss possible project conflicts with existing facilities. CNC will prepare and distribute minutes of all meetings including a list of action items and the responsible party.
2. RESEARCH & REVIEW AVAILABLE DATA - As part of the conceptual design phase, CNC has already obtained copies of street centerline data and field verified the information. Our investigation shows all easements in the area have been transferred by the County to the City. However, we will conduct our record search at the City as well as the County. Refer to item 3 below for utility research. CNC will return all records compiled, along with a log of all utility contacts to the City upon project completion.
3. UTILITY RESEARCH & NOTIFICATION - In addition to the requirements for this task provided in the RFP, CNC proposes the following services for utility investigation:
a. Access the Underground Service Alert's website and compile a list of member agencies that own facilities within the project limits.
b. Augment and/or refine the above list based on available information from the City. c. Notify each utility purveyor, in writing, of the City's proposed plans and schedule and request copies of record drawings or atlas maps of existing and proposed facilities in the vicinity of the project. d. Utilities shown on the record drawings will be surface verified, and added to the base map prepared under Task 5 below, along with the most recent easement lines shown for each facility. e. CNC will consult with the service planners and others as necessary within each utility company to resolve any conflicts. f. CNC will keep City staff informed on all discussions with utility companies via written meeting minutes or records of telephone conversation.
g. CNC will prepare a Utility Notification Log to track utility company contacts and responses including contact information and dates of all outgoing and incoming correspondence.
h. With prior approval from the City, CNC will provide copies of the preliminary plans to the utility purveyors to facilitate planning future modifications.
i. Provide City with recommended location(s) and depth of utility potholes on the base map prepared in Task 5 below, if necessary.
4. SITE EVALUATION - As part of the conceptual design of this project for the City, CNC has already performed several in depth site visits to investigate the wall and identify design constraints and opportunities. We will notify the City prior to our site visit, and will update our records per the latest condition of the wall and adjacent improvements and field verify available record drawings obtained in Tasks 2 and 3 above, as well as the base map in Task 5.
CNC has assembled a team of soils and structural engineers who will join us during the site inspection in order to provide a more informed and comprehensive evaluation of the physical condition of the existing wall and confirm limits of repairs vs. replacement. CNC will prepare a summary report of the site evaluation including all field notes and photographs along with our recommendations and a corresponding opinion of probable construction cost for city review and approval.
5. TOPOGRAPHIC SURVEY - As part of the conceptual design phase of this project, CNC located street centerline monuments tied to State Plane Coordinates to establish the street right-of-way of Crown Valley Parkway. We will use these monuments and the nearest available County bench mark to perform Field Topographic Cross Section Survey of the project at 25-ft intervals, grade breaks and beginning and ends of turns. Each cross section will begin at the top of the easterly curb on Crown Valley Parkway and extend eastward. In order to avoid survey on private property, CNC proposes the following easterly limits of survey cross sections:
CITY OF LAGUNA NIGUEL PAGE! 17
Crown Valley Parkway Screen Wall North of Club House Drive ACNC SECTION 2
ENGINEERING Project Approach
From CVP centerline station 0+50 to 1+40, extend cross sections to 60' east of CVP centerline. • From CVP centerline station 1+40 to 9+50, extend cross sections to the toe of the embankment slope along the east side of the Crown Valley Parkway.
• From CVP centerline station 9+50 to 12+00, extend cross sections to the existing screen wall.
The above stationing is based on Exhibit A of the RFP. Each cross section will consist of the existing dirt walkway in front of the wall and the wall itself, top and toe of slope and existing surface culture including manholes, valves, pull boxes, signs and planting Survey will include measurement of tree trunks at breast height (TBH).
6. GEOTECHNICAL INVESTIGATION - CNC proposes to use the services of Hushmand Associates, Inc. (HAI) for the geotechnical investigation required for this project. HAI recently worked with CNC for the geotechnical investigation and design requirements for two (2) 72-ft tall freeway pylon signs for the City as well as all of the City's entry monuments. The following is a detailed list of tasks and assumptions for geotechnical services:
• Review of the available information on local conditions for the site and surrounding areas including geologic maps and other published reports.
• Obtaining a no fee permit from the City for drilling exploratory borings • Marking Borings and Dig-Alert for utility markings.
• Field Exploration consisting of 4 hand-auger borings reaching minimum depth 5 ft below ground surface (bgs), to determine soil profile and to collect bulk sample for soil classification and performing geotechnical tests at HAI soil laboratory. • Performing Dynamic Cone Penetrometer (DCP) test at 4 locations to depth of 6 feet below grade to assess in situ soil properties.
• Excavation of up to three hand-excavated trenches to expose the footing of the existing wall, in order to assess the configuration of the footing (width, depth, and thickness) as part of evaluation of the cause(s) of distortion and distress of the existing wall.
• Performing laboratory tests and providing test results. • Engineering analyses to assess soil creep potential, expansion potential, passive capacity, and base friction, to evaluate potential cause(s) of the existing wall distortion, and to provide geotechnical design parameters for the wall footing. • Preparation of a geotechnical investigation report for City review and approval.
Based on the CGS Earthquake Zones of Required Investigation San Juan Capistrano Quadrangle Map, the project site is located within liquefaction-prone areas. However, a liquefaction evaluation is not needed for the subject site since it is an uninhabitable structure with no life-line critical function in case of earthquake. If the Client/City requires a liquefaction evaluation for the site, a separate proposal for evaluation of the liquefaction potential and its impacts on the wall stability will be provided.
