CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: April 4, 2023
SUBJECT: Introduction of Ordinance No. 2023-220, Amending Ordinance No. 91-45 to Establish the Prima Facie Speed Limit on Two Street Segments of Pacific Park Drive Between Alicia Parkway to La Paz Road and La Paz Road to the SR-73 Freeway Within the City

RECOMMENDATION
Staff recommends that the City Council:

1. Waive full reading and introduce Ordinance No. 2023-220, by title:

ORDINANCE NO. 2023-220

AN ORDINANCE OF THE CITY OF LAGUNA NIGUEL,
CALIFORNIA, AMENDING ORDINANCE NO. 91-45

TO ESTABLISH THE PRIMA FACIE SPEED LIMIT ON TWO

STREET SEGMENTS OF PACIFIC PARK DRIVE BETWEEN

ALICIA PARKWAY TO LA PAZ ROAD AND LA PAZ ROAD TO
THE SR-73 FREEWAY WITHIN THE CITY

2. Direct that the proposed Ordinance be placed on the agenda for adoption at the April 18, 2023 City Council meeting.

BACKGROUND
In accordance with State law, Engineering and Traffic Surveys (E&TS) are needed to establish speed limits and to update old surveys so that speed limits can be legally posted and enforced. Between 2020 and 2022, the City conducted E&TS on 95 street segments.

The speed limits map is provided as Attachment "A" and the speed study summary is provided as Attachment "B".

The California speed limit law is based on the "reasonable driver" premise, which concludes that most drivers (in statistical analysis, 85% of all drivers) drive in a reasonable and prudent manner based on the conditions they encounter and do not intentionally drive in a manner that will result in collisions or citations. As with most laws, speed limits need to depend on the voluntary compliance of the greater majority of motorists. Speed limits

Page 2 ends

cannot be set arbitrarily low, as this would create violators of the majority of drivers and would not command the respect of the public, nor would it comply with state law.

E&TS are conducted during off-peak hours on an average weekday when traffic is free flowing and individual driver behavior can be recorded. Once the information is gathered, the necessary calculations are made and an 85th percentile speed is determined. By law, the speed limit must be set at the closest 5 miles per hour (MPH) increment to the 85th percentile speed. If extreme or unusual conditions exist, then the speed limit may be lowered to the nearest 5 MPH increment.

Pursuant to California Vehicle Code (CVC) Section 40802, E&TS are valid for five years but can be valid for seven years if the citing officers have the proper training and the electronic speed measuring device has the proper certifications. The Orange County Sheriffs Department deputies assigned to the City of Laguna Niguel possess the training and equipment calibration testing certificates required by the CVC; therefore, the City's E&TS are valid for seven years from the date of survey. With the passage of California Assembly Bill (AB) 43 in 2021, E&TS can remain valid for 14 years if a registered engineer determines that no significant changes in roadway or traffic conditions have occurred, including, but not limited to, changes in adjoining property or land use, roadway width, or traffic volume. Although the law allows up to 14 years between surveys, the City of Laguna Niguel updates its surveys every seven years to ensure that any changes in traffic patterns and driving behavior are appropriately documented.

California AB 43 authorizes local jurisdictions to reduce or keep existing speed limits on public streets. The new law allows local governments to resist the consistent increase in speed limits over time, known as "speed creep," specifically stating that if an E&TS finds that the speed limit is still more than reasonable or safe, the local authority may retain the existing speed limit if that speed limit was already established with an E&TS and if a registered engineer has evaluated the section of the highway and determined that no general purpose lanes have been added to the roadway since completion of the E&TS that established the prior speed limit.

To influence driver behavior, the City of Laguna Niguel Public Works Department routinely implements traffic calming features on City roadway improvement projects and private development projects and finds opportunities to improve traffic safety by studying localized intersections and even entire corridors. Oversize speed limit signs, pavement legends, buffered bike lanes, speed feedback signs, and even signal louvres are some of the traffic calming measures that have been implemented on City streets. The Public Works Department has a partnership with the Orange County Sheriffs Department to manage speeds with targeted enforcement and deployment of portable speed feedback trailers that are strategically placed in areas of concern on a rotating basis. Both departments work together very closely to make safety the number one priority in Laguna Niguel.

Establishing speed limits supports City Council Goal 1 (Public Safety) and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.

