BACKGROUND
The State's Health and Safety Code mandates that the California Building Standards Commission every three years adopt and publish the California Building Standards Code. The California Building Standards Code contains the minimum standards for the design and construction of buildings and structures in California. The new 2022 California Building Standards Code will become effective statewide on January 1, 2023. Every city and county statewide has the authority to adopt more restrictive building standards (referred to as "local amendments") based on local climatic, geological, or topographical conditions. The City of Laguna Niguel adopted local amendments during each of the prior triennial code adoption cycles, most recently in November 2019. Unless the City adopts and amends Codes contained in the California Building Standards Code, the building standards contained in those Codes will automatically apply to the City.

ANALYSIS
As in years past, the Community Development Department, in collaboration with the Orange County Fire Authority (OCFA), is proposing local amendments to more fully safeguard life and property in the City of Laguna Niguel. These local amendments, discussed below, are included in Ordinance Nos. 2022-219 and 2022-220 (Attachments B and C, respectively) adopting by reference certain Codes contained in the 2022 California Building Standards Code. The necessary findings that the local amendments are required due to local climatic, geological, or topographical conditions, or are administrative in nature, are included in draft Resolution 2022-1410 (Attachment A).

The Codes contained in the California Building Standards Code, which are proposed for adoption, are listed below. Upon adoption of the proposed Ordinances, each will become codified in Titles 8 or 11 of the Laguna Niguel Municipal Code (LNMC). The list also identifies whether local amendments are proposed.

California Building Standards Code: LNMC: Local Amendment Proposed:
• California Building Code Title 8, Division 1, Article 2 Yes • California Residential Code Title 8, Division 1, Article 9 Yes • California Green Building Standards Code Title 8, Division 1, Article 10 N/A • California Electrical Code Title 8, Division 2, Article 1 N/A Pg 3
• California Plumbing Code Title 8, Division 3, Article 1 N/A • California Mechanical Code Title 8, Division 5, Article 1 N/A • California Administrative Code Title 8, Division 7 N/A • California Fire Code Title 11, Division 3, Article 1 Yes Local Code Amendments
OCFA is recommending a total of two (2) new local amendments to the California Fire Code (CFC) and three (3) revisions to existing local amendments as detailed in the summary table included as Attachment D. In general, the two new amendments have to do with high pile commercial storage of compost (CFC Sections 2808.15 and 2808.16).

The three revisions to existing local amendments consist of renaming and streamlining Code references (CFC Section 501.1), vegetation spacing/separation within fuel modification zones (CFC Section 4907.3), and a modification when fire sprinklers are CFC Section 45013). required for significant remodels and additions to single-family homes that are over 5,500 square feet (CFC Section 903.2.8).

Aside from OCFA's five (5) recommended changes, all other local amendments contained in the proposed Ordinances are already in the LNMC and are proposed to be re-adopted as-is (summary table included in Attachment E). The California Administrative Code, California Electrical Code, Mechanical Code, California Plumbing Code, and California Green Building Standards Code are all proposed to be adopted without any local amendments.

International Code Council Codes
The International Code Council publishes a series of uniform Codes, many of which are adopted and amended by the State and made a part of the California Building Standards Code, to provide cities with a complete set of building-related regulations. The two International Codes listed below provide important construction and safety standards not addressed elsewhere in the adopted State regulations according to the City's Building Official. The following Codes were included in the City's 2019 adoption cycle and are also included for the 2022 adoption cycle:
- 2021 International Swimming Pool and Spa Code; and,
- 2021 International Property Maintenance Code.

NEXT STEPS
With the introduction of these Ordinances, a City Council public hearing, for the second reading and adoption, will be scheduled for November 1, 2022. If the Ordinances are adopted by City Council, City staff will file copies of the Ordinances and Resolution with the California Building Standards Commission.

Pg 4

CEQA COMPLIANCE
Pursuant to Section 15060(c)(2) of the California Environmental Quality Act (CEQA) Guidelines, adoption of the subject Ordinances would not result in a direct or reasonably foreseeable indirect physical change in the environment and therefore is not subject to the CEQA. Additionally, pursuant to Section 15060(c)(3) the activity is not a "project" as defined in Section 15378 because the Ordinances have no potential for resulting in physical change to the environment, directly or indirectly.

ALTERNATIVES CONSIDERED

1. Modify the Ordinance(s) as directed by the City Council.

2. Not adopt one or more of the Ordinances. This alternative is not recommended because the Ordinances are considered necessary to more fully safeguard life and property in the City of Laguna Niguel.

FISCAL REVIEW
There is no fiscal impact to the City as a result of these actions.

LEGAL REVIEW
The City Attorney's Office has reviewed and approved this report and corresponding Resolution and Ordinances as to form and content.

CONCLUSION
To more fully safeguard life and property in the City of Laguna Niguel, the Community Development Department and the OCFA are recommending adoption of the 2022 California Building, Administrative, Residential, Plumbing, Electrical, Mechanical, Green Building Standards, and Fire Codes, including local amendments, the 2021 International Property Maintenance Code, and the 2021 International Swimming Pool and Spa Code (Ordinance Nos. 2022-219 and 2022-220).

