CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: September 5, 2023
SUBJECT: Approval of Amendment No. 2 to the Professional Services Agreement with Park Consulting Group, Inc. to Provide On-Call Land Management Software (LMS) Implementation Services

RECOMMENDATION
Staff recommends that the City Council:

1. Approve Amendment No. 2 to the Professional Services Agreement with Park Consulting Group, Inc. to provide on-call land management software services, to replace the annual not to exceed amount of $150,000 for three years ($450,000 aggregate) with a total not to exceed amount of $450,000 through June 30, 2025; and,

2. Authorize the City Manager to execute Amendment No. 2 to the Professional Services Agreement between the City and Park Consulting Group, Inc., and future amendments to the agreement subject to the City Attorney making non-substantive changes.

BACKGROUND & ANALYSIS
Un October 18, 2022, the City Council approved Amendment No. 1 to the Professional Services Agreement with Park Consulting Group, Inc., to provide on-call land management software (LMS) implementation services in an annual amount not to exceed $150,000 through June 30, 2025 ($450,000 aggregate over three years), in support of Tyler Technologies, Inc.'s EnerGov software build-out and implementation.

Since this time, City staff and Park Consulting Group, Inc. have been working diligently during the build-out process, resulting in being ahead of schedule. Typically, a LMS build- out and implementation takes approximately three years to complete. However, due to the newly expedited timeline, staff anticipates going live with the new software within roughly one year of implementation in Spring 2024.

As a result of the accelerated timeline, costs are being realized over a shorter period of time than originally projected, necessitating an update to the agreement, which removes the annual terms while still retaining the total approved agreement not to exceed amount of $450,000.

Page 2 ends

Although the project is ahead of schedule and very likely to be completed well in advance of the June 30, 2025, agreement term limit, staff does not recommend altering this term limit to safeguard against any unforeseen delays or project implementation issues that may occur. Based on the above, staff recommends a total not to exceed amount of $450,000 with the approval of Amendment No. 2 to the Professional Services Agreement with Park Consulting Group, Inc. (Attachment A) to run through the completion of the contract term.

ALTERNATIVES CONSIDERED
The City Council may decide not to approve Amendment No. 2 to the Professional Services Agreement with Park Consulting Group, Inc. This alternative is not recommended as it would result in delays of services and postpone the LMS software implementation completion and expedited go-live date.

FISCAL REVIEW
Adequate funding is available within the approved Fiscal Year 2023-2024 Community Development Department budget, including but not limited to the California Energy Commission solar grant and LEAP planning grant funds, to cover costs incurred under the agreement.

LEGAL REVIEW
The City Attorney has reviewed and approved the agreement and this staff report as to form.

CONCLUSION
Staff recommends that the City Council:

1. Approve Amendment No. 2 to the Professional Services Agreement with Park Consulting Group, Inc. to provide on-call land management software services, to replace the annual not to exceed amount of $150,000 for three years ($450,000 aggregate) with a total not to exceed amount of $450,000 through June 30, 2025;

2. Authorize the City Manager to execute Amendment No. 2 to the Professional Services Agreement between the City and Park Consulting Group, Inc., and future amendments to the agreement subject to the City Attorney making non-substantive changes.