ANALYSIS
Based on the surveys conducted, eight street segments would have required an increase in the posted speed limit based on the "reasonable driver" premise. However, the eight street segments were evaluated in accordance with AB 43, and consequently, the prior speed limit can be retained for the eight street segments listed in the following table:
85th
Percentile Existing
Street Segment Speed Speed Limit
(MPH) (MPH)
Alicia Pariso Creek Road to Highlands Avenue 58 50
Aliso Creek Road 49 40
La Paz Road to Moulton Parkway
Avila Road
43 35
La Paz Road to Alicia Parkway
Camino Capistrano 43 35
North City Limit to Paseo De Colinas
Camino Del Avion 51
40 East City Limit to Golden Lantern
Camino Del Avion 53 45
Bear Brand Road to Niguel Road
Crown Valley Parkway 54 45
La Paz Road to Niguel Road
Ocean Way 34 25
Pacific Island Drive to Cannes Trail
Additionally, there are two street segments on Pacific Park Drive that were evaluated that currently do not have a posted speed limit. The city boundary line along Pacific Park Drive generally runs along the raised center medians, where westbound Pacific Park Drive belongs to the City of Aliso Viejo and eastbound belongs to the City of Laguna Niguel.

There are existing posted speed limit signs of 45 MPH on westbound Pacific Park Drive between Alicia Parkway and the SR-73 freeway, but there are currently no speed limit signs posted in the eastbound direction.

Based on the new speed surveys, the 85th percentile speeds and recommended speed limits are as follows:
85th Recommended
Percentile Speed Limit
Street Segment Speed
(MPH) (MPH)
Eastbound Pacific Park Drive 48 45
Alicia Parkway to La Paz Road
Eastbound Pacific Park Drive
49 45
La Paz Road to SR-73 Freeway

Page 4 ends

By law, the speed limit shall be set at the nearest 5 MPH increment to the 85 percentile speed, which would be 50 MPH. Due to adjacent land uses, the City has discretion, per the CVC, to lower the speed limit by 5 MPH. It is recommended to implement a posted speed limit of 45 MPH on eastbound Pacific Park Drive, which is consistent with the posted speed limit in the westbound direction. Adoption of Ordinance No. 2023-220 would allow enforcement of the speed limit on eastbound Pacific Park Drive (Attachment "C").

Traffic and Transportation Commission Review
On February 22, 2023, the Traffic and Transportation Commission reviewed the Speed Limits for Streets Within Laguna Niguel discussion item (Attachment "D"). Based on the results from speed surveys presented by staff during the meeting, the Traffic and Transportation Commission approved staff's recommendation of no changes to existing speed limits and recommended that the City Council adopt the ordinance to establish new speed limits on the following street segments:

Eastbound Pacific Park Drive (Alicia Parkway to La Paz Road) - 45 MPH Eastbound Pacific Park Drive (La Paz Road to SR-73 Freeway) - 45 MPH Draft meeting minutes are provided in Attachment "E".

FISCAL REVIEW
The estimated cost to install the new speed limit signs is $1,200. There are sufficient funds in the Fiscal Year 2022-23 Public Works Department budget to cover the cost of the new signs.

LEGAL REVIEW
The City Attorney's Office has approved Ordinance No. 2023-220 as to form.

CONCLUSION
Staff recommends that the City Council:

1. Waive full reading and introduce Ordinance No. 2023-220, by title:

CITY OF LAGUNA NIGUEL

TRAFFIC AND TRANSPORTATION COMMISSION

AGENDA ITEM
To: Traffic and Transportation Commission Members
FROM: Kathy Nguyen, Engineering Services Manager/City Traffic Engineer DATE: February 22, 2023
SUBJECT: Speed Limits for Streets Within Laguna Niguel

RECOMMENDATION
Staff recommends that the Traffic and Transportation Commission:

1. Approve staff's recommendation of no changes to existing speed limits; and,

2. Recommend that the City Council adopt an ordinance to establish new speed limits on the following street segments:
• Eastbound Pacific Park Drive (Alicia Parkway to La Paz Road) - 45 MPH • Eastbound Pacific Park Drive (La Paz Road to SR-73 Freeway) - 45 MPH

BACKGROUND
In accordance with State law, Engineering and Traffic Surveys (E&TS) are needed to establish speed limits and to update old surveys so that speed limits can be legally posted and enforced (Attachment "A"). Between 2020 and 2022, the City conducted E&TS on 96 street segments. The latest Speed Survey Summary is provided as Attachment "B".

Speed limits cannot be set arbitrarily low, as this would create violators of the majority of drivers and would not command the respect of the public.

E&TS are conducted during off-peak hours on an average weekday when traffic is free flowing and individual driver behavior can be recorded. Once the information is gathered, the necessary calculations are made and an 85" percentile speed is determined. By law, the speed limit must be set at the closest 5 miles per hour (MPH) increment to the 85th

Page 2 ends

percentile speed. If extreme or unusual conditions exist, then the speed limit may be lowered.

