CITY OF LAGUNA NIGUEL
CITy CouncIL AgEnDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: January 16, 2024
SUBJECT: Approval of Amendment No. 1 to the Professional Services Agreement with Linscott, Law & Greenspan, Engineers (LLG) to Support Continued Coordination of the Laguna Niguel General Plan Update Traffic Study

RECOMMENDATION
Staff recommends that the City Council:

1. Approve Amendment No. 1 to the Professional Services Agreement with Linscott, Law & Greenspan, Engineers (LLG) to increase the contract amount by $130,297 for coordination with City staff regarding questions and comments throughout the General Plan Update Traffic Study, for a total not to exceed amount of $350,000;

2. Approve a not-to-exceed 10% contingency of the total contract in the amount of $35,000 for unforeseen additional work and authorize the Community Development Director to approve additional work for a total not-to-exceed amount of $385,000, if needed; and,

3. Authorize the City Manager to execute Amendment No. 1 to the Professional Services Agreement between the City and Linscott, Law & Greenspan, Engineers (LLG), subject to the City Attorney making non-substantive changes.

BACKGROUND & ANALYSIS
On December 7, 2021, the City Council approved the Professional Services Agreement with Linscott, Law & Greenspan, Engineers (LLG), to coordinate, facilitate, and prepare the Laguna Niguel General Plan Update Traffic Study for an amount not-to-exceed $219,703. Items comprised in the initial scope of work for Phase 1 of the General Plan Update were the preparation of two traffic study reports, the Level of Service (LOS) Traffic Study and Vehicle Miles Traveled (VMT) Traffic Study.

In addition to the work items included as part of Phase 1, staff now anticipates the need for additional coordination and analysis with Linscott, Law & Greenspan, Engineers (LLG) throughout Phase 2 of the General Plan Update process (Attachment "A"). The current contract scope is adequate to accommodate the work; however, the original approved budget is not. As such, staff recommends increasing the total compensation to an amount

Page 2 ends

not to exceed $350,000, an increase of $130,297. In addition, staff recommends the agreement include a not-to-exceed 10% contingency of the total contract amount of $35,000 for unforeseen additional work for a total not-to-exceed amount of $385,000.

ALTERNATIVES CONSIDERED
The City Council may decide not to approve Amendment No. 1 to the Professional Services Agreement with Linscott, Law & Greenspan, Engineers (LLG). However, this alternative is not recommended as it would compromise staff's ability to complete the necessary analysis under Phase 2 of the General Plan Update.

FISCAL REVIEW
Adequate funding is available within the adopted Fiscal Year 2023-2024 Community Development Department budget, to cover costs incurred under the agreement during this budget cycle.

LEGAL REVIEW
The City Attorney has reviewed and approved the agreement and this staff report as to

CONCLUSION
Staff recommends that the City Council:

1. Approve Amendment No. 1 to the Professional Services Agreement with Linscott, Law & Greenspan, Engineers (LLG) to increase the contract amount by $130,297 for coordination with City staff regarding questions and comments throughout the General Plan Update Traffic Study, for a total not to exceed amount of $350,000;

SCOPE OF WOrK GREENSPAN
CITY OF LAGUNA NIGUEL GENERAL PLAN UPDATE TRAFFIC STUDY engineers TASK 1 - REFINE/UPDATE OCTAM FOR CITY OF LAGUNA NIGUEL FOR THREE (3) LAND

USE ALTERNATIVES

1.1 Coordinate with City staff to discuss the project, identify pertinent traffic issues and concerns to develop a citywide traffic forecast model for the General Plan Update.

Additionally, this citywide traffic forecast model will also establish the framework for Vehicle Miles Traveled (VMT) analysis and allow future development within the City to be fully compliant with Senate Bill (SB) 743. The City's objective is to have an accurate transportation forecast model to analyze future projects, roadway, transit, active transportation, and multimodal projects through VMT analysis as the City prepares its General Plan Update.

1.2 Develop the Laguna Niguel Transportation Analysis Model that will tier-off the Orange County Transportation Analysis Model 5.0 (OCTAM 5.0) model and will allow for micro-level detail, validation, and refinement within each Traffic Analysis Zone (TAZ) within the City's jurisdiction It should be noted that the City currently relies on the OCTAM, prepared by the Orange County Transportation Authority (OCTA), for its modeling needs and rather than relying on a macro-level traffic model for City and traffic analysis zone (TAZ) level analyses, the City will develop its own City-specific model.

