BACKGROUND
During the City Council meeting held on April 5, 2022, the City Council considered several updates and amendments to the provisions of the Municipal Code related specifically to the Military Support Committee. The updates and amendments for City Council consideration included:
• 1. Provide that the appointment and removal of members of the Committee be 2 completed by the City Council rather than by the City Council liaisons to the Committee;
• 2. Provide that the City Council liaisons to the Committee shall serve as non-voting advisory members of the Committee and not as Co-Chairs; • 3. Provide that the members of the Committee shall select the Chair and Vice Chair of the Committee; and,
• 4. Update the Municipal Code provisions related to the listing of specific adoptive military units, including the list of ex-officio members from those units, and provide that the Council shall make the future designations of which military units are to be supported by the City and the Committee.
introduced Ordinance No. 2022-212 with only bullet point items 1 and 4 included, but not bullet point items 2 and 3. Specifically, the City Council amended proposed Ordinance No. 2022-212 by retaining the provisions that would provide for the appointment and removal of members of the Committee by the City Council rather than by the City Council liaisons to the Committee and updating the Code regarding adopted military units. The City Council removed the provisions on Council Liaison Roles and the designation of a Chair and Vice-Chair. On April 19, 2022, the City Council adopted Ordinance No 2022- 212 with the amended language (Attachment A).
ANALYSIS
At the request of Mayor Pro Tem Sharma and Council Member Oddo, this item has been placed on the agenda to introduce Ordinance No. 2023-221. Mayor Pro Tem Sharma and Council Member Oddo currently serve as the Co-Chairs of the Laguna Niguel Military Support Committee.
If adopted as prepared, Ordinance No. 2023-221 would further amend the Laguna Niguel Municipal Code related to the Military Support Committee to include updated provisions on the role of non-voting City Council Liaisons and the designation and Selection of a Chair and Vice-Chair from amongst the Committee's membership.
City Council Liaisons to Serve as Non-voting Advisory Members, Not Co-Chairs At current, two City Council members are appointed by the entire City Council to serve as Co-Chairs to the Committee. The Co-chairs lead the Committee through the business of each meeting and through the implementation of Committee guidelines. The request is to shift from City Council appointed Co-Chairs to City Council liaisons. The recommendation is to no longer have City Council liaisons serve as Co-Chairs but to instead serve as non- voting advisory member liaisons to the Committee.
The rationale behind this request is to make the City Council liaison structure match that of the other Commissions and Committees, excluding the Investment, Banking & Audit Committee (IB&A), resulting in a non-voting advisory role by the liaisons and the appointment of a Chair and Vice Chair from the Committee membership. 3 Members of the Committee Shall Select the Chair and Vice Chair of the Committee At current, the Committee is Co-Chaired by two City Council members. The request is to have Committee members who are selected by the Committee serve as Chair and Vice Chair of the Committee. The recommendation is that the Committee members, within 90 days of the effective date of the proposed Ordinance, select a Chair and Vice Chair from the appointed voting members during a regular meeting and serve through the end of the current 1-year term. The selection of a Chair and Vice Chair will thereafter continue to be made annually.
The rationale behind this request is to make the Chair and Vice Chair structure match that of the other Commissions and Committees.
Last, there is one non-substantive revision to Section 2-3.26 (Accounting and approval of expenditures) to change the reference of committee-co-chair to Chair.
To make all of the aforementioned amendments and additions, staff has prepared Ordinance 2023-221 (Attachment B) pertaining to the Military Support Committee.
ALTERNATIVES CONSIDERED
The City Council may elect to:
1. Make no changes to the existing Ordinance.
2. Make additional edits to the provisions of Commissions, Boards and Committees.