Pursuant to California Vehicle Code (CVC) Section 40802, E&TS are valid for five years but can be valid for seven years if the citing officers have the proper training and the electronic speed measuring device has the proper certifications. The Orange County Sheriff's Department deputies assigned to the City of Laguna Niguel possess the training and equipment calibration testing certificates required by the CVC; therefore, the City's E&TS are valid for seven years from the date of survey.

California AB 43 authorizes local jurisdictions to reduce or keep existing speed limits on public streets. The new law allows local governments to resist the consistent increase in speed limits over time, known as "speed creep," specifically stating that if an E&TS finds that the speed limit is still more than reasonable or safe, the local authority may retain the existing speed limit if that speed limit was already established with an E&TS and if a registered engineer has evaluated the section of the highway and determined that no general purpose lanes have been added to the roadway since completion of the E&TS that established the prior speed limit
To influence driver behavior, the City of Laguna Niguel Public Works Department routinely implements traffic calming features on City roadway improvement projects as well as development projects and finds opportunities to improve traffic safety by studying localized intersections and even entire corridors. Oversize speed limit signs, pavement legends, buffered bike lanes, speed feedback signs, and even signal louvres are some of the traffic calming measures that have been implemented on City streets. The Public Works Department has a partnership with the Orange County Sheriff's Department to manage speeds with targeted enforcement and deployment of portable speed feedback trailers that are strategically placed in areas of concern on a rotating basis. Both departments work together very closely to make safety the number one priority in Laguna Niguel.

ANALYSIS
Based on the 96 E&TS conducted, eight street segments would have required an increase in the posted speed limit based on the "reasonable driver" premise. However, the eight street segments were evaluated in accordance with AB 43 and it is recommended that the existing speed limit be retained for the eight street segments listed

Based on the new speed surveys, the 85t percentile speeds and recommended speed limits are as follows:

Eastbound Pacific Park Drive

Based on the law, the speed limit shall be set at the nearest 5 MPH increment to the 85th percentile speed, which would be 50 MPH. Due to adjacent land uses, the City has discretion, per the CVC, to lower the speed limit by 5 MPH based on factors not readily available to motorists. Pacific Park Drive is adjacent to a residential area and well-

Page 4 ends

frequented retail centers. It is recommended to implement a posted speed limit of 45 MPH on eastbound Pacific Park Drive, which is the same as the posted speed limit in the westbound direction for consistency.

Staff recommends that the Traffic and Transportation Commission approve staffs recommendation of no changes to existing speed limits. Staff also recommends that the Traffic and Transportation Commission recommend that the City Council adopt an ordinance to establish a new speed limit of 45 MPH on eastbound Pacific Park Drive.

FISCAL REVIEW
The estimated cost to install the new speed limit signs is $1,200. There are sufficient funds in the Fiscal Year 2022-23 Public Works Department budget to cover the cost of the new signs.

LEGAL REVIEW
The City Attorney's Office has reviewed the ordinance and approved as to form.

CONCLUSION
Staff recommends that the Traffic and Transportation Commission:

1. Approve staff's recommendation of no changes to existing speed limits; and,

2. Recommend that the City Council adopt an ordinance to establish new speed limits on the following street segments:
: Eastbound Pacific Park Drive (Alicia Parkway to La Paz Road) - 45 MPH Eastbound Pacific Park Drive (La Paz Road to SR-73 Freeway) - 45 MPH Kaun

ORDINANCE NO. 2023-XX

AN ORDINANCE OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,
AMENDING ORDINANCE NO. 91-45 BY ESTABLISHING

THE SPEED LIMIT ON TWO STREET SEGMENTS WITHIN THE CITY
The City Council of the City of Laguna Niguel does ordain as follows:

SECTION 1. RECITALS
The City Council, by the adoption of Ordinance No. 91-45 on August 20, 1991, established speed limits on a substantial number of streets located within the City

2. To comply with State Law, the City Council must adopt new or revised speed limits in accordance with the latest Engineering and Traffic Surveys.

The City Council desires to establish the speed limit on two street segments:
• Pacific Park Drive (Alicia Parkway to La Paz Road) - 45 MPH • Pacific Park Drive (La Paz Road to SR-73 Freeway) - 45 MPH SECTION 2. SPEED LIMITS
Engineering and Traffic Surveys for speed limits are regularly conducted once every seven years by governing municipalities for the purpose of complying with Section 40802 of the California Vehicle Code. This law requires that speed surveys must be performed with the use of radar or other electronic devices at locations where speed limits are to be enforced with the use of radar.

The speed limits prior to the adoption of this amendment ordinance are identified in the controlling document used by the City of Laguna Niguel for speed limits. It is entitled "City of Laguna Niguel, Engineering and Traffic Surveys for Speed Limits, dated May 1991." This Ordinance amends the previously adopted document by adding the street segments) and the declared prima facie speed limit as identified below.