1.3 Collect traffic counts and data to validate the inputs and results. The Laguna Niguel Transportation Analysis Model will be calibrated to existing conditions based on current traffic counts. LLG will provide recommendations on how the Covid-19 pandemic has potentially altered traffic patterns and will provide appropriate refinements to calibrate the Laguna Niguel Transportation Analysis Model. The Laguna Niguel Transportation Analysis Model will be a tool calibrated to the specific details and characteristics of the local area that may not be included in the existing regional OCTAM. Its micro-level adjustments will facilitate accurate VMT analysis for all future potential projects.

1.4 Verify in the field the existing roadway network for the base year model. All planned buildout network improvements will be confirmed for inclusion within the future year model.

1.5 Coordinate with the City and confirm all Existing and Buildout model inputs.

1.6 Coordinate with other appropriate local agencies and confirm/verify existing and buildout inputs for the Laguna Niguel Transportation Analysis Model.

1.7 Each TAZ within the City will be reviewed with microscopic detail and the most recent adopted socioeconomic data and land uses will be inputted and validated, in addition to 16 LINSCOTT

SCOPE OF WORK (CONTINUED)
CITY OF LAGUNA NIGUEL GENERAL PLAN UPDATE TRAFFIC STUDY engineers network assumptions. Socioeconomic data will be consistent with the City's General Plan for the base model and Updated General Plan for the updated base model, respectively.

The socioeconomic data will be reviewed by the City and will include the number of households, population demographics, employment, etc., within each TAZ.

1.8 Calibrate the Laguna Niguel Transportation Analysis Model to allow for more precise, detailed integration of City land uses to improve long-term induced travel modeling capabilities.

1.9 After calibration, conduct sensitivity analyses in order to further refine and validate the model. Intricate adjustments to these statistics and details will be made as needed in order to provide more accurate VMT calculations and volume forecasts.

1.10 Vet the VMT data for every TAZ within the City by applying the proper significance thresholds and screening criteria.

1.11 Validate and confirm that the VMT results are in-line and consistent with the City and adjoining jurisdictions and also address any VMT issues that have been identified within the larger-scale OCTAM.

1.12 Following completion of an accurate base and future year of the Laguna Niguel Transportation Analysis Model, create low VMT area screening maps. All VMT data per TAZ will be documented for the City's use and any additional concerns will be addressed.

1.13 Once the base and future traffic models are updated, refined and calibrated for the Current General Plan, coordinate with the City Staff to obtain the existing land use data for all portions of the City for the General Plan Update. It should be noted that the City is currently organized into fourteen (14) Community Profile Areas (CPA), however, that organization may change in the General Plan Update.

1.14 Prepare and conduct full model runs for the scenarios listed below utilizing OCTAM. The land uses in the TAZs will be changed to reflect the proposed land uses:
• Baseline Conditions for Current General Plan
• Baseline Conditions for General Plan Update
• Cumulative Conditions for Current General Plan
• Cumulative Conditions for General Plan Update

1.15 Conduct adequate sensitivity modeling for three (3) land use alternatives to be provided by City Staff for the above analysis scenarios. Land use data will be organized by existing TAZs.

1.16 Evaluate the scenarios noted above for the Baseline and Cumulative conditions, and summarize the following types of VMT:
• Project generated VMT per capita (VMT/Cap), VMT per employee (VMT/Emp) and/or VMT per service population (VMT/SP) and comparing it to the appropriate benchmark noted in the City's Guidelines.
• Project effect on VMT; comparing how the Project changes VMT on the network looking at Citywide VMT.

1.17 Calculate the Baseline and Cumulative City average VMT per capita (VMT/Cap), VMT per employee (VMT/Emp), VMT per service population (VMT/SP) and/or Citywide VMT.

1.18 Recommend mitigation for VMT impacts that include modifying the proposed land uses to reduce VMT generated, implementing transportation demand management (TDM) measures to reduce VMT generated, and/or participation in a VMT fee program.

Jtilize CAPCOA's Quantifying Greenhouse Gas Mitigation Measures: A Resources fo ocal Government to Assess Emission Reductions from Greenhouse Gas Mitigatio Measures and other sources to quantify effects of the mitigation. LLG will also consider the mitigation measures listed in Technical Advisory on Evaluating Transportation Impacts in CEQA, Updating Transportation Impact Analysis in the CEQA Guidelines:
