CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: March 21, 2023
SUBJECT: 2022 Housing Element Annual Progress Report
RECOMMENDATION
Staff recommends that the City Council authorize staff to submit the 2022 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR) by April 1, 2023.
BACKGROUND
State law requires each jurisdiction to prepare and file APRs describing the status and progress in implementing its Housing Element to both HCD and OPR. Specifically, the City must prepare and file the Housing Element APR using forms and definitions adopted by HCD. The 2022 APR must be submitted by April 1, 2023 to HCD and OPR.
The Laguna Niguel General Plan Housing Element, covering the 2021-2029 planning period, was adopted by the City Council on October 19, 2021. An amendment to the October 19, 2021, Adopted Housing Element, will be considered as a public hearing item at this March 21, 2023 City Council hearing.
ANALYSIS
The State's Housing Element APR form for the 2022 reporting period has been updated in accordance with recent state laws (AB 757, SB 290, and SB 9) (Attachment A). Table F2 was added to allow reporting of above-moderate-income units converted to moderate-income units, pursuant to Government Code (GC) 65400.2. Table | was added to allow reporting of units constructed pursuant to GC 65852.21 and applications for lot splits pursuant to GC 66411.7. Table J was added to allow reporting of student housing developments for low-income students that were granted a density bonus pursuant to GC 65915(b)(1)(F). There was no City data to report for these new tables.
Within the 2022 APR form, Tables A - F, G, H, Summary, and LEAP are consistent with last year, and include the following information:
• Housing development applications submitted (Table A):
• Cove @ El Niguel (22-unit townhome development) and South Forbes (309-unit multi-family development) were submitted (for purposes of the APR, submitted is when the application is deemed complete) and approved in 2022.
• Annual building activity reports for new housing units (Table A2):
• Single-family units: 2 received building permits and 1 received a certificate of occupancy in 2022.
• Accessory dwelling units: 10 received building permits and 6 received a certificate of occupancy in 2022.

• Moderate income: 2 units were issued building permits. • Above-moderate income: 2 units were issued building permits. • Sites identified or rezoned to accommodate shortfall housing need and no net- loss law (Table C):
Not applicable.
• Housing Element Program implementation status including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing (Table D):
• Table D includes the status of program implementation for the following six programs identified in the October 2021 Adopted 2021-2029 Housing Element: Provision of Adequate Housing Sites, Sites for Emergency Shelters and Transitional/Supportive Housing, Affordable Housing Development, Conserve and Improve Existing Housing Affordable to Low and Moderate Income Households, Promote Equal Housing Opportunity, and Housing Element Monitoring and Reporting.
• Commercial development bonus approved pursuant to GC 65915.7 (Table E):

• Not applicable.
• Locally owned surplus sites (Table H):
• Not applicable.
• Summary of building permits issued by affordability, units by structure type, number of applications, and use of SB 35 streamlining provisions (Table Summary).
• Local Early Action Planning (LEAP) reporting (Table LEAP):
• The City received $300,000 in LEAP grant funds and is allocating the funds towards a new land management software system (Energov). The software implementation is currently in progress.
ALTERNATIVES CONSIDERED
The City Council can decide not to authorize staff to submit the 2022 APR to HCD and OPR by the April 1st deadline which may result in the City being subject to the loss of grant funding, litigation, and non-compliance with SB 35.
FISCAL REVIEW
There is no fiscal impact as a result of this action.
LEGAL REVIEW
The City Attorney has approved this report to form.
CONCLUSION
Staff recommends that the City Council authorize staff to submit the 2022 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR) by April 1, 2023.
