CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: June 20, 2023
SUBJECT: Orange County Transportation Authority OC Go (Measure M2) Eligibility Package Submittal

RECOMMENDATION
Staff recommends that the City Council:

1. Adopt Resolution No. 2023-1436, adopting a Seven-Year Capital Improvement Program for Fiscal Years 2023-24 through 2029-30 for compliance with the Measure M2 eligibility requirements;

2. Adopt Resolution No. 2023-1437, concerning the status and update of the Circulation Element and Mitigation Fee Program for the City of Laguna Niguel;,

3. Adopt Resolution No. 2023-1438, concerning the update of the Local Signal Synchronization Plan Update for the City of Laguna Niguel; and,

4. Direct staff to submit the City's OC Go (Measure M2) Eligibility Package to the Orange County Transportation Authority prior to June 30, 2023.

BACKGROUND
In November 2006, Orange County voters approved Measure M2, also known as OC Go, which authorized the 30-year continuation of a one-half percent retail transaction and use tax to fund needed transportation improvements. These programs provide competitive funding for various improvements such as street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects. In order to receive OC Go funds from the Orange County Transportation Authority (OCTA), local jurisdictions must comply with the eligibility criteria as summarized below.

Local jurisdictions are required to adopt some or all of the following prior to July 1 of each year in order to continue to be eligible for funding:

Seven-Year Capital Improvement Program - Annually;

Page 2 ends

Maintenance of Effort Certification - Annually;

3. An Eligibility Checklist - Annually;

4. A resolution confirming that the City is in compliance with the Master Plan of Arterial Highways and Mitigation Fee Program - Biennially;

5. A Congestion Management Plan Compliance Checklist - Biennially;

6. An Updated Pavement Management Plan - Biennially; and,

7. An Updated Local Signal Synchronization Plan - Every three years As part of this year's submittal package to OCTA, the City is required to submit documentation for items 1, 2, 3, 4, 5, and 7 as listed above. Item 6 will be required for submittal next year in June 2024.

The City risks losing access to funds from the Comprehensive Transportation Funding Programs and annual OC Go Local Fair Share formula funds if the eligibility requirements are not submitted in a timely manner.

Maintaining OC Go eligibility supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.

ANALYSIS
Seven-Year Capital Improvement Program
The City is required to prepare a Seven-Year Capital Improvement Program (CIP) to remain eligible for OC Go funding. This CIP includes all transportation-related projects and programs funded with Comprehensive Transportation Funding Programs and annual OC Go Local Fair Share formula funds. The projects include street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects.

The purpose of the CIP is to identify intended or potential use of OC Go funds. For each project listed in the CIP, projected funding amounts for design, right-of-way, and construction costs are included, where applicable. Some of the projects included in the CIP are the Active Transportation Study and Bicycle Green Zone Pilot Project, Golden Lantern Median Modifications at Serenity Lane, Local Roadway Pavement Rehabilitation Project, and the Residential Resurfacing Program.

Staff is recommending adoption of Resolution No. 2023-1436, which identifies transportation-related projects and programs (Attachment "A").

Maintenance of Effort Certification
The purpose of the Maintenance of Effort (MOE) certification is to document and demonstrate that Cities continue to spend at least the same amount of General Fund money for the maintenance of local roads and transportation-related streets projects as

Page 3 ends

they did prior to the passage of OC Go. The original MOE benchmark requirement was based upon a historic five-year average of General Fund expenditures from Fiscal Year 1985-86 to Fiscal Year 1989-90. The benchmark requirement is now adjusted once every three years (beginning in 2014) based upon the lesser of the Caltrans Construction Cost Index or general revenue growth for the City over the prior three-year period.

In April 2023, the OCTA Board of Directors approved a benchmark requirement of $988,702 for the City of Laguna Niguel.

Each June, the City must certify that it will meet its MOE requirement in the upcoming fiscal year. OCTA requests excerpts of the City's budget showing how the MOE benchmark will be met.

The Fiscal Year 2023-24 Public Works Operating and Capital Improvement Program budgets include the following eligible General Fund expenditures to satisfy the MOE requirement:

Median Island Maintenance $ 300,000
Street Lighting $ 750,000
Street Sweeping $ 260,000
Fiscal Year 2023-24 Total $ 1,310,000
Based on the above budget amounts, the City can certify that it will meet its MOE benchmark requirement as the budget exceeds the MOE benchmark requirement of $988,702 (Attachment "B").

Master Plan of Arterial Highways (MPAH) and Mitigation Fee Program Every two years, the City must submit a resolution attesting that no unilateral reduction in lanes has been made on any MPAH arterial streets over the last two fiscal years (Fiscal Years 2021-22 and 2022-23). The resolution is designed to ensure that the County's systems of roads remain intact to handle the existing and future traffic volumes. There have been no changes to the number of lanes during the two-year reporting period.

Every two years, the City must submit a resolution certifying that the City has an existing mitigation fee program that assesses traffic impacts of new developments and requires a fair share payment of necessary transportation improvements attributable to the new development.

Staff is recommending adoption of Resolution No. 2023-1437, attesting that no unilateral reduction in lanes has been made on any MPAH arterial streets over the last two fiscal years and reaffirm the City's mitigation fee program (Attachment "C").

Congestion Management Program (CMP) Compliance
The goals of Orange County's Congestion Management Plan (CMP) are to support regional mobility and air quality by reducing traffic congestion and provide a mechanism for coordinating land use and development decisions. Each jurisdiction must comply with

Page 4 ends

conditions and requirements to be considered eligible for funding. Some of the requirements include reviewing Level of Service for roadways, Land Use Analysis and their impacts to transportation systems, and Modeling and Data Consistency guidelines.

Every two years, the City complies with the requirements of the CMP through a checklist submission (Attachment "D"). The checklist confirms that the City of Laguna Niguel conforms to the criteria established by OCTA so that the City can qualify for the allocation of revenues generated from Measure M2.

Local Signal Synchronization Plan Update
In 2020, the City adopted an update to its Local Signal Synchronization Plan (LSSP) and forwarded the update to OCTA to remain eligible for funding. The updated LSSP conforms to and is consistent with the Regional Signal Synchronization Master Plan.

Every three years, the City must adopt an update to its LSSP to comply with the requirements of the OC Go program through the eligibility submission process. The updated plan documents the activities of the City in regards to its traffic signal system including signal timing along synchronized streets and reports on the status and performance of signal synchronization activities.

In this update, one corridor (Aliso Creek Road) has been completed, two corridors (Crown Valley Parkway and Moulton Parkway/Golden Lantern) are in progress, and four corridors (Alicia Parkway, La Paz Road, Niguel Road, and Camino Del Avion) are eligible for future grant funding.

Staff is recommending adoption of Resolution No. 2023-1438 (Attachment "E"). A copy of the LSSP is available in the City Clerk's Office for review.

ALTERNATIVES CONSIDERED
The City Council may decide not to submit the annual eligibility package. This is not recommended as this alternative would risk the City losing access to OC Go funds including local fair share and grant funding opportunities.

FISCAL REVIEW
The Seven-Year CIP lists several transportation improvement projects. For each This intormation can be
improvin Exhibit oct tachmenty funding sources are listed.

LEGAL REVIEW
The City Attorney's Office has reviewed the resolutions and has approved the resolutions to form.
