CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
1989
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: August 1, 2023
SUBJECT: Approval of Final Parcel Map 2019-161

RECOMMENDATION
Staff recommends that the City Council:

1. Approve Final Parcel Map 2019-161; and,

2. Accept the dedication of the five-foot-wide public access easement as shown on Final Parcel Map 2019-161.

BACKGROUND
On August 10, 2021, the Planning Commission adopted Resolution No. 21-06 to conditionally approve Tentative Parcel Map TPM 2019-161 which would divide an existing 25,211 square-foot parcel into two separate parcels to facilitate the development of one new residential dwelling unit (Attachment "A"). The applicant's project is located at 29371 Thackery Drive (Attachment "B").

A General Plan Amendment was required to increase the projected number of residential dwelling units within this area by one dwelling unit and facilitate development of the unused portion of the applicant's property in a manner compatible with surrounding land uses. On September 7, 2021, the City Council unanimously adopted Resolution No. 2021- 1369, as recommended by the Planning Commission, to approve the applicant's request for General Plan Amendment GPA 19-02 (Attachment "C"). Once the lot is divided, both parcels will meet the minimum requirements in terms of size and adequate frontage, and any future development on the newly created parcel will be required to comply with all applicable development standards for this zoning district.

A concrete walkway currently exists on the property and provides residents of this neighborhood access to Clipper Cove Park from the terminus of Thackery Drive (Attachment "D"). Although this access path has been in existence and in use for years, the current title report for this property does not provide any explicit reference to a recorded public access easement. The applicant proposes to leave the concrete walkway in place. To memorialize the existing use and ensure public access is preserved, a condition was included in the approval of Tentative Parcel Map TPM 2019-161 requiring

Page 2 ends

a five-foot-wide public access easement encompassing the existing sidewalk and extending from the terminus of Thackery Drive to Clipper Cove Park to be irrevocably offered for dedication to the City of Laguna Niguel on the final map.

The project qualifies for an exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15303 (Class 3, New Construction or Conversion of Small Structures) and Section 15332 (Class 32, In-Fill Development Projects).

ANALYSIS
In accordance with Section 66458 of the Government Code, if the final map conforms to all requirements of the Subdivision Map Act of the State of California and the local subdivision ordinance applicable at the time of the tentative map approval or conditional approval and any rulings made thereunder, the final map shall be approved by the City Council at the meeting at which the final map is received or at the next regular meeting.

All applicable conditions of approval tied to the recordation of the final map have been satisfied. Therefore, it is recommended that the City Council approve Final Parcel Map 2019-161 and accept the dedication of the five-foot-wide public access easement as shown on Final Parcel Map 2019-161 (Attachment "E").

The recommended action supports City Council Goal 5 (Economic and Community Development) of the City's adopted Strategic Plan.

ALTERNATIVES CONSIDERED
The City Council may decide not to approve Final Parcel Map 2019-161. This alternative is not recommended because the final map conforms to all requirements of the Subdivision Map Act of the State of California and the local subdivision ordinance.

However, the City Council may decide to defer approval to the next regular meeting.

FISCAL REVIEW
There is no fiscal impact as a result of the approval of Final Parcel Map 2019-161. The project applicant is responsible for all costs associated with the review and approval of this map.

LEGAL REVIEW
The City Attorney's Office has reviewed and approved this report as to form.

CONCLUSION
Staff recommends that the City Council:

1. Approve Final Parcel Map 2019-161; and,

2. Accept the dedication of the five-foot-wide public access easement as shown on Final Parcel Map 2019-161.

RESOLUTION OF THE PLANNING COMMISSION OF

THE CITY OF LAGUNA NIGUEL, CALIFORNIA,
APPROVING TENTATIVE PARCEL MAP TPM 2019-161
(DAMIAN RESIDENCE - 29371 THACKERY DRIVE)
WHEREAS:

The APPLICANT: Andrei Damian, 29371 Thackery Drive, Laguna Niguel, C/ 32677, is requesting to subdivide 29371 Thackery Drive (APN 655-261-12 and 13) generally located north of Niguel Road between Alicia Parkway and Highland:
ivenue in the City of Laguna Niguel. The Tentative Parcel Map would divide the existing 25,211-square-foot parcel into two separate parcels to facilitate the development of one new residential dwelling unit.

2. A notice of public hearing describing the project, date, time and location of the hearing was advertised in the Coastal Current News at least 10 days prior to the hearing date. Hearing notices were mailed to property owners within 300 feet of the project boundaries and the Crown Valley Highlands Community Association and Hillcrest Village Homes Community Association (the project site is not located within a homeowners' association). A notice was also posted at City Hall and was made available on the City's website.