A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA, SETTING FORTH FINDINGS THAT MODIFICATIONS TO THE 2022 CALIFORNIA BUILDING

STANDARDS CODE ARE REASONABLY NECESSARY BECAUSE OF LOCAL

CLIMATIC, GEOLOGICAL OR TOPOGRAPHICAL CONDITIONS
WHEREAS, On October 18, 2022, the City Council introduced Ordinance Nos. 2022-219 and 2022-220 adopting and amending certain codes that are part of the 2022 California Building Standards Code; and
WHEREAS, pursuant to California Government Code section 50022.1, et seq., the City of Laguna Niguel may adopt by reference the California Building Standards Code, 2022 Edition as codified in Title 24 of the California Code of Regulations; and Calitornia Buildina standards Code
and
WHEREAS, California Health & Safety Code section 17958.5 authorizes cities and counties to modify building standards in the California Building Standards Code by adopting more restrictive standards and modifications if such standards and modifications are supported by express findings that they are reasonably necessary because of local climatic, geological, or topographical conditions; and WHEREAS, the Laguna Niguel Community Development Department and/or the Orange County Fire Authority (OCFA) have recommended that changes and modifications be made to certain codes contained in the California Building Standards Code (specifically, provisions of the 2022 California Building Code, the 2022 California Residential Code, and the 2022 California Fire Code) and are reasonably necessary to safeguard life and property due to local conditions in the City of Laguna Niguel and has further advised that the remainder of said changes and modifications are of an administrative or procedural nature, or concern themselves with subjects not covered by the Codes; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Laguna Niguel as follows:

1. To the extent that the following changes and modifications are deemed more restrictive than the standards contained in the 2022 California Building Standards Code, thus requiring that findings be made pertaining to local conditions to justify such modifications, the City Council hereby finds and determines that the following findings are reasonably necessary because of local climatic, geological, or topographical conditions, and adopts the findings provided below to support Resolution No. 2022-1410 Page 2
the modifications to building standards in the 2022 California Building, Residential and Fire Code, adopted and amended by the City.

Climatic Conditions
A. Orange County and the City of Laguna Niguel are located in a semi-arid Mediterranean type climate. It annually experiences extended periods of high temperatures with little or no precipitation. Hot, dry (Santa Ana) winds, which may reach speeds of 70 M.P.H. or greater, are also common to the area. These climatic conditions cause extreme drying of vegetation and common building materials. Frequent periods of drought and low humidity add to the fire danger. This predisposes the area to large destructive fires (conflagration). In addition to directly damaging or destroying buildings, these fires are also prone to disrupt utility services throughout the County. Obstacles generated by a strong wind, such as fallen trees, street lights and utility poles will greatly impact the response time to reach an incident scene.

B. The climate alternates between extended periods of drought and brief flooding conditions. Flood conditions may affect the fire department's ability to respond to a fire or emergency condition. Floods also disrupt utility services to buildings and facilities within the County.

C. Water demand in this densely populated area far exceeds the quantity supplied by natural precipitation; and although the population continues to grow, the already-taxed water supply does not. California is projected to increase in population by nearly 10 million over the next quarter of a century with 50% of that growth centered in Southern California. Due to storage capacities and consumption, and a limited amount of rainfall, future water allocation is not fully dependable. This necessitates the need for additional and on-site fire protection features.

D. These dry climatic conditions and winds contribute to the rapid spread of even small fires originating in high-density housing or vegetation. These fires spread very quickly and create a need for increased levels of fire protection. The added protection of fire sprinkler systems and other fire protection features will supplement normal fire department response by providing immediate protection for the building occupants and by containing and controlling the fire spread to the area of origin. Fire sprinkler systems will also reduce the use of water for firefighting by as much as 50 to 75%.

E. Untreated wood roofs cause or contribute to serious fire hazard and to the rapid spread of fires when such fires are accompanied by high winds.

Pieces of burning wooden roofs become flying ambers and are carried by the wind to other locations and thereby spread fire quickly.

Resolution No. 2022-1410 Page 3
F. Swimming pool accidents are a preventable tragedy. The warm, dry climate is conducive to swimming pools which creates a higher probability of child drownings where pools are unprotected.

II. Topographical Conditions
A. Natural slopes of 15% or greater generally occur throughout the foothills of Orange County and the City of Laguna Niguel. The elevation change caused by the hills creates the geological foundation on which communities within Orange County are built and will continue to be buil on. With much of the populated flatlands already built upon, future growth will occur in areas with steeper slopes and greater constraints in terrain.

B. Traffic and circulation congestion is an artificially created, obstructive topographical condition, which is common throughout Orange County.

C. These topographical conditions combine to create a situation that places fire department response time to fire occurrences at risk and makes it necessary to provide automatic on-site fire-extinguishing systems and other protection measures to protect occupants and property.

IlI. Geological Conditions
The Orange County region, including the City of Laguna Niguel, is a densely populated area that has buildings constructed over and near a vast and complex network of faults that are believed to be capable of producing future earthquakes similar or greater in size than the 1994 Northridge and the 1971 Sylmar earthquakes. Earthquake faults run along the northeast and southwest boundaries of Orange County. The Newport-Inglewood Fault, located within Orange County was the source of the destructive 1933 Long Beach earthquake (6.3 magnitude) which took 120 lives and damaged buildings in an area from Laguna Beach to Marina Del Rey to Whittier. In December 1989, another earthquake occurred in the jurisdiction of Laguna Niguel at an unknown fault line.

Regional planning for reoccurrence of earthquakes is recommended by the state of California, Department of Conservation.

A. Previous earthquakes have been accompanied by disruption of traffic flow and fires. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create obstacles similar to those indicated under the high wind section above. The October 17, 1989, Santa Cruz earthquake resulted in one major fire in the Marina District (San Francisco). When combined with the 34 other fires locally and over 500 responses, the department was taxed to its fullest capabilities. The Marina fire was difficult to contain because mains supplying water to the district burst during the earthquake. This situation creates the need for both additional fire protection and automatic on-site fire protection for building Resolution No. 2022-1410 Page 4
occupants. State Department of Conservation noted in their 1988 report (Planning Scenario on a Major Earthquake on the Newport-Inglewood Fault Zone, page 59), "unfortunately, barely meeting the minimum earthquake standards of building codes places a building on the verge of being legally unsafe."
B. Road circulation features located throughout the County also make amendments reasonably necessary. Located through the County are major roadways, highways and flood control channels that create barriers and slow response times. Hills, slopes, street and storm drain design, accompanied by occasional heavy rainfall, causes roadway flooding and landslides and at times may make an emergency access route impassable. There are areas in Orange County that naturally have extended emergency response times that exceed the 5 minute goal.

C. Soils throughout the County possess corrosive properties that reduce the expected usable life of water services when metallic pipes are in contact with soils.

Due to the topographical conditions of sprawling development separated by waterways and narrow and congested streets and the expected infrastructure damage inherent in seismic zones described above, it is prudent to rely on automatic fire sprinkler systems to mitigate extended fire department response time and keep fires manageable with reduced fire flow (water) resources available for a given structure. Additional fire protection is also justified to match the current resources of firefighting equipment and personnel within the fire department.

IV. Administrative
This amendment is necessary for administrative or procedural clarification, and do not modify a building standard pursuant to California Health, Safety Code Sections 17958, 17985.7 and/or 18941.5. This amendment establishes administrative standards for the effective enforcement of the building standards in the City of Laguna Niguel.

The findings above are applicable to amendments to the 2022 California Building Code, the 2022 California Residential Code, and the 2022 California Fire Code, as detailed in the following tables.

City Staff - Local Amendments Summary Table
Summary of Proposed Local Code Amendments (2022) - City Staff Recommendations Code Sections Title Description New, Existing, or
Revised
LNMC Section 8-1-12 Adoption of 2022 Edition of the Lists the applicable Codes adopted by reference. This is an administrative provision necessary for Existing California Building Code and local implementation of the Codes.

Related Codes
CBC Section 105.2(2) Work Exempt from permit The CBC does not require a building permit for freestanding fences and walls that are "seven (7) Existing feet in-height or less." The proposed local code amendment lowers the permit requirement to a height threshold of "42 inches in-height or less" for walls, fences and gates. Requiring a permit for fences helps ensure that over-height fences are not constructed in violation of zoning standards, such as in the front yard setback, or constructed on neighboring properties, as well as provides for proper design and inspection of walls and footings, given the City's soil and slope conditions.

CBC Section 105.2(4) Work Exempt from permit Retaining walls "four (4) feet-in-height or less" would be removed from the exemption list. Existing Requiring a building permit for retaining walls helps ensure that proper design is provided. Given the City's poor soil conditions, it ensures that footings and drainage improvements are structurally engineered and inspected to protect against potential slope and fence/wall movement, which results in property damage.

CBC Section 105.2(9) Work Exempt from permit The CBC does not require a building permit for small above-ground prefabricated pools that are Existing "less than 24 inches deep." To be consistent with the State Health and Safety Code and the pool safety standards of the City, the proposed local code amendment lowers the permit requirement to a height threshold of "less than 18 inches deep" for small above-ground prefabricated pools.

CBC Section 105.3.2.1 Building permit application as a Establishes a time limitation of 60 days for a permit application from expiring for any proposed Existing result of a Notice of Violation work submitted as the result of a Code Enforcement written Notice of Violation. This provision is intended to aid in resolving code violations for un-permitted construction in a timely fashion. To account for extenuating circumstances, the Building Official is authorized to grant extension of time for justifiable good cause.

CBC Section 105.5 Expiration of building permit As a condition of granting any permit extension, the Building Official may require the payment of Existing permit fees based on the remainder of work to be completed. The Building Official shall not grant an extension unless the permittee submits a written application and demonstrates that there is justifiable cause for the extension requested. The purpose of this local amendment is to avoid prolonged construction projects where no meaningful progress occurs for an extended period of time.