ASSUMPTIONS
• Full access to the site will be granted by the City no cost. • We are not responsible for damage to underground structures. • Boring will be excavated in soil-covered areas. No borings will be advanced in concrete side walk or asphalt pavement. • Borings will be backfilled with soil and hand compacted.
B. PRELIMINARY DESIGN PHASE
1. BASE SHEETS - All survey data collected in Task 5 above will be downloaded on our computers for preparation of the base map. Mapping will be performed using the latest AutoCAD Civil 3D software and drafted using conventional line style and text annotation stored as a separate layer. CNC will field verify the base map for accuracy and completeness and also check it against available record drawings of the roadway. Drawings will show location of control points and bearing/distance or station/offset information from the project location to the control points. The electronic files will be in AutoCAD and in full compliance with the City's Digital Submission Requirements for Street Improvement Plans. The base map will be augmented by addition of existing utilities obtained from available record drawings. All plans shall be developed at 1" = 40' scale or 1"=20' scale for optimal legibility.
2. PRELIMINARY DESIGN - CNC understands portions of the wall have been repaired since the completion of our conceptual design.
Based on survey and geotechnical data collected in the field, we will perform stability analysis of the wall from Station 0+68 to Station 9+51 (see Exhibit A) to determine the extent of repair vs. replacement along the various segments of the structure. Our CITY OF LAGUNA NIGUEL PAGE | 12
Crown Valley Parkway Screen Wall North of Club House Drive ACNC SECTION 2
ENGINEERING Project Approach
recommendations along with a copy of the supporting analysis and anticipated factor of safety will be presented to the City for approval prior to proceeding with the final design phase. Our landscape consultant will also develop concepts design concepts for decorative textured fiber cement wall finish
We understand the scope of work from Station 9+51 to Station 11+78 will be limited to installing new planting and irrigation within the public right of way adjacent to the existing wall located on private property within these limits and this segment of the wall will not be altered. CNC's landscape architect Cornerstone Studios, Inc. (CSI) will prepare schematic drawings at 1"= 20' scale.
The drawings will include a preliminary plant palette with photos and plan views of the project areas as needed for presentation purposes. All mutually agreed upon review comments from the City will be incorporated into the drawings to produce final schematic plans.
CNC understands City would like the selected consultant to investigate the feasibility of switching the irrigation from potable water to reclaimed. As shown in Exhibit A (on page 14 of this proposal), there is currently an 8-inch reclaimed waterline in Club House Drive east of Crown Valley Parkway that is owned and operated by the Moulton Niguel Water District (MNWD). We will work closely with our landscape consultant, CSI, to investigate feasible options for running a service lateral from this line to the project site to deliver adequate volume and pressure of irrigation for the landscaping. We will check any possible cross connection with domestic water line, where MNWD will require 10' minimum horizontal separation from domestic waterline and vertical separation from the street surface in order of the higher quality, i.e., domestic water above reclaimed water and reclaimed water above sewer.
C. FINAL DESIGN PHASE
CNC will prepare construction plans, consisting of the following:
DESCRIPTION NUMBER OF SHEETS SCALE
Title Sheet 1 NTS
Typical Sections and Notes 1 NTS
Construction Details 1 NTS
Wall Layout and Profile 2 40
Planting, Irrigation & Decorative Treatment Plans 5 40
Wall Design- The above list assumes new wall segments will be constructed per standard plans provided in the Greenbook or Caltrans Standard Plans. This task includes analysis of these standard plans against the geotechnical design recommendations to ensure the design provides sufficient factor of safety. If the analysis shows a standard wall does not provide sufficient factor of safety at this site, then we will use the services of a registered structural engineer to prepare plans and specifications for a special design, as an additive task, described below.
Additive Task for Special Design for New Wall- If analysis of standard walls shows they do not provide sufficient factor of safety, then with prior approval of the City, CNC will use the services of Arcon Structural Engineers to prepare details and specifications for a special design for the new wall that can meet the required factor of safety for the conditions at the site.
Planting & Irrigation Design- CSI will prepare planting and irrigation plans based on the final schematic plans and the Landscape Guidelines. All landscape shrubs to be appropriately selected to grow within the narrow space provided and to conceal the entire height of the wall. All existing vegetation to be removed between the block wall and Crown Valley Parkway. CSI will also prepare the final PS&E for decorative textured fiber cement for the portion of the wall that will not be covered with landscaping.
Irrigation plans and details will provide permanent systems for all planting. We understand that the irrigation water for this project may be supplied by an existing potable water meter located on Westgreen Drive and it shall be a dedicated meter for the irrigation use.
This proposal assumes irrigation design will be based on the existing source of irrigation. The existing landscape controller located on Westgreen Drive will need to be upgraded to meet the watering demands for the project areas and to meet the latest Model Water Efficient Landscape Ordinance (MWELO) guidelines.
If the analysis in the Preliminary Design Phase above shows use of reclaimed water in lieu of the existing potable water meter is feasible, then a new reclaimed water service lateral will be designed per separate work order.

CNC performed design survey and prepared the construction documents for regrading of over 5,000 PROJECT MANAGER square feet of the adjacent slopes across residential lots to accommodate the widening of the roadway.
Shahab (Sean) Nazarie, P.E., M.S. The challenge was to protect single family structures at the top of slope. Work included design of over 300 lineal feet of terrace drains, two separate PVC down-drains, and an innovative permanent slope shoring system consisting of soldier piles connected to modular block facing with a patented system of fabrics. The design allowed sufficient set-back from the grading limits to the structures while exceeding the minimum required factor of safety for the slope.