3. The Planning Commission of the City of Laguna Niguel finds and determines as follows:
a. Consistency with the General Plan - The 25,211-square-foot project site is located within Community Profile Area 7, Sub-profile Area B (Laguna Crest/Knoll), of the Laguna Niguel General Plan. The Laguna Niguel General Plan Land Use Element designates Sub-Profile Area B as a mix of Residential Detached, Residential Attached, and Parks and Recreation land uses. A maximum of 303 residential units are projected for this sub area. Subject to approval of General Plan Amendment 19-02 to increase the number of projected dwelling units from 303 units (3.13 dwelling units per acre) to 304 dwelling units (3.14 dwelling units per acre, the proposed project is consistent with the land use designation and growth projections of the Laguna Niguel General Pian. The addition of one single-family residence within the existing single-family neighborhood would contribute to the number of new residential dwelling units in the City, would not alter the land uses within the area or result in significant impacts to existing density or traffic, and would afford the applicant greater use of his property.
b. Consistency with the Zoning Code - The proposed project is consistent with the applicable requirements of the Laguna Niguel Zoning Code (LNZC). The proposed division does not affect the existing zoning designation for the project Resolution No. 21-06 Page 2
TPM 2019-161 (Damian Residence)
site, "Single-Family Residential" (RS-3) Zoning District. The two proposed parcels both exceed the minimum lot area standard of 3,000 square feet (Parcel 1 - 11,403 square feet and Parcel 2 - 13,808 square feet). c. Compliance with the California Environmental Quality Act (CEQA) - The project qualifies for an exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15303 and 15332 under Class 3 (New Construction or Conversion of Small Structures) and Class 32 (In-Fill Development Projects). Class 3 consists of construction and location of limited numbers of new, small facilities or structures, including but not limited to one single-lamily residence in a residential zone. Class 32 consists of projects characterized as in-fill development: consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations; occurring within city limits on a project site of no more than five acres substantially surrounded by urban uses; occurring on a project site that has no value as habitat for endangered, rare or threatened species; where approval of the project would not result in any significant effects relating to traffic, noise, air or water quality; and if the site can be adequately served by all required utilities and public services.
d. Supplemental Subdivision Findings - The project site is physically suitable for the type and density of development and the newly created parcel and proposed residence comply with all applicable development standards. The proposed parcel would be comparable in size and shape to existing surrounding parcels and the proposed new residence would be similar in scale to other residences on the same street and within the neighborhood. The design of the proposed project and the type of improvements will not cause serious public-health problems. The proposed project will not conflict with three existing easements through or use of property within the project. There is an existing 30-foot-wide City easement for drainage purposes and an existing 30- foot Moulton Niguel Water District easement for water lines and sanitary sewer purposes, both extending from the terminus of Thackery Drive to Clipper Cove Park along the proposed new shared property line. There is also a third private easement which is a triangular sliver of land that adds to the driveway width for the adjacent residence at 29372 Thackery Drive. All of these easements on the site will remain in place and will not be affected by the proposed development.

There is also an existing public sidewalk that leads to Clipper Cove Park from the terminus of Thackery Drive that bisects the property, and that has been in use for many years. The existing public sidewalk from Thackery Drive to Clipper Cove Park will remain, and the conditions require that a five-foot wide public access easement encompassing the current sidewalk and extending from the terminus of Thackery Drive to Clipper Cove Park to be irrevocably offered for dedication to the City of Laguna Niguel on the final map. Adequate utility services and capacities exist now or will exist prior to occupancy to serve the project. Discharge of wastewater from the project site into the existing community sewer system would not result in or add to a violation of existing Resolution No. 21-06 Page 3
TPM 2019-161 (Damian Residence)
requirements prescribed by either Santa Ana or San Diego Regional Water Quality Control Boards. Finally, the site is located in an area for which fees to fund facilities and services have been adopted, and conditions of approval within Resolution No. 21-06 obligate the applicant to pay applicable fees prior to building permit issuance.

THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Tentative Parcel Map TPM 2019-161, subject to the following conditions:

Approval of General Plan Amendment - The approval of Tentative Parcel Map TPM 2019-161 is contingent on, and shall not be effective unless and until, City Council approval of General Plan Amendment GPA 19-02 to increase the maximum number of residential dwelling units in Community Profile Area 7, Sub-profile Area B (Laguna Crest/Knoll) from 303 to 304 dwelling units.

