2. Adopt Resolution No. 2023-1435, Adopting a List of Projects for Fiscal Year 2023- 24 Funded by SB 1: The Road Repair and Accountability Act of 2017.
BACKGROUND
On April 28, 2017, Governor Brown signed Senate Bill 1 (SB 1), also known as the Road Repair and Accountability Act of 2017. SB 1 sets aside per gallon fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees with inflationary adjustments to tax rates in future years to address basic road maintenance, rehabilitation, and critical safety needs on state and local streets.
On November 1, 2017, the State Controller began depositing these funds into the newly created Road Maintenance and Rehabilitation Account (RMRA). Each month, a percentage of the RMRA funds are apportioned by formula to the City for basic road maintenance, rehabilitation, and critical safety projects in Laguna Niguel.

ALTERNATIVES CONSIDERED
The City Council may decide not to adopt Resolution No. 2023-1435. This alternative is not recommended as it would result in the City not receiving an apportionment of RMRA funds from the CTC in Fiscal Year 2023-24.
FISCAL REVIEW
The estimated cost of newly proposed projects in Fiscal Year 2023-24 is $1,381,277. The City will receive an estimated $1,443,088 in RMRA funding in Fiscal Year 2023-24 from SB 1. Any funds expended beyond this year's allocation will be drawn from prior year's SB 1 remaining fund balance.
LEGAL REVIEW
The City Attorney's Office has approved the resolution as to form.
CONCLUSION
Staff recommends that the City Council:
1. Approve the recommended list of projects for Fiscal Year 2023-24 to be funded by SB 1: The Road Repair and Accountability Act of 2017; and,
2. Adopt Resolution No. 2023-1435, Adopting a List of Projects for Fiscal Year 2023- 24 Funded by SB 1: The Road Repair and Accountability Act of 2017.