RESOLUTION NO. 2021-1369

A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENT GPA 19-02
(DAMIAN RESIDENCE)
WHEREAS, the APPLICANT: Andrei Damian, 29371 Thackery Drive, Laguna Niguel, CA 926/7, requests approval of General Plan Amendment GPA 19-02 to increase the maximum number of residential dwelling units in Community Profile Area 7, Sub-profile Area B (Laguna Crest/Knoll) of the Laguna Niguel General Plan by one dwelling unit from 303 to 304 dwelling units.

WHEREAS, the application for General Plan Amendment GPA 19-02 was submitted to the City in conjunction with the applicant's request for approval of Tentative Parcel Map TPM 2019-161 to subdivide the applicant's property at 29371 Thackery Drive into two lots.

WHEREAS, on August 10, 2021, the Planning Commission held a duly noticed public hearing on General Plan Amendment GPA 19-02 and Tentative Parcel Map TPM 2019-161, at which time it considered all evidence presented, both written and oral, and thereafter unanimously recommended that the City Council approve General Plan Amendment GPA 19-02, and approved Tentative Parcel Map TPM 2019-161 conditioned on the City Council's approval of GPA 19-02.

WHEREAS, during the project review process and pursuant to Senate Bill SB 18 (required consultation with Native American Tribes), the City mailed consultation letters with a detailed project description to local tribes identified by the Native American Heritage Commission (NAHC). No requests for consultation or comments were received during the requisite 90-day response period for this notification.

WHEREAS, a notice of public hearing describing the project, date, time and location of the September 7, 2021, City Council hearing was advertised in the Laguna Niguel News at least 10 days prior to the hearing date. Hearing notices were mailed to property owners within 300 feet of the project boundaries, the Crown Valley Highlands Community Association and the Hillcrest Village Homes Community Association. A notice was also posted at City Hall and was made available on the City's website.

WHEREAS, the City Council has determined the project qualifies for an exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15303 (Class 3, New Construction or Conversion of Small Structures) and Section 15332 (Class 32, In-Fill Development Projects) of the State CEQA Guidelines prior to taking action on GPA 19-02.

WHEREAS, the City Council has determined that GPA 19-02 is internally consistent with the goals, objectives, and policies of the LNGP which are not being amended, including the following:

Resolution No. 2021-1369 Page 2
Land Use Element, Policy 3.4: Ensure that residential densities are compatible with the surrounding land uses and buildings are in scale with the neighborhood character. A maximum of 303 residential units are projected for this sub area.

Subject to approval of General Plan Amendment GPA 19-02 to increase the number of dwelling units from 303 units (3.13 dwelling units per acre) to 304 dwelling units (3.14 dwelling units per acre), the proposed project is consistent with the land use designation and growth projections of the General Plan.

The subject property is located along Thackery Drive at the end of the cul-de-sac.

The lot sizes along Thackery Drive range from. 15 acres to .33 acres (excluding the project site). The area surrounding the property is built-out and surrounded by existing single- and two-story single-family dwellings that generally range in size from 2,000 square feet to 4,000 square feet. The proposed subdivided parcels (.26 acres and .32 acres) would be comparable in size and shape to existing surrounding parcels. Approval of the general plan amendment would facilitate development of the unused portion of the applicant's property in a manner compatible with surrounding land uses. Future development on the newly created parcel will be required to comply with all applicable development standards for this zoning district. • Housing Element, Policy 1.3: Promote a variety of housing opportunities that accommodate the needs of all income levels of the population. The addition of one single-family residence will contribute to the overall number of new residential dwelling units in the City and is characteristic of the existing housing type in the surrounding neighborhood.
• Housing Element, Program Objective 1: Identify and monitor the use of vacant land for the construction of new housing units to meet RHNA allocation. The existing 25,211-square-foot site greatly exceeds the minimum 3,000 square-foot size requirement for lots in the RS-3 Zoning District. Sufficient street frontage and lot dimensions exist to create two compliant residential building sites. Approval of the general plan amendment would allow construction of an additional housing unit thereby contributing to the number of new housing units in the City.

NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Laguna Niguel as follows:

The City Council does hereby amend the General Plan Land Use Element Statistical Summary for Community Profile Area 7, as shown in Exhibit 1 attached hereto; and,

2. The City Council does hereby amend the General Plan Land Use Element text for Laguna Crest/Knoll, as shown in Exhibit 2 attached hereto.
